Of course you'd charge him with rape. The core of a justifiable shooting is that the shooter reasonably feared for his life or the life of others. To put in that hypothetical that he has time to consider rape, and do it, both of which proves he wasn't really in physical jeopardy at the time and didn't have to do that. On the other hand if all that's left is two intruders, one big hole in each, and your side of the story, it's quite obvious your life was in jeopardy and you did what you felt you had to, right? |

His home has been robbed 8 times in the past year, there have been several other break-ins in his neighborhood recently. The 18 year old legal adult who broke into his home was a pill junkie. This wouldn't be a discussion if these kids were hideously deformed. |

Maybe he brought them to the house to kill them. The way he killed them the talked about it , justifies murder charges. Even in your home you can not kill somebody intentionally thus the second shots with intent to kill. also he waited all night before calling the cops?Waiting for them to be dead,because he intended to kill them rather then to defend his property with deadly force. Deadly force is defined as the gun . The intent to kill can not be part of self defense. Only self defense people, to stop the threat. This man incriminated himself.What he did was Murder. Yes it would , it would also reveal the distance of each shot.So if you shoot them a second time while they are incapacitated point blank they will have intent to kill.Thus its not self defence anymore. A lot of people dont understand that deadly force is the means you deliver the force.How you defend yourself and property could cause death of the individual, thus a gun,knife etc. If they die from deadly force its justified , but you can not intend kill them. Like shooting them point blank under the chin to stop breathing. |

You cant just shoot em because they are in your house in alot of states...although i think we should be able to light their ass up with lead if they are in your house. People have sat by on their duffs for yrs and did nothing to change it...so, here we are. |

God Bless Texas. In Texas he would have been charged with murder. I just told you the law. The first kid was shot and fell down the stairs, then he walked up shot the kid in the face. Formed the intent to murder , after the threat was gone. The girl he shot, she laughed at him when the gun jammed laying on the floor. He pulls out a 22 pistle and shoots her again. He drags her to the basement. she was still breathing , he told cops he put the gun under her chin and shot her through the back of the head to make her stop breathing. He formed intent to murder them both, well past self defense. After he shot them one time , and they was on the ground bleeding to death . He should have then called the police. He waited till the next morning after looking for a lawyer from his neighbor. I believe he is lying , because dead kids cant tell their side of the story.They look like wealthy kids.
