"Senators seek deal on gun-sale background checks"

[link to news.yahoo.com]

"WASHINGTON (AP) — A bipartisan quartet of senators, including two National Rifle Association members and two with "F'' ratings from the potent firearms lobby, are quietly trying to find a compromise on expanding the requirement for gun-sale background checks.

A deal, given a good chance by several participants and lobbyists, could add formidable political momentum to one of the key elements of President Barack Obama's gun control plan. Currently, background checks are required only for sales by the nation's 55,000 federally licensed gun dealers, but not for gun show, person-to-person sales or other private transactions.

The senators' talks have included discussions about ways to encourage states to make more mental health records available to the national system and the types of transactions that might be exempted from background checks, such as sales among relatives or to those who have permits to carry concealed weapons, said people who spoke anonymously because they were not authorized to describe the negotiations publicly.

The private discussions involve liberal Sen. Chuck Schumer of New York, who is the No. 3 Senate Democratic leader; West Virginia Sen. Joe Manchin, an NRA member and one of the chamber's more moderate Democrats; Sen. Tom Coburn, R-Okla., another NRA member and one of the more conservative lawmakers in Congress; and moderate GOP Sen. Mark Kirk of Illinois.

"It will not limit your ability to borrow your Uncle Willie's hunting rifle or share a gun with your friend at a shooting range," Schumer said last week in one of the senators' few public remarks about the package the group is seeking. He said he believed a bipartisan deal could be reached.

Polls show that requiring background checks for nearly all gun purchases has more public support than Obama's proposals to ban assault weapons and high-capacity ammunition magazines, and it is among those given the best chance of enactment. Even so, it is opposed by the NRA and many congressional Republicans, who consider it intrusive and unworkable for a system they say already has flaws.

"My problem with background checks is you're never going to get criminals to go through background checks," Wayne LaPierre, NRA executive vice president, told the Senate Judiciary Committee at its gun control hearing last week.

An agreement among the four senators could help overcome that opposition by opening the door to support from other conservative Republicans besides Coburn. It also could make it easier to win backing from Democratic senators from GOP-leaning states, many of whom face re-election next year and who have been leery of embracing Obama's proposals.

Schumer and Kirk each have "F'' scores from the NRA, while Coburn and Manchin have "A'' ratings...."

California, which already has some of the strictest gun control laws in the country, is also looking at a proposal which would call for the immediate confiscation of 166,000 registered modern sporting rifles. "In less than four weeks since President Obama proposed sweeping new gun control laws and a ban on assault-style weapons, the backlash from law enforcement groups that strongly support the Second Amendment has surged and now there are 10 state sheriffs associations opposed to the president.

The Illinois Sheriffs Association became the last to join the growing crowd of police opposed to Obama, arguing this week that the president should instead be focused on mental health, not gun hardware.

"Sheriffs from across the state of Illinois believe that it is their responsibility and duty to uphold the Constitution including the Second Amendment. Rational law abiding citizens are not the cause of random acts of horrific violence in our communities. The focus should be primarily on the lack of mental health services in our country," the group just announced.

Similar statements have been issued by the sheriff associations of Utah, Florida, Georgia, New York, Colorado, New Mexico, Nebraska, Wyoming and Indiana...."

Along with the company would go the 200 direct employees Magpul has, and nearly 700 jobs at suppliers and subcontractors.

“Passage would devastate the company,” he said...."

"As National Dems Pull Back on Gun Control, Colorado Dems Push Ahead"

[link to thecoloradoobserver.com]

"DENVER – In the wake of mass shootings last year in Aurora and Newtown, Democratic lawmakers in Colorado and the nation’s capital called for the enactment of far-reaching gun control laws at both the state and federal level. In recent weeks, however, that has begun to change.

High-profile Democrats in Washington, DC now appear to backing away from the volatile issue, while their counterparts in Colorado have decided to push for new curbs on gun rights.

In the immediate aftermath of the Sandy Hook Elementary massacre, Senate Majority Leader Harry Reid (D-Nev.) seemed to signal that he was open to some of the aggressive gun restrictions put forward by other Democrats.

“We need to accept the reality that we are not doing enough to protect our citizens,” Reid said after the shootings.

At the time, an aide to the Nevada Democrat added that Reid — long viewed as a supporter of gun rights — was “in a different place than he was in 2010.”

But public fervor on the issue has died down in the weeks and months since the shootings, and Democrats like Reid seem to be hedging again, this time in response to pressure from those on the other side of the contentious debate.

“In the Senate, we’re going to do what we think can get through the House and I’m not going to go through a bunch of these gyrations just to say we’ve done something,” said Reid, sounding far less ambitious in a recent Nevada PBS interview.

President Clinton has also urged caution in recent days, warning a group of key group of Democratic Party donors not to underestimate the political muscle or intensity of the nation’s estimated 70 to 80 million gun owners...."

Thread: Ohio Senator Introduces Bill That Would Bar New Local/Federal/International Gun Bans From Being Enforced In Ohio

"A bill just introduced in the Ohio legislature could start a gunfight with the federal government. There is concern among some gun-owners that the government is getting ready to confiscate fire arms. So State Senator Kris Jordan (R-19th District) has introduced a bill that he says keeps Washington from running wild over your constitutional right to own a gun.

St. Sen. Kris Jordan (R-19th District) is sponsoring a bill that he believes will prevent the government from confiscating legal firearms.

During the president's State of the Union address, Tuesday, he said:

"Police chiefs are asking our help to get weapons of war and massive ammunition off our streets."

Mister Obama appealed to federal lawmakers to pass his gun control plan. He particularly targets the sale of assault weapons… and high-capacity magazines… as unnecessary for private individuals.

Since the massacre at Sandy Hook Elementary in Newtown Connecticut, in December, 58-percent of Americans now say favor tougher laws on gun sales.

The president's 23-point gun control plan includes items such as how to do a background check, how states can share information if a gun is lost or stolen, and how to make sure dangerous people don't get guns.

But gun supporters fear the plan will eventually lead to confiscating *all guns*….

So Tuesday, Ohio State Senator Kris Jordan introduced SB- 36 which aims to prohibit any law officer from enforcing "a firearm registration requirement or firearm ban"....

CO: "Republicans Fight Passage of Gun Control Bills"

[link to thecoloradoobserver.com]

"DENVER– Democrat legislators aim to fire four gun-control bills through the House on Friday. But the debate over the Second Amendment right to bear arms may put the First Amendment right of free speech to the test.

House Speaker Mark Ferrandino assured Republicans that ample time will be allotted to debate the bills on the floor. His remarks followed a speech by state Rep. Bob Gardner (R-Colorado Springs) asking legislators to respect debate.

“I ask you to consider that this is the debate of the people ofColoradoand of our constituents,”Gardner said Thursday on the House floor.

Gardner and fellow Republicans complained of gun-control bills being pushed through Democrat-controlled committees this week – cutting off the testimony of witnesses and questions posed by legislators who opposed the bills.

Friday’s debate will be over passage of House Bill 1224 to ban large ammunition magazines, House Bill 1228 to assess a background check tax, House Bill 1229 to expand background checks for gun transactions and House Bill 1226 to prohibit concealed carry weapons on college campuses.

Whether it is a two-hour discussion of three bills in the House Appropriations Committee or a 12-hour debate over two bills before the House Judiciary Committee, Gardner said that constituents and their legislators deserve to be heard and respected.

“To curtail that debate because one needs to be on the floor to move a bill forward that is serious, and one that constituents take as infringement upon their fundamental rights, is nothing less than to diminish the process,” he said. “And to silence even those of us who refuse to be silenced.”...

"The Rifle on the Wall: A Left Argument for Gun Rights "

[link to www.thepolemicist.net]

Thread: The Rifle on the Wall: A Left Argument for Gun Rights

"The Fundamental Political Principle"

"That rifle on the wall of the labourer's cottage or working class flat is the symbol of democracy. It is our job to see that it stays there." -- George Orwell1

Let’s start with this: The citizen’s right to possess firearms is a fundamental political right. The political principle at stake is quite simple: to deny the state the monopoly of armed force. This should perhaps be stated in the obverse: to empower the citizenry, to distribute the power of armed force among the citizenry as a whole. The history of arguments and struggles over this principle, throughout the world, is long and clear. Instituted in the context of a revolutionary struggle based on the most democratic concepts of its day, the Second Amendment of the United States Constitution is perhaps the clearest legal/constitutional expression of this principle, and as such, I think, is one of the most radical statutes in the world.

The question of gun rights is a political question, in the broad sense that it touches on the distribution of power in a polity. Thus, although it incorporates all these perfectly legitimate “sub-political” activities, it is not fundamentally about hunting, or collecting, or target practice; it is about empowering the citizen relative to the state. Denying the importance of, or even refusing to understand, this fundamental point of the Second Amendment right, and sneering at people who do, symptomizes a politics of paternalist statism – not (actually the opposite of) a politics of revolutionary liberation.

I’ll pause right here. For me, and for most supporters of gun rights, however inartfully they may put it, this is the core issue. To have an honest discussion of what’s at stake when we talk about “gun rights,” “gun control,” etc., everyone has to know, and acknowledge, his/her position on this fundamental political principle. Do you hold that the right to possess firearms is a fundamental political right?

If you do, then you are ascribing it a strong positive value, you will be predisposed to favor its extension to all citizens, you will consider whatever “regulations” you think are necessary (because some might be) with the greatest circumspection (because those “regulations” are limitations on a right, and rights, though never as absolute as we may like, are to be cherished), you will never seek, overtly or surreptitiously, to eliminate that right entirely – and your discourse will reflect all of that. If you understand gun ownership as a political right, then, for you, if there weren’t a second amendment, there should be.

If, on the other hand, you do not hold that the right to possess firearms is a fundamental political right, if you think it is some kind of luxury or peculiarity or special prerogative, then, of course, you really won’t give a damn about how restricted that non-right is, or whether it is ignored or eliminated altogether. If you reject, or don’t understand, gun ownership as a political right, then you probably think the Second Amendment should never have been...."

compliments of Denver's Bird Cage Liner...

"Coloradans who buy guns from private individuals would have to undergo the same background checks required of buyers at stores and gun shows under a bill being debated in the Colorado House on Friday.

House Bill 1229 was the second of four Democratic bills expected to be debated in the Democratic-controlled House on Friday in a marathon session that could run into Saturday. Another bill that would limit magazines for guns to 15 rounds and eight for shotguns had already received first-round approval in the House after a six hour debate.

People who buy guns from a licensed dealer now are subject to state background checks conducted by the Colorado Bureau of Investigation. But private sales and transfers between individuals are not required to undergo the checks.

"Why shouldn't someone whose buying private have the same responsibility?" asked Rep. Beth McCann, D-Denver, a co-sponsor of the bill.

But Republicans said the bill would have no effect on sales between criminals.

"That gun sale in the alley between two hoodlums will never make it to the CBI," said Rep. Jerry Sonnenberg, R-Sterling. "It comes back again to what do we want to do to law-abiding citizens? We cannot keep evil people from doing evil things unless we lock 'em up."...

SURE it would...

"Gun ban would protect more than 2,200 firearms"

[link to news.yahoo.com]

"WASHINGTON (AP) — Congress' latest crack at a new assault weapons ban would protect more than 2,200 specific firearms, including a semi-automatic rifle that is nearly identical to one of the guns used in the bloodiest shootout in FBI history.

One model of that firearm, the Ruger .223 caliber Mini-14, is on the proposed list to be banned, while a different model of the same gun is on a list of exempted firearms in legislation the Senate is considering. The gun that would be protected from the ban has fixed physical features and can't be folded to be more compact. Yet the two firearms are equally deadly.

"What a joke," said former FBI agent John Hanlon, who survived the 1986 shootout in Miami. He was shot in the head, hand, groin and hip with a Ruger Mini-14 that had a folding stock. Two FBI agents died and five others were wounded.

Hanlon recalled lying on the street as brass bullet casings showered on him. He thought the shooter had an automatic weapon.

Both models of the Ruger Mini-14 specified in the proposed bill can take detachable magazines that hold dozens of rounds of ammunition. "I can't imagine what the difference is," Hanlon said.

President Barack Obama has called for restoring a ban on military-style assault weapons and limiting the size of ammunition magazines.

A bill introduced last month by Sen. Dianne Feinstein, D-Calif. would ban 157 specific firearms designed for military and law enforcement use and exempt others made for hunting purposes. It also would ban ammunition magazines that hold more than 10 rounds.

Yet there are firearms that would be protected under Feinstein's proposal that can take large capacity magazines like the ones used in mass shootings that enable a gunman to fire dozens of rounds of ammunition without reloading.

Feinstein said in a written response to questions from The Associated Press that the list of more than 2,200 exempted firearms was designed to "make crystal clear" that the bill would not affect hunting and sporting weapons...."

WA: "Mistake in gun bill could defeat the effort"

Thread: Washington state proposed bill allows HOME INSPECTIONS BY THE SHERIFF if you own an assault weapon, added in "by mistake"

"One of the major gun-control efforts in Olympia this session calls for the sheriff to inspect the homes of assault-weapon owners. The bill’s backers say that was a mistake.

Forget police drones flying over your house. How about police coming inside, once a year, to have a look around?

As Orwellian as that sounds, it isn’t hypothetical. The notion of police home inspections was introduced in a bill last week in Olympia.

That it’s part of one of the major gun-control efforts pains me. It seemed in recent weeks lawmakers might be headed toward some common-sense regulation of gun sales. But then last week they went too far. By mistake, they claim. But still too far.

“They always say, we’ll never go house to house to take your guns away. But then you see this, and you have to wonder.”

That’s no gun-rights absolutist talking, but Lance Palmer, a Seattle trial lawyer and self-described liberal who brought the troubling Senate Bill 5737 to my attention. It’s the long-awaited assault-weapons
ban, introduced last week by three Seattle Democrats..."

"SHOCKING OBAMA JUSTICE DEPT. MEMO: Assault Weapons Ban Won’t Work Without Confiscation and Gun Registration (Video):"

[link to www.thegatewaypundit.com]

"Under the Tsar, Russia was one of the most heavily armed societies on earth. That all changed when Stalin and the communists took control. Stalin was able to control, starve, punish and imprison a defenseless people… after he took their guns. (Zinnfigur)

But that could never happen in the United States, right?

Or maybe not…
In this short video by the NRA, an internal Justice Department (the same Justice Department ran by Eric ‘Fast and Furious’ Holder), it is revealed that the Obama administration’s own research shows that an assault weapons ban would only be effective with mandatory gun confiscation and that universal background checks would only be effective with federal gun registration...."

Just as effective as gun control???

"Gun dealers report shortages of ammunition"

[link to www.usatoday.com]

"Gun shops are running low on ammunition from a run by customers fearful of potential gun-control legislation, according to gun retailers and customers.

Prices have more than doubled over past year in some shops, retailers are putting limits on the amount a customer can buy, and some common types of ammunition, such as .22-caliber long rifle shells, are hard to get.

The National Shooting Sports Foundation, which represents ammunition makers, retailers, hunters and sport shooters, attributes what it calls "spot shortages" around the country to rising popularity of sport-shooting and hunting, and to people who are "keeping firearms for personal and home defense...."

"Colorado House Set to Approve Gun Control Package"

[link to thecoloradoobserver.com]

"DENVER–Colorado House Democrats are poised to pass sweeping gun-control legislation Monday after lobbying by Vice President Joe Biden and despite warnings that the bills could cost the state hundreds of jobs.

The House is scheduled to begin debate at 10 a.m. Monday on four Democrat-sponsored bills to tighten the state’s firearms laws. Each of the bills won preliminary approval on voice votes Friday after an emotional and contentious all-day floor session.

As debate was raging, Biden called a handful of House Democrats from swing districts and urged them to approve the four bills. The vice-president was on a ski vacation in Aspen.

“I was totally surprised,” state Rep. Tony Exum (D-Colorado Springs told Fox affiliate KDVR-TV. “He just said he’s watching us and asked if we had a chance to move these bills forward and said what an important signal it would send to the country if we do.”

Republicans argued that the bills would have no impact on gun violence while harming the economy by prompting gun manufacturers to leave the state. Two ammunition companies, Magpul Industries and Alfred Manufacturing, indicated Friday that they would relocate if the bill limiting magazines to 15 rounds becomes law...."

"Chicago Police Chief: Second Amendment Is A Danger To Public Safety"

[link to www.redstate.com]

"Chicago’s Chief of Police, who previously blamed ”government-sponsored racism” and Sarah Palin for Chicago’s gun violence, declared that the law-ful exercise of the Second Amendment was a threat to public safety. From the Illinois State Rifle Association:

Chicago’s embattled police superintendent dug himself deeper into a pit of controversy today by claiming that lawful firearm owners are agents of political corruption. Appearing on a Chicago Sunday morning talk show, superintendent Garry McCarthy expressed his conviction that firearm owners who lobby their elected representatives or who donate money to political campaigns are engaged in corruption that endangers public safety. McCarthy went on to express his belief that judges and legislators should rely on public opinion polls when interpreting our Constitution.

After totally dismissing the citizen’s right to redress grievances, McCarthy trained his constitutional wisdom on the 2nd Amendment. Despite recent court decisions to the contrary, McCarthy opined that the 2ndAmendment limits citizens to owning smooth-bore muskets. McCarthy went on to say that he believes that the 2nd Amendment supports mandatory liability insurance for firearm owners and the mandatory application of GPS tracking devices to civilian owned firearms...."

"U.S. road deaths in 2012 jump"

[link to www.detroitnews.com]

"Washington - U.S. traffic deaths last year rose about 5 percent to about 36,200, according to a preliminary estimate released Monday by a nonprofit group that tracks auto safety.

The increase would be the first time in eight years that road deaths increased, and coincides with a jump in the number of miles Americans drove in 2012.

The National Safety Council also said crash injuries requiring medical attention rose by an estimated 5 percent since 2011 to a total of 3.9 million.

"NSC is greatly concerned with the upswing in traffic fatalities on our nation's roads," said Janet Froetscher, president and CEO of the National Safety Council, which was founded in 2013 and chartered by Congress. "Although we have improved safety features in vehicles today, we also have new challenges, especially as it relates to teen and distracted driving, that need to be addressed on a national scale. We must work together now to reverse this latest trend to prevent needless tragedy...."

"Comcast To Firearms Shops: Your Money’s No Good Here"

[link to detroit.cbslocal.com]

"DETROIT (CBS Detroit) Williams Gun Sight and Outfitters in Davison, Mich., said they learned their money’s no good with Comcast when the cable giant rejected their advertising because they no longer accept ads promoting firearms or fireworks.

The change in policy happened February 8 after a deal that gave Comcast controlling interest in NBC Universal, which previously had a policy of not accepting firearms ads.

But Comcast is the monopoly cable provider in two-thirds of the markets in the country, said John Kupiec, president of the advertising agency Canadian American Corp., so their policy now affects every cable channel and major network. And it affects major advertisers including Cabela’s and Walmart.

“The next step is we want to get the lawmakers on Capitol Hill to review the monopolistic rights this company (Comcast) currently enjoys as the largest cable provider in the United States,” Kupiec said, adding as a last resort, his firm will consider legal action.

Kupiec first discovered the firearms ad ban when he tried to place an ad for Williams Gun Sight, and was told by Comcast they’ll no longer air them.

“Comcast Spotlight has decided it will not accept new advertising for firearms or weapons moving forward,” the company said in a press statement. “This policy aligns us with the guidelines in place at many media organizations.”

Williams Gun Sight staffers think it’s a hypocritical, anti-constitutional stance.

“We’re a perfectly legal company selling a perfectly legal product and they have chosen us out of all the industries out there to make a stand on what’s right or wrong,” said Williams’ chief operating officer Dan Compeau, adding they’re one of the largest firearms retailers in Michigan..."
