"DENVER – In the wake of mass shootings last year in Aurora and Newtown, Democratic lawmakers in Colorado and the nation’s capital called for the enactment of far-reaching gun control laws at both the state and federal level. In recent weeks, however, that has begun to change.

High-profile Democrats in Washington, DC now appear to backing away from the volatile issue, while their counterparts in Colorado have decided to push for new curbs on gun rights.

In the immediate aftermath of the Sandy Hook Elementary massacre, Senate Majority Leader Harry Reid (D-Nev.) seemed to signal that he was open to some of the aggressive gun restrictions put forward by other Democrats.

“We need to accept the reality that we are not doing enough to protect our citizens,” Reid said after the shootings.

At the time, an aide to the Nevada Democrat added that Reid — long viewed as a supporter of gun rights — was “in a different place than he was in 2010.”

But public fervor on the issue has died down in the weeks and months since the shootings, and Democrats like Reid seem to be hedging again, this time in response to pressure from those on the other side of the contentious debate.

“In the Senate, we’re going to do what we think can get through the House and I’m not going to go through a bunch of these gyrations just to say we’ve done something,” said Reid, sounding far less ambitious in a recent Nevada PBS interview.

During the president's State of the Union address, Tuesday, he said:

"Police chiefs are asking our help to get weapons of war and massive ammunition off our streets."

Mister Obama appealed to federal lawmakers to pass his gun control plan. He particularly targets the sale of assault weapons… and high-capacity magazines… as unnecessary for private individuals.

Since the massacre at Sandy Hook Elementary in Newtown Connecticut, in December, 58-percent of Americans now say favor tougher laws on gun sales.

The president's 23-point gun control plan includes items such as how to do a background check, how states can share information if a gun is lost or stolen, and how to make sure dangerous people don't get guns.

But gun supporters fear the plan will eventually lead to confiscating *all guns*….

House Speaker Mark Ferrandino assured Republicans that ample time will be allotted to debate the bills on the floor. His remarks followed a speech by state Rep. Bob Gardner (R-Colorado Springs) asking legislators to respect debate.

“I ask you to consider that this is the debate of the people ofColoradoand of our constituents,”Gardner said Thursday on the House floor.

Gardner and fellow Republicans complained of gun-control bills being pushed through Democrat-controlled committees this week – cutting off the testimony of witnesses and questions posed by legislators who opposed the bills.

“To curtail that debate because one needs to be on the floor to move a bill forward that is serious, and one that constituents take as infringement upon their fundamental rights, is nothing less than to diminish the process,” he said. “And to silence even those of us who refuse to be silenced.”...

Let’s start with this: The citizen’s right to possess firearms is a fundamental political right. The political principle at stake is quite simple: to deny the state the monopoly of armed force. This should perhaps be stated in the obverse: to empower the citizenry, to distribute the power of armed force among the citizenry as a whole. The history of arguments and struggles over this principle, throughout the world, is long and clear. Instituted in the context of a revolutionary struggle based on the most democratic concepts of its day, the Second Amendment of the United States Constitution is perhaps the clearest legal/constitutional expression of this principle, and as such, I think, is one of the most radical statutes in the world.

The question of gun rights is a political question, in the broad sense that it touches on the distribution of power in a polity. Thus, although it incorporates all these perfectly legitimate “sub-political” activities, it is not fundamentally about hunting, or collecting, or target practice; it is about empowering the citizen relative to the state. Denying the importance of, or even refusing to understand, this fundamental point of the Second Amendment right, and sneering at people who do, symptomizes a politics of paternalist statism – not (actually the opposite of) a politics of revolutionary liberation.

I’ll pause right here. For me, and for most supporters of gun rights, however inartfully they may put it, this is the core issue. To have an honest discussion of what’s at stake when we talk about “gun rights,” “gun control,” etc., everyone has to know, and acknowledge, his/her position on this fundamental political principle. Do you hold that the right to possess firearms is a fundamental political right?

If you do, then you are ascribing it a strong positive value, you will be predisposed to favor its extension to all citizens, you will consider whatever “regulations” you think are necessary (because some might be) with the greatest circumspection (because those “regulations” are limitations on a right, and rights, though never as absolute as we may like, are to be cherished), you will never seek, overtly or surreptitiously, to eliminate that right entirely – and your discourse will reflect all of that. If you understand gun ownership as a political right, then, for you, if there weren’t a second amendment, there should be.

If, on the other hand, you do not hold that the right to possess firearms is a fundamental political right, if you think it is some kind of luxury or peculiarity or special prerogative, then, of course, you really won’t give a damn about how restricted that non-right is, or whether it is ignored or eliminated altogether. If you reject, or don’t understand, gun ownership as a political right, then you probably think the Second Amendment should never have been...."

House Bill 1229 was the second of four Democratic bills expected to be debated in the Democratic-controlled House on Friday in a marathon session that could run into Saturday. Another bill that would limit magazines for guns to 15 rounds and eight for shotguns had already received first-round approval in the House after a six hour debate.

People who buy guns from a licensed dealer now are subject to state background checks conducted by the Colorado Bureau of Investigation. But private sales and transfers between individuals are not required to undergo the checks.

"Why shouldn't someone whose buying private have the same responsibility?" asked Rep. Beth McCann, D-Denver, a co-sponsor of the bill.

But Republicans said the bill would have no effect on sales between criminals.

"That gun sale in the alley between two hoodlums will never make it to the CBI," said Rep. Jerry Sonnenberg, R-Sterling. "It comes back again to what do we want to do to law-abiding citizens? We cannot keep evil people from doing evil things unless we lock 'em up."...

"WASHINGTON (AP) — Congress' latest crack at a new assault weapons ban would protect more than 2,200 specific firearms, including a semi-automatic rifle that is nearly identical to one of the guns used in the bloodiest shootout in FBI history.

One model of that firearm, the Ruger .223 caliber Mini-14, is on the proposed list to be banned, while a different model of the same gun is on a list of exempted firearms in legislation the Senate is considering. The gun that would be protected from the ban has fixed physical features and can't be folded to be more compact. Yet the two firearms are equally deadly.

"What a joke," said former FBI agent John Hanlon, who survived the 1986 shootout in Miami. He was shot in the head, hand, groin and hip with a Ruger Mini-14 that had a folding stock. Two FBI agents died and five others were wounded.

Hanlon recalled lying on the street as brass bullet casings showered on him. He thought the shooter had an automatic weapon.

Both models of the Ruger Mini-14 specified in the proposed bill can take detachable magazines that hold dozens of rounds of ammunition. "I can't imagine what the difference is," Hanlon said.

President Barack Obama has called for restoring a ban on military-style assault weapons and limiting the size of ammunition magazines.

A bill introduced last month by Sen. Dianne Feinstein, D-Calif. would ban 157 specific firearms designed for military and law enforcement use and exempt others made for hunting purposes. It also would ban ammunition magazines that hold more than 10 rounds.

Yet there are firearms that would be protected under Feinstein's proposal that can take large capacity magazines like the ones used in mass shootings that enable a gunman to fire dozens of rounds of ammunition without reloading.

Feinstein said in a written response to questions from The Associated Press that the list of more than 2,200 exempted firearms was designed to "make crystal clear" that the bill would not affect hunting and sporting weapons...."

The House is scheduled to begin debate at 10 a.m. Monday on four Democrat-sponsored bills to tighten the state’s firearms laws. Each of the bills won preliminary approval on voice votes Friday after an emotional and contentious all-day floor session.

As debate was raging, Biden called a handful of House Democrats from swing districts and urged them to approve the four bills. The vice-president was on a ski vacation in Aspen.

“I was totally surprised,” state Rep. Tony Exum (D-Colorado Springs told Fox affiliate KDVR-TV. “He just said he’s watching us and asked if we had a chance to move these bills forward and said what an important signal it would send to the country if we do.”

Republicans argued that the bills would have no impact on gun violence while harming the economy by prompting gun manufacturers to leave the state. Two ammunition companies, Magpul Industries and Alfred Manufacturing, indicated Friday that they would relocate if the bill limiting magazines to 15 rounds becomes law...."

"DETROIT (CBS Detroit) Williams Gun Sight and Outfitters in Davison, Mich., said they learned their money’s no good with Comcast when the cable giant rejected their advertising because they no longer accept ads promoting firearms or fireworks.

The change in policy happened February 8 after a deal that gave Comcast controlling interest in NBC Universal, which previously had a policy of not accepting firearms ads.

But Comcast is the monopoly cable provider in two-thirds of the markets in the country, said John Kupiec, president of the advertising agency Canadian American Corp., so their policy now affects every cable channel and major network. And it affects major advertisers including Cabela’s and Walmart.

“The next step is we want to get the lawmakers on Capitol Hill to review the monopolistic rights this company (Comcast) currently enjoys as the largest cable provider in the United States,” Kupiec said, adding as a last resort, his firm will consider legal action.

Kupiec first discovered the firearms ad ban when he tried to place an ad for Williams Gun Sight, and was told by Comcast they’ll no longer air them.

“Comcast Spotlight has decided it will not accept new advertising for firearms or weapons moving forward,” the company said in a press statement. “This policy aligns us with the guidelines in place at many media organizations.”

Williams Gun Sight staffers think it’s a hypocritical, anti-constitutional stance.

“We’re a perfectly legal company selling a perfectly legal product and they have chosen us out of all the industries out there to make a stand on what’s right or wrong,” said Williams’ chief operating officer Dan Compeau, adding they’re one of the largest firearms retailers in Michigan..."

Some of the proposed laws even go a step further, making it a state crime for any government official to enforce these hypothetical federal gun laws.

Bills introduced in Texas, Wyoming, Tennessee, Alabama and Missouri over the past month would declare void any federal laws banning high-capacity magazines or certain weapons. The Texas bill, for instance, introduced by Rep. John Otto of Dayton, says any federal attempts to tax, limit the magazine size of, or ban any weapon "infringes upon Texans' right to bear arms" and is thus "invalid" in the state. Any government employee who enforces such laws is committing a misdemeanor crime, the bill says.

These state laws would most likely be unenforceable, as federal gun control laws would preempt state laws. It would be up to the courts to decide whether gun control bills infringed on constitutional rights...."
