This is ridiculous. If it was in the trash, it wasn't wanted. Why are you all giving in to the ultimate tyranny that should be noted here? "They" are in control. This is the sort of law that should not be. It is almost as bad as the state government owned rainwater laws.

They want to control us. Can't you see that? I thought you all were awakened. Have you no cognition?

Some laws are good. Lock up the murderers, pedophiles, rapists. But to be locked up, even overnight, for trash digging is just ridiculous. Once a person throws something away, it should be free grabs for anyone.

If it was small and resting by the curb, I took a nightstand or two or a chair when I moved into my first apartment and was just starting off. But Ive never had the guts to dumpster dive . It does seem intrusive and dangerous and unsanitary.

I had pone of those giant 60 inch big screens that was about 20 years old. A big pain in the rear with a broken tube. I dragged it out front and left a sign free to anyone, and before the end of the day that thing was gone.

Smart people that took it. It has copper in it.. they knew there was still money in there. It doesnt take long to extract the copper. You have to be careful not to break the tube cause theres gases in there. But I got 7-10 bucks worth of copper wire from a old broken tv.

Ive seen people throw out aluminum lawn chairs too not realizing, duh ! Its aluminum. The scrap yard will pay you for it..

You can make a easy 30 bucks or more just hauling trash and junk from ones yard.

These are from "Chapter 281 - RECYCLING" and has NOTHING to do with what this tread is about.

You should have been looking in "Chapter 398 - GARBAGE, RUBBISH AND REFUSE" [link to ecode360.com] where there is no mention of penalties of going through garbage.

The fact is, once you put your garbage in public domain for collection it becomes just that, public. If this bike was in a trash can on someone's privately owned property then yes, it would be considered stealing. But if it were on the sidewalk, it was free game.

The statement above applies to household, curbside garbage. Now if it was in a dumpster on private property it would be illegal.

I personally wouldn't go through someone's garbage but it is still not illegal if left in public domain.

How is taking something from the trash stealing? Is the city dump going to take the stuff and sell it or will it sit at the landfill and rot?

America is fucked up here in Canada the people are way nicer then that, some of us even clean thing before we put them out in case someone wants it.

if I toss anything that's still good but I just don't have room for or need anymore help yourselves to it. I would never even think of someone picking up trash as stealing.

OP needs to find out where Obama lived when he took from the garbage. If there was a law against it at the time, then OP has a case. If the President of the United States believes it's ok to take from garbage dumpsters even though the law states otherwise, then maybe the law should be revisited?

If I don't get my recycled cans and bottles out for the trucks to pick up in front of my house, I take it to the recycle bins at the apartments about 2 miles away.

One time, several years ago, I was there and took 2 Hoover Windtunnel vacuum cleaners out of the dumpster, which is next to the recycle bins. Got home and found out both the vacuum cleaners worked. I gave one to my mom, and I still have the other. They retail for about $200.00 each!

I certainly can afford to buy them, but when they are thrown away, I see no reason to keep them or give them away to someone who can use them. I've also seen perfectly good furniture in those dumpsters or placed alongside of them. It's a shame that they don't take them to a thrift store or Goodwill so others can benefit.

1) LEO routinely circumvent laws in the process of investigations, rifling through trash without a warrant being one of them.

2) There are laws on the books governing how fast you operate a vehicle. Have you followed them meticulously your entire driving life?

3) Some laws are just downright stooooopid. This being one of them. If you throw it away, indicating irrevocably that you have no further calim or desire to posses it, why should anyone be prohibited from making use of it?

Here in Cali, a lot of dumpsters are chained and locked, with the key given to residents. This is to prevent not only picking, but random burglarizing which has unfortunately come with it. When my rental building was sold, the new owner had a dumpster that was filled with unwanted trash and debris from vacated tenants. This attracted unwanted elements, as pickers regularly descended on the dumpster and took anything they could, even taking the lightbulbs from outside lighting sources! After reports of alleged break-in attempts, the chain and lock appeared on the dumpster with instructions from the new owner to always be sure to keep it closed, chained, and locked when not in use. Problem solved: no more unwanted 'guests' picking through our dumpsters. I believe that if this were to be adopted by those who do not want pickers in their neighborhoods, the problem would be eliminated.

This is a non-issue.

When I or anyone I see throws out perfectly good stuff, say after a garage sale or whatever we place it on the curb and possibly put a piece or masking tape on it that says free.

You don t go opening and digging in your neighbors trash can for salvage. This pisses people off because once some jerk has spread your trash all over your yard and street trying to get a piece of copper out of a something you threw away without the decent state of mind to put the trash they pulled out back into the trash can it makes you very hostile to these people.

Last I checked most functioning bikes would not fit in the trash can, objects sitting on the street or curb are not protected the same as the stuff actually in the trash can or recycle bin and can be taken if they are on public property. If you want something out of your neighbors trash and are to xenophobic to knock on their door and ask them, then it's a personal issue, the laws that are in place to protect trash are their because of scrap yards making messes and not cleaning up after themselves and the nature of the sensitive information in people's trash and the biohazards that people trash presents.

If you pulling stuff out of an apartment complex dumpster and some patrol cops sees you they are going to bust you and there is plenty of precedent as to why that happens. If you are calm and like hey officer I was after this bike right here, then chances are they are going to let you go if you don't act like a jerk

This pisses people off because once some jerk has spread your trash all over your yard and street trying to get a piece of copper out of a something you threw away without the decent state of mind to put the trash they pulled out back into the trash can it makes you very hostile to these people.

Last I checked most functioning bikes would not fit in the trash can, objects sitting on the street or curb are not protected the same as the stuff actually in the trash can or recycle bin and can be taken if they are on public property. If you want something out of your neighbors trash and are to xenophobic to knock on their door and ask them, then it's a personal issue, the laws that are in place to protect trash are their because of scrap yards making messes and not cleaning up after themselves and the nature of the sensitive information in people's trash and the biohazards that people trash presents.

If you pulling stuff out of an apartment complex dumpster and some patrol cops sees you they are going to bust you and there is plenty of precedent as to why that happens. If you are calm and like hey officer I was after this bike right here, then chances are they are going to let you go if you don't act like a jerk

We put our garbage on our property, the garbage men have to walk onto my privately owned land to remove it. I've had bikes abandoned on my property before and called the police, they come look at it and check to see if it has been reported stolen, if not then they tell me I can have it.
