Your Right of Defense Against Unlawful Arrest

“Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529. The Court stated: “Where the officer is killed in the course of the disorder which naturally accompanies an attempted arrest that is resisted, the law looks with very different eyes upon the transaction, when the officer had the right to make the arrest, from what it does if the officer had no right. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.”

“One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. As for grounds for arrest: “The carrying of arms in a quiet, peaceable, and orderly manner, concealed on or about the person, is not a breach of the peace. Nor does such an act of itself, lead to a breach of the peace.” (Wharton’s Criminal and Civil Procedure, 12th Ed., Vol.2: Judy v. Lashley, 5 W. Va. 628, 41 S.E. 197)

I grew up in Cleveland and it used to be a great city to be in. The neighborhood I grew up in wasn't a rich neighborhood but everyone looked out for each other. We took care of one another. This was off of W. 25th street which it a ghetto now. I don't really go down there very much anymore. I used to say I would never leave the City because of how much I loved it. I changed my mind about that area when I had kids. There was a drug house 2 doors down from where I lived which I was unaware of until it was raided. The same week there was a drive by shooting so I decided to move to a better area in Cleveland(Westpark) that even got to be bad after about 10 years.

The problem with the city of Cleveland is the people that run the city they are ALL crooks, they don't care. They changed the law a few years back that if you lived in the city you no longer had to reside in it. The police, firemen,etc moved so fast your head would spun around. Since they left it had doubled with crime. When you no longer have police living on your street, they seem to want the street they live on to be safe. It was over once they left.

This is just my opinion...the police that shot these people are guilty. They should all be charged and lose the jobs they have. You are damn right when you say these 2 were scared of the police they should be. The cops in this town are fucking vigilantes and the politicians are so worried about getting swimming pools and going on "business" trips to other countries they just don't have time to address the crime. It really is a shame. This city is one step away from being Detroit.

First of all, were any of you there? Neither was I. You're passing judgement on someone based on a news story written by someone else that also wasn't there before all the facts are even out. That being said let's look over a few things that were already mentioned.

A. No gun found, so what? It is easy enough to toss one out the window at any point. That point is null. Let's instead wait for the tests to come back on the gun shot residue before jumping to conclusions.

B. There is an investigation in progress. We don't even have all of the facts yet and people are already pointing the finger at the police. You sicken me. You had your mind made up before you even finished reading the headline. I have respect for anyone that chooses a career that puts their lives in danger in order to protect a random citizen that they've never met. I thank them for what they do. This applies to the military as well.

C. 137 rounds? Sounds like a lot, right? You ever tried shooting through a windshield of a car? Me neither, but I've seen it done and it takes a lot of rounds. The car was being used to ram police cars and attempting to run over an officer. That officially makes the car a weapon. At that point, I see no issue with firing until that threat is no longer a threat. If it takes 137 rounds, then so be it. In my mind, I say you fire until that car is no longer moving.

D. If there was no gun, then why did they run in the first place. If it was a misunderstanding, you pull over and explain it and everyone goes home ALIVE. I've been stopped by the police many times and it's never once ended in a shoot-out.

E. Police don't have the luxury of sitting around reading news articles for days and analyzing the series of events. They are forced to make an immediate decision. Any hesitation can result in the death of an innocent bystander or fellow officer.

It's disgusting that it has somehow become 'the cool thing to do' to blame the police. I'm not sure why people immediately attack the people that are there to protect us. You can throw up all of your hate towards the police and they'll still be there to save your life if the situation presents itself.
