This is not a simple discussion about fundamental constitutional rights, it is also a question of how our state is viewed by job-creators.

With the casting of votes, Democrats propose chasing from our state a growing manufacturing business leaving more than two-hundred families without work. Their purposeful actions also leave another five-hundred families whose jobs will be left hanging in the balance as other manufacturers will certainly follow suit.

Colorado already has an eco-devo black-eye with the legalization of marijuana. Now, Democrats look to level another blow to our slow, sputtering economic recovery by rejecting good-paying manufacturing jobs and over $85 million in private sector investment. It’s almost become a joke among economic development outfits from other states. If Colorado doesn’t want you, come to Alabama, come to Texas, come to Louisiana.

There is no doubt that,if legislation pushed by statehouse Democrats becomes law, the Erie, Colorado-based manufacturer Magpul will leave our state. In a message on an official company site they posted,

“We don’t play political games. We’ve made our position very clear, very publicly. We would not survive lying to our customer base, nor would we ever consider it. If you pass this, we will leave…we’ve already got plans in place to get PMAG manufacturing moved rapidly, and the rest of the company will follow.”

Any reasonable employer now thinks the same. What happens if my product, if my enterprise falls out of political favor? Will the political winds turn against me and the men and women employed by my company? What happens to the families who rely on these jobs – to the children who will be uprooted from their schools and their friends? Why would an employer even consider relocating its manufacturing operation to a state that is willing to change course so quickly? Businesses cannot grow and prosper in an economic environment so fickle toward employers...."

Kyle Coplen, who founded the Armed Citizens Project, is giving away 20-gauge single-shot shotguns to residents in mid- and high-crime neighborhoods to test whether or not the weapon will help reduce crime in the area, according to the group’s website. Coplen says the weapons are not of much value to criminals, but are especially useful for citizens looking to protect themselves from criminals...."

"CHICAGO (Reuters) - New York Mayor Michael Bloomberg's push for stricter U.S. gun laws in the wake of the Connecticut school massacre faces a stern test next week in a messy Chicago special election where he has piled in with more than $2 million in political ads.

The outcome of the race is the first big election test since the Newtown, Connecticut, shooting of whether gun control champions such as Bloomberg and former U.S. congresswoman Gabby Giffords can use money, and the same tough tactics as gun rights lobbyists, to influence voters.

Gun control vaulted to the top of the U.S. political agenda after a gunman last December shot and killed 26 people at an elementary school in Newtown including 20 children.

Bloomberg is taking a risk by wading into the nasty and racially charged politics of Chicago, where critics have already complained the brash mayor is trying to buy an election nearly 1,000 miles from New York City.

The February 26 primary is to replace U.S. Congressman Jesse Jackson Jr., who pleaded guilty in federal court on Wednesday to using campaign funds to finance a lavish personal lifestyle.

Jackson was a reliable vote in Congress for gun control measures but polls last month showed the seat could be won by Debbie Halvorson, who has an "A" rating from the powerful gun rights lobby, the National Rifle Association, and opposes an assault weapons ban.

The winner of the Democratic primary is likely to win the seat because the district is heavily Democratic.

Bloomberg's Independence USA political action committee, or PAC, has blanketed Chicago television with more than $2 million in ads attacking Halvorson's stance on guns and endorsing Robin Kelly, a candidate supporting gun control, according to PAC spokesman Stefan Friedman.

"Halvorson would have probably won this district if the gun control issue hadn't intervened," said Dick Simpson, a former Chicago city council member and political scientist at the University of Illinois, Chicago. "Whether she still can win it is unclear."...

"Whenever the subject of gun control comes up, supporters of the practice (generally of the liberal persuasion) inevitably run up against one major roadblock to pushing sweeping laws — specifically, the United States constitution, and its second amendment, which protects a sweeping right to keep and bear arms.

Thus, experts have read the amendment in a way that hasn’t banned the ownership of weapons altogether. This reading has only been strengthened by recent Supreme Court cases such as District of Columbia vs. Heller, and McDonald vs. Chicago, which have codified the right to keep and bear arms as being as important as other rights such as the right to free speech.

Undoubtedly, this is frustrating to many opponents of gun rights, since even in moments of widely felt national tragedy like the present moment, their agenda requires a constitutional justification as well as a political one – a fact that puts them at a permanent disadvantage relative to gun rights supporters.

Which is why opponents of gun rights have seized on a well-worn constitutional argument in the wake of the shootings at Sandy Hook Elementary. That argument – an old chestnut of the anti-gun community – is that the second amendment doesn’t actually grant every American a right to keep and bear arms, and is in fact obsolete because it only applies to members of state militias. This argument focuses on what legal scholars call the prefatory clause of the second amendment, bolded below for emphasis:

A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.

So since the amendment itself mentions the maintenance of “well regulated” militias as the purpose of the right to keep and bear arms, the argument goes, gun control is perfectly permissible so long as it only targets private citizens and not state militias. In fact, the liberal Daily Beast published an article on Tuesday making this exact argument.

The Argument for “Militia-Only” Gun Ownership

So well-worn is this argument that Justice John Paul Stevens used it in his dissent in District of Columbia vs. Heller (emphasis added):

The Second Amendment was adopted to protect the right of the people of each of the several States to maintain a well-regulated militia. It was a response to concerns raised during the ratification of the Constitution that the power of Congress to disarm the state militias and create a national standing army posed an intolerable threat to the sovereignty of the several States. Neither the text of the Amendment nor the arguments advanced by its proponents evidenced the slightest interest in limiting any legislature’s authority to regulate private civilian uses of firearms. Specifically, there is no indication that the Framers of the Amendment intended to enshrine the common-law right of self-defense in the Constitution.

As did Justice Stephen Breyer in the same case (emphasis added):

The majority’s conclusion is wrong for two independent reasons. The first reason is that set forth by Justice Stevens—namely, that the Second Amendment protects militia-related, not self-defense-related, interests. These two interests are sometimes intertwined. To assure 18th-century citizens that they could keep arms for militia purposes would necessarily have allowed them to keep arms that they could have used for self-defense as well. But self-defense alone, detached from any militia-related objective, is not the Amendment’s concern.

Of these two Justices, Breyer remains on the court, and would presumably be all too happy to resurrect this argument to limit the scope of the Second Amendment. So at the level of legal strategy, it is easy to see where this argument – that the Second Amendment is much narrower in scope than a generalized right to bear arms – might be appealing...."

State Attorney General Lisa Madigan had asked for the entire 7th U.S. Circuit Court of Appeals to consider the case after a three-judge panel in December gave lawmakers until June 8 to legalize the concealed carry of firearms.

Madigan argued that the ruling conflicts with decisions by other federal appellate courts and goes beyond what the U.S. Supreme Court has held.

"In their first collective response to the mass shooting in Newtown, Connecticut late last year, every Republican on the House Judiciary committee has signed a letter criticizing the Obama administration for not enforcing current federal gun measures.

In the wake of the Sandy Hook Elementary School shooting Dec. 14, House Speaker John Boehner said the House committees of jurisdiction would conduct reviews of the nation's gun laws before determining whether any new measures or changes to current laws are appropriate.

Now, members of the House Judiciary GOP have banded together, bashing the president and attorney general for lack of enforcement, citing a slowing trend of federal weapons prosecutions during his presidency.

The letter points to a study conducted by Syracuse University that found a 30 percent decline in prosecutions compared with the peak year of the Bush presidency. In 2004, there were 11,015 prosecutions, but data shows that by the final year of President Obama's first term in 2012, just 7,774 cases were prosecuted.

"Before the President demands that Congress push through legislation to stifle the rights of law abiding citizens, he should take care to enforce the laws that are already on the books," Rep. Bob Goodlatte, the chairman of the committee, wrote in a statement today. "We must all be looking for ways to prevent senseless acts of violence and the taking of innocent life but the best place to start would be enforcing the laws that Congress has already enacted."...

By trying to stay out of the gun control debate, the popular coffee chain has actually found itself in the thick of it. A spokesperson for Starbucks tells the Washington Post that the company’s position is for stores to comply with the local laws where they are located.

“Some anti-gunners wanted citizens such like myself kicked out of Starbucks for carrying a gun and Starbucks said, ‘Hey, we’re here to sell cakes and coffees,’ ” Ed Levine, founder of Virginia Open Carry, told WNEW’sJohn Domen.

When the complainants attempted to organize a boycott of the coffee chain, the gun enthusiast jumped into action. Levine organized a day of support for the franchise known for its loyal following and potent java.

The inaugural event went well and participants are hoping to make it an annual tradition.

“I’ve got a pocket full of $2 bills that signify the Second Amendment,” Levine said at a Starbucks in northern Virginia. “We tip them and we show them we support them, supporting us.”...

"ST. PAUL, Minn. (AP) — Handgun holstered on his hip, Anthony Triemert showed up to Minnesota's Capitol on Friday for the latest in a number of recent legislative hearings on various gun control proposals.

"I just came down here today to show support for Second Amendment rights," he said. But Triemert's right to carry a loaded gun is safe in this building. Minnesota is one of nine states that allow people to carry guns into the brick-and-mortar homes of government.

All he and other Minnesotans have to do is notify the Minnesota Department of Public Safety in advance. As hundreds of pro-gun activists have streamed into the state's legislative hearings on gun controls, such notifications have spiked in the last month — almost 1/5th of all notifications given since the current permit law took effect in 2006.

Between Jan. 18 and Feb. 22, 150 people notified DPS of the intent to carry their weapons on the Capitol complex. By contrast, only 56 such notifications were filed in all of 2012. And since the law took effect, a total of 723 individuals have notified the agency.

On Friday, gun rights activists again came out in force for the second day of the Senate Judiciary Committee hearing. Most of them didn't wear their guns openly like Triemert, though he was not the only one. An auto mechanic from Brooklyn Park who's now on disability, Triemert said he wears the gun almost everywhere he goes.

"I don't believe in gun safe zones. I think it's an advertisement for a killing zone," Triemert said, noting he carries a weapon for protection because of his own physical limitations.

Private establishments in Minnesota are allowed to post signs stating that guns are not allowed on the premises. But no such rules are in place at the Capitol, which has no metal detectors at its public entrances...."

The NRA's assertion and its obtaining of the memo in the first place underscore the no-holds-barred battle under way as Washington's fight over gun restrictions heats up.

The memo, under the name of one of the Justice Department's leading crime researchers, critiques the effectiveness of gun control proposals, including some of President Barack Obama's. A Justice Department official called the memo an unfinished review of gun violence research and said it does not represent administration policy.

The memo says requiring background checks for more gun purchases could help, but also could lead to more illicit weapons sales. It says banning assault weapons and high capacity ammunition magazines produced in the future but exempting those already owned by the public, as Obama has proposed, would have limited impact because people now own so many of those items.

It also says that even total elimination of assault weapons would have little overall effect on gun killings because assault weapons account for a limited proportion of those crimes.

The nine-page document says the success of universal background checks would depend in part on "requiring gun registration," and says gun buybacks would not be effective "unless massive and coupled with a ban."


The administration has not proposed gun registration, buybacks or banning all firearms. But gun registration and ownership curbs are hot-button issues for the NRA and other gun-rights groups, which strenuously oppose the ideas.

Justice Department and White House officials declined to provide much information about the memo or answer questions about it on the record.

The memo has the look of a preliminary document and calls itself "a cursory summary" and assessment of gun curb initiatives. The administration has not release it officially.

But the NRA has posted the memo on one of its websites and cites it in advertising aimed at whipping up opposition to Obama's efforts to contain gun violence. The ad says the paper shows that the administration "believes that a gun ban will not work without mandatory gun confiscation" and thinks universal background checks "won't work without requiring national gun registration" — ideas the president has not proposed or expressed support for.

"Still think President Obama's proposals sound reasonable?" Chris W. Cox, the NRA's chief Washington lobbyist, says in the ad.

Last month, White House spokesman Jay Carney said none of Obama's proposals "would take away a gun from a single law-abiding American." Other administration officials have said their plans would not result in gun seizures or a national gun registry.

A Justice Department official who would only discuss the issue on condition of anonymity said the NRA ad misrepresents Obama's gun proposals and that the administration has never backed a gun registry or gun confiscation.

While the memo's analysis of gun curb proposals presents no new findings, it is unusual for a federal agency document to surface that raises questions about a president's plans during debate on a high-profile issue such as restricting firearms.

Obama wants to ban assault weapons and ammunition magazines exceeding 10 rounds that are produced in the future. He wants universal background checks for nearly all gun purchases. Today, checks are only mandatory on sales by federally licensed gun dealers, not transactions at gun shows or other private sales.

His plan also includes tougher federal laws against gun trafficking and straw purchases, which occur when a person legally buys a firearm but sells it to a criminal or someone else barred from owning a weapon...."

"The NRA's Cox declined to say how his organization obtained the memo.

He said the commercial is running online in 15 states, including many Republican-leaning states where Democrats will defend Senate seats next year, such as Alaska, Arkansas, Louisiana, Montana, North Carolina, South Dakota and West Virginia. There are also ads in papers in five states.

The memo was written under the name of Greg Ridgeway, acting director of the National Institute of Justice, the Justice Department's research arm. It is dated Jan. 4, nearly two weeks before Obama announced his plan for restricting guns, and Ridgeway's first day as acting chief.

Justice Department officials said Ridgeway was not granting interviews. He came to the institute last July from the RAND Corporation, a nonprofit research institution where he studied criminal justice issues, and has a Ph.D. in statistics.

The memo says straw purchases and gun thefts are the largest sources of firearms used in crimes, and says such transactions "would most likely become larger if background checks at gun shows and private sellers were addressed...."

Firearms-makers to politicians on gun rights: You balk, we walk
Firearms companies ranging from gun shops to machinists are joining forces to oppose new gun control laws. Some are threatening to move away from states that crack down on guns, others are refusing to sell gear to police that can't be sold to citizens.

"A growing number of firearm firms in the US are vowing to reverse-boycott local and state governments that enact any new infringements on the Second Amendment.

Vowing to close what they're calling "the police loophole," at least 50 US companies, ranging from gun machinists to gun shops, are now saying publicly they'll refuse to sell weapons and gear to police in places where governments have banned the use of the same gear by civilians.

Quality Arms, located in Rigby, Idaho, writes on its website that it "will not supply any firearm or product manufactured by us or any other company, nor will we warranty, repair, alter or modify a firearm owned by any state, county or municipality that infringes on the right of its citizens to bear arms under the 2nd Amendment."

The move comes as Congress and some state houses are considering new gun controls in the wake of the Dec. 14 massacre at Sandy Hook Elementary School in Newtown, Conn. The most direct target of the "police loophole" movement seems to be New York State, which put into law a raft of new gun control regulations, including limiting the size of magazines, last month.

"Based on the recent legislation in New York, we are prohibited from selling rifles and receivers to residents of New York [so] we have chosen to extend that prohibition to all governmental agencies associated with or located within New York," York Arms of Buxton, Maine, writes on its website.

So far, none of the major gun manufacturers have joined the list, and it's an open question whether the smaller companies are bluffing or would even have occasion to sell directly to governments in New York State, for example.

"Unless S&W, Springfield Armory, Ruger, Remington, etc. get on board, these boycotts are practically useless," writes an anonymous poster on the Sipsey Street Irregulars blog.

Meanwhile, the push for more gun control continues across the country, led by President Obama.

On Friday, Obama's political advocacy group, Organizing for Action, held over 100 events across the country, including letter-writing parties, rallies with police chiefs and mayors, and candlelight vigils, to push for Obama's federal gun control plan, which includes beefing up background checks and banning assault weapons and high-capacity magazines.

Nevertheless, at least one of the companies on the "police loophole" list, Predator Intelligence of Phoenix, Ariz., says its pushback against new gun control laws is having an impact.

"We have police from LA and NYC that contact us about purchasing Magazines if they provide proof," the company wrote recently on Facebook. "Why should we consider sending them to states that want to enforce laws that are unconstitutional?"...

"If you've never been to a gun show, you should go. It's worth it simply to get a look at one side of the national debate we're having on firearms, the Second Amendment, and public safety.

I went to a big show in Virginia recently (free admission if you joined the National Rifle Association). Spread out over three days at a sprawling exhibition hall near Dulles Airport, it was packed with buyers and sellers of all kinds of weaponry — from a few super-pricey Browning shotguns ($16,500-$19,000) to a .25-caliber Saturday Night Special for $115.

Who goes to them? Some of the same people, who, according to a recent Pew Research survey, tend to own guns in the first place: White men from the South. Perhaps gun shows elsewhere are different, but that's who was generally there in the packed exhibition hall. There were kids as well, tagging along with their dads as they perused the aisles of weaponry, knives, clothing, and other wares. And this being Fairfax County, one of the wealthiest counties in America, a few men were well-dressed, corporate-looking types, probably dropping in after work on a Friday night. It was polite, orderly, well-run and informative.

A gun show is a vast marketplace for private transactions, many of which are not regulated by law. Supporters of gun rights applaud this, but gun control advocates criticize this so-called "gun-show loophole," which they say allows anyone to buy a gun without having to first pass a federal background check. Anecdotally, I found that most sellers were licensed dealers, but not all. AFTE estimates that between 25 and 50 percent are not...."

These two courts aren’t the first to mull this issue. Looking ahead, appeals courts in California and Virginia are set to review the issue...."
