Police Arrest Me For Taking a Bike Out Of The GARBAGE!! "North Arlington NJ"

I see nothing wrong with trash picking, it's recycling. Better that someone actually use something then end up in overcrowded landfills.

Some "picker" once stole a bike out of my yard, and it was nowhere near the trash.

Where I live, people will often put a sign out that says "free stuff", because according to our town laws, once you put something at the curb for pickup, it belongs to the town. Not that they bother to enforce it, but they could.

Yeah, the kind that looks like this while they're taking their last breath upon this earth...

Hmmm. On those investigator/forensic shows they always show cops taking suspects trash to go through it. Their rationale is that once you put your garbage on the public curb it's no longer yours. Was it on the curb or technically still on their driveway? Garbage truck won't touch my garbage if the bin is even halfway still touching the driveway. It must not be touching any part of property.

It belongs to the town...you mean it belongs to the town workers that come by to dispose of all this, and THEY then take it home.

I've taken things out of the garbage that I thought were useful. I've also put things out for the garbage hoping someone would pick them up before the trash truck came, and they did pick them up. I was happy.

I don't understand why any normal person would care if someone took something out of the garbage that they found useful.

I think it's a good thing. Too much is thrown away, the landfills are overcrowded.

I don't want people going through my stuff, even though I shred any papers with personal info on them, people can still get information on you by digging through your trash...plus if they get hurt on your property they can sue...I once threw a broken chair in a dumpster I own and it landed on some bum's head...he cussed me for it when he was INSIDE my dumpster!

Wow. Lots of complete assholes on this site apparently. I had absolutely no idea anyone could get arrested for taking trash. The courts have ruled that trash is no longer yours when it hits the curb. The pig-thugs are allowed to go through your trash to look for things to arrest you for. Supreme Court said so years ago.

I'd fight it in court. Established precedent says you did nothing wrong. I take things from the trash all the time. Couple years ago I got $2000 worth of gold from "fake" jewelry some moron tossed out. The cane I use to walk with was found in the trash. The box for my car speakers was found in the trash. I have found several computers, fixed and sold them all from the trash.

When I was a teenager I would hang out at the landfill and scoop up televisions people threw out, fix them and then sell them. Made good money like that.

Trash is free stuff. Anyone who has a problem with that is a giant, stinky asshole with no sense of decency.

If it's tossed into the trash.. it's public property. Why is it that cops will dig through a suspect's garbage for phone bills bank statements etc.

Because once you toss it into the trash it's public domain and fair game for any one to look at or take. There is no expectation of privacy & no further anticipated use.

Claiming there is a law where there clearly isn't is a troll tactic and another kick in the nuts for what little constitution you have left..

So unless the owner is claiming they set the bike against the trash while they ran inside for something, there's no great crime in some one coming along and making use of it.

Even if the owner claimed it was set there by accident.. the officers should have simply returned the bike to the owner and sent every one on their way.

Instead they chose to waste valuable resources and man hours writing up a misdemeanor.. it took 4-6 officers 3-4 hrs to write up the paperwork, process & then release him to obtain legal representation for a charge that will most definitely be tossed out.

If I were the judge hearing this case i would not only dismiss the case, but I would fine the officers plus court costs and wages for every one working in the courtroom that day.. for wasting tax dollars, embarrassing themselves and the entire NJ police force on live camera, I'd recommend they take two days off without pay.

First off the guy didn't shove a camera in the cops face, not only that but he was being fairly polite compared to other anti-cops videos I've seen on the internet.

Secondly, "you are begging for a police state every time you steal an item or harass cops with cameras..." really makes no sense, it's called transparency. How is creating transparency going to create a police state? Why is it okay for them to film us but wrong if we film them?

Once trash is put to the curb, the property owner relinquishes ownership to the local municipality and/or the contracted agent of same.

Scavenging or "dive bombing " trash is alway unlawful.
