"Bloomberg: If You Sell a Gun to Your Son, 'There's Something Wrong in Your Family'"

[link to cnsnews.com]

"(CNSNews.com) – If you sell a gun to your son, “there’s something wrong with your family," says New York City Mayor Michael Bloomberg.

In a radio appearance on Friday, Bloomberg, a gun control activist and co-chair of Mayors Against Illegal Guns, praised the legislation that is now moving forward in the Senate. The bill would require universal background checks for most sales of firearms, including those online and at gun shows.

“The only thing it would not cover is if you sold a gun to your son, for example,” Bloomberg told radio host John Gambling. “Number one, I don't know how we would ever enforce that if it were the law. So to make a big deal about that's carved out, so what? It doesn't change anything.”

“Number two, I would argue if you want to sell your gun to your son, maybe you have a problem in your family,” he said. “Why don't you just give—I don't know if you should have a gun or not, but if you have a commercial transaction of $100 with your son, there's something wrong in your family...."

"Graham to Oppose Toomey-Manchin"

[link to www.nationalreview.com]

"South Carolina senator Lindsey Graham announced earlier today that he will vote against the compromise amendment proposed last week by senators Pat Toomey and Joe Manchin, which would expand criminal background checks to all advertised gun sales. Graham announced his decision on Twitter, arguing that the bill is “well-intentioned” but does not constitute “a solution to illegal gun violence”:

I will oppose the Toomey-Manchin background check amendment. The proposal, while well-intentioned, is not a solution to illegal gun violence

"Background checks amount to ‘new tax on guns,’ Coburn insists"

[link to www.washingtontimes.com]

"The deal senators have struck to expand firearm background checks to all Internet and gun show sales will drive up prices for consumers, weapons retailers say.

Manufacturers say the deal, which is the crux of the gun bill that senators will begin debating this week, also includes language that gives background checks for sales at gun shows priority over in-store purchases — something their top trade group says is unfair.

Under current law, background checks are required for sales only by licensed retailers. The director of the top trade group for gun retailers said expanding checks to include Internet and gun show purchases will drive up prices and push business to federally licensed firearms retailers, who in many cases will perform the checks for private sellers.

“You’re going to have a lot more people paying a lot more money,” said Andrew Molchan, director of the Florida-based Professional Gun Retailers Association Inc.

If background checks are required for all sales, he said, federal licensees could effectively corner the market, set their own transaction fees and pass the costs on to consumers.

“If they have to do [the background checks], that means they have to pay,” he said. “In the real world, a lot of people are going to raise their prices.”

As the Senate begins its debate, gun control advocates’ hopes for a broader ban on semi-automatic weapons and high-capacity ammunition magazines have faded. That has left background checks as the centerpiece of the fight.

Proponents argue that tightening the system to include more transactions can help keep guns out of the hands of criminals and the mentally ill, but opponents say the paperwork requirements could lead to a national gun registry.

Sens. Patrick J. Toomey, Pennsylvania Republican, and Joe Manchin III, West Virginia Democrat, tried to combat those fears in their background-check proposal by specifically outlawing federal attempts to keep a registry and including stiff prison sentences for violators.

But Sen. Tom Coburn, an Oklahoma Republican who was part of the negotiations with Mr. Toomey before dropping out of the talks, said the record-keeping provisions in the deal are too onerous and amount to a “new tax on guns....”

"Parties’ Rifts Hinder Background Check Measure in Gun Bill"

[link to www.nytimes.com]

"WASHINGTON — Deep divisions within both parties over a bipartisan measure to extend background checks for gun buyers are threatening its chances as the Senate this week begins debating the first broad gun control legislation in nearly 20 years.

In spite of a vote last Thursday in favor of debating new gun measures, some Democrats who are facing re-election next year in conservative states have already said they will not vote for the background check measure offered by Senators Patrick J. Toomey, Republican of Pennsylvania, and Joe Manchin III, Democrat of West Virginia, forcing Democrats to look desperately across the aisle to fill the gaps.

Republicans, in the meantime, are bitterly torn between moderates who feel pressure to respond to polls showing a majority of Americans in support of some new gun regulations and conservatives who are deeply opposed to them.

Further, an impending immigration bill may force Republicans to choose between softening their stance on either immigration or guns, but not both.

Sixty-eight senators, pressured by the families of those killed in gun violence, came together last week to overcome a filibuster threat that would have quashed the debate on a broader gun bill. But many of those votes are clearly not translating into yes votes for the only background check measure that has attracted bipartisan support...."

"Little Red Riding Hood and AR-15s? New Ads Contrast School Bans and Gun Regulations"

[link to shine.yahoo.com]

"It's a startling, uncomfortable image: Two little girls are sitting in a school library. One is holding a copy of "Little Red Riding Hood." The other cradles an AR-15 semi-automatic rifle that's nearly as big as she is.

"One child is holding something that's been banned in America to protect them," the ad reads. "Guess which one."

The ad, released on Monday, is the first in a series created by Grey Group for pro gun-regulation organization Moms Demand Action for Gun Sense in America, which was founded in the wake of the shootings at Sandy Hook Elementary School in Newtown, Connecticut last year.

"We chose these images to point out the absurdity in America's gun laws right now," the Moms Demand Action's founder, Shannon Watts, told Yahoo! Shine on Monday. "We say that we are very in favor of child welfare and yet, even after the mass shooting of 20 innocent children in the sanctity of their elementary school, we aren't acting to ban assault weapons."

The ad contrasting an AR-15 with a classic cautionary tale (which was banned by two California schools in 1990 because Little Red Riding Hood is carrying a bottle of wine in her basket, a detail taken directly from the original 17th-century story by Charles Perrault) garnered an immediate reaction online.

"This is a powerful ad. Seeing that gun in a school environment is shocking," wrote Anne Galbraith on Facebook. "An adult armed with a weapon like this is at war with their fellow Americans—and sometimes they are our children. We must protect them."

"Notice how we have limited the 1st Amendment for the safety of our children?" asked Erin Dando on Facebook. "Now let's do the same for the 2nd!"

But some people have pointed out that, no matter how you look at it, guns have always been subject to more restrictions than books.

"This is a stupid poster. Guns ARE banned in schools, people. BOTH of these things are banned in schools," pointed out Jenny Thompson on the Moms Demand Action Facebook page. "You can get Little Red Riding Hood in another library just like you can get a gun outside of school. This poster could be done way better than this. I'm disappointed...."

"Senator urges colleagues to stand firm on gun background checks for gun buyers"

[link to news.yahoo.com]

"WASHINGTON - Democrat Joe Manchin and Republican Pat Toomey defended their plan to expand background checks for gun buyers on Monday, as Manchin opened the Senate's debate on the proposal by urging colleagues to "make a difference" and resist political pressure to reject the measure.

Manchin's call for bipartisanship on one of the nation's most divisive issues came as the background checks plan that he and Toomey devised was headed to a close vote in the Senate later this week.

After an intense, emotional week of lobbying that included family members of victims from the Newtown, Connecticut massacre visiting Capitol Hill to call for action, both sides of the gun-control debate scrambled for votes on a crucial piece of President Barack Obama's gun-control legislation.

Manchin, who is from West Virginia and has long been a strong supporter of gun rights, sought to assure others that the background checks plan would not limit law-abiding citizens' access to guns. He also urged senators to look beyond politics in voting on the plan.

"'No' is the safest vote as a congress person or senator, I understand that. I can vote 'no' on about everything and be fine," Manchin said of the plan, which has drawn opposition from the National Rifle Association and other gun-rights proponents, but is supported by two other gun owners' groups.

"I want to make a difference. I want to do something," Manchin said, saying that members of Congress should not be so worried about "all of the outside pressure, and maybe getting elected, maybe getting campaign funds."

The proposal to expand criminal background checks to include sales made online and at gun shows represents Obama's best hope for meaningful gun-control legislation in the aftermath of the killings of 20 children and six adults at an elementary school in Newtown, Connecticut, on December 14.

The deal between Manchin and Toomey, designed to keep guns out of the hands of criminals and the mentally ill, would be the centerpiece of gun-control legislation that also would tighten laws on gun trafficking and increase funding for school security.

Like Manchin, Toomey has been a staunch defender of Americans' constitutional right to bear arms. The Pennsylvania senator said he did not consider the background checks provision to be gun control, while acknowledging that there was no way to prevent all criminals or mentally unstable people from securing firearms.

"But can't we take a very modest step to make it more difficult if we can do it in a way that does not infringe on the Second Amendment rights of law-abiding citizens?" Toomey asked...."

"Gun control bill in peril"

[link to www.politico.com]

"The tough gun-control bill that President Barack Obama wants now has little, if any, chance of passing this Congress – it’s struggling in the Senate and facing outright rejection in the House.

Vice President Joe Biden worked the phones Monday to try to salvage a bipartisan bill in the Senate but has come up short. Personal appeals from parents of Newtown victims and former Rep. Gabby Giffords haven’t worked either.

And even if Senate negotiators get to 60 votes, the House is certain to rewrite the bill – or discard it altogether.

A defeat would mean that in just five months after the Sandy Hook Elementary School shootings, the best chance for new gun controls in 20 years is slipping away.

The reasons are many:

The National Rifle Association hasn’t budged, and it warned supporters of the compromise Senate bill — authored by Sens. Joe Manchin (D-W. Va.) and Pat Toomey (R-Pa.) — that the group would remember their vote when they are next up for reelection.

Speaker John Boehner’s House Republican Conference is turned off by back-room deals and many House Republicans come from the South and the Mountain West, where gun ownership is a way of life.

And moderate red state Democrats, and reluctant conservatives and couldn’t be persuaded to support even a bipartisan bill that falls far short of what gun control activists wanted...."

"Obama: "Unimaginable" That Congress Would "Defy" Americans And Not Pass Gun Control"

[link to www.realclearpolitics.com]

"I think we’ve got a good chance of seeing it pass if members of Congress are listening to the American people," President Obama said in an interview on NBC's "Today Show" that aired on Tuesday. "The notion that Congress would defy the overwhelming instinct of the American people after what we saw happen in Newtown, I think, is unimaginable."

Obama was then asked by Savannah Guthrie how he could expect Democrats in red states to vote on this bill when he, as a Senator, didn't have to himself...."

"Obama Calling Lawmakers In Effort To Save Gun Background Check Measure"

[link to washington.cbslocal.com]

"WASHINGTON (AP) — A bipartisan proposal to expand background checks to more gun buyers seemed in jeopardy Monday as a growing number of Republican senators expressed opposition to the proposal, perhaps enough to derail it. But there was plenty of time for lobbying and deal-making to affect the outcome, and the sponsors seemed willing to consider carving out at least one exemption in an effort to drum up votes.

The White House said President Barack Obama was calling lawmakers, as both sides hunted support for a nail-biting showdown.

As of Monday evening, some senators were saying the vote now appeared likely late this week, rather than midweek as top Democrats have hoped. Such a delay would give both sides more time to find support.

“The game hasn’t even started yet, let alone over,” said Sen. Joe Manchin, D-W.Va., who reached a background check compromise last week with Sen. Patrick Toomey, R-Pa., on which the Senate was preparing to vote.

In one sign of the bargaining underway, Manchin and Toomey seemed willing to consider a change to their deal that would exempt gun buyers from background checks who live hundreds of miles from licensed firearms dealers, said one Senate aide...."

"Mark Kelly on gun control bill: 'We do have a problem' with many senators" -- "The husband of former Rep. Gabrielle Giffords, an advocate of stricter gun laws, warned a fellow Arizonan of repercussions at the ballot box if he votes against a gun control measure to expand background checks. A lot of senators, said Mark Kelly, want a reason 'to get to no.'"

[link to news.yahoo.com]

"Mark Kelly, husband of former US Rep. Gabrielle Giffords, says the gun control organization the couple has founded will work to defeat Sen. Jeff Flake (R) in the next election if the Arizona senator votes against expanding background checks to include more gun buyers.

Mr. Kelly, a retired Navy captain and astronaut, said Senator Flake is “a good friend” of Ms. Giffords. But he gave this warning Tuesday at a Monitor-hosted breakfast with reporters: “If there was the right candidate out there and he [Flake] didn’t support this legislation, … you know friendship is one thing … saving people’s lives, especially first-graders', is another.”

On Monday, Flake posted on Facebook a statement that he will oppose the bipartisan legislation on background checks drafted by Republican Sen. Pat Toomey of Pennsylvania and Democratic Sen. Joe Manchin of West Virginia. The measure “simply goes too far,” Flake said.

Kelly criticized Flake's action.

“Senator Flake’s timing for his posting to his Facebook was not ideal in my opinion,” he said. On Tuesday afternoon, Flake is slated to join Giffords and Kelly, along with Vice President Joseph Biden and House Speaker John Boehner, to dedicate a room in the House in honor of Gabriel Zimmerman. He was a member of Giffords's staff and was killed in the attack that gravely wounded her in January 2011.

The warning to Flake from the co-founder of Americans for Responsible Solutions comes as amid reports that prospects are dimming for new gun control legislation. Republican opposition to expanded background checks is growing in the Senate, “enough to put the proposal’s fate in jeopardy,” the Associated Press reported Tuesday. Likewise, a Politico story on Tuesday said gun control is “struggling in the Senate and facing outright rejection in the House.”

"Let’s hope the Boston Marathon bomber is a white American " --There is a double standard: White terrorists are dealt with as lone wolves, Islamists are existential threats

[link to www.salon.com]

"As we now move into the official Political Aftermath period of the Boston bombing — the period that will determine the long-term legislative fallout of the atrocity — the dynamics of privilege will undoubtedly influence the nation’s collective reaction to the attacks. That’s because privilege tends to determine: 1) which groups are — and are not — collectively denigrated or targeted for the unlawful actions of individuals; and 2) how big and politically game-changing the overall reaction ends up being.

This has been most obvious in the context of recent mass shootings. In those awful episodes, a religious or ethnic minority group lacking such privilege would likely be collectively slandered and/or targeted with surveillance or profiling (or worse) if some of its individuals comprised most of the mass shooters. However, white male privilege means white men are not collectively denigrated/targeted for those shootings — even though most come at the hands of white dudes.

Likewise, in the context of terrorist attacks, such privilege means white non-Islamic terrorists are typically portrayed not as representative of whole groups or ideologies, but as “lone wolf” threats to be dealt with as isolated law enforcement matters. Meanwhile, non-white or developing-world terrorism suspects are often reflexively portrayed as representative of larger conspiracies, ideologies and religions that must be dealt with as systemic threats — the kind potentially requiring everything from law enforcement action to military operations to civil liberties legislation to foreign policy shifts.

“White privilege is knowing that even if the bomber turns out to be white, no one will call for your group to be profiled as terrorists as a result, subjected to special screening or threatened with deportation,” writes author Tim Wise. “White privilege is knowing that if this bomber turns out to be white, the United States government will not bomb whatever corn field or mountain town or stale suburb from which said bomber came, just to ensure that others like him or her don’t get any ideas. And if he turns out to be a member of the Irish Republican Army we won’t bomb Dublin. And if he’s an Italian-American Catholic we won’t bomb the Vatican.”

Because of these undeniable and pervasive double standards, the specific identity of the Boston Marathon bomber (or bombers) is not some minor detail — it will almost certainly dictate what kind of governmental, political and societal response we see in the coming weeks. That means regardless of your particular party affiliation, if you care about everything from stopping war to reducing the defense budget to protecting civil liberties to passing immigration reform, you should hope the bomber was a white domestic terrorist. Why? Because only in that case will privilege work to prevent the Boston attack from potentially undermining progress on those other issues.

To know that’s true is to simply consider how America reacts to different kinds of terrorism...."

"Kansas Governor Sam Brownback Signs 2nd Amendment Protection Act into Law"

[link to blog.tenthamendmentcenter.com]

"TOPEKA, KS (April 16, 2013) – Today, Kansas Governor Sam Brownback signed into law Senate Bill 102 (SB102), formerly HB2199 – the 2nd Amendment Protection Act. In the wake of increased federal interest in restricting the right to keep and bear arms, the new Kansas law is the most comprehensive nullification of such acts thus far.

The new law nullifies a wide range of federal attacks on the right to keep and bear arms in the State of Kansas. It states, in part:

Any act, law, treaty, order, rule or regulation of the government of the United States which violates the second amendment to the constitution of the United States is null, void and unenforceable in the state of Kansas

In conjunction with Section 6a (quoted above), the bill defines what is meant by “the second amendment to the constitution of the United States,” and that it isn’t based off a decision of the supreme court.

The second amendment to the constitution of the United States reserves to the people, individually, the right to keep and bear arms as that right was understood at the time that Kansas was admitted to statehood in 1861, and the guaranty of that right is a matter of contract between the state and people of Kansas and the United States as of the time that the compact with the United States was agreed upon and a
dopted by Kansas in 1859 and the United States in 1861...."

"Calif. Dems push wide-ranging gun control bills"

[link to news.yahoo.com]

"SACRAMENTO, Calif. (AP) — California lawmakers took their first step toward moving a package of gun control bills Tuesday, following tough firearm and ammunition restrictions enacted in several other states in the wake of recent shooting rampages.

As dozens of supporters and opponents packed the committee room, Democrats in the state Senate began to use their majority to advance a group of seven bills that would further tighten California's strict gun laws. Final votes were not expected until late Tuesday, sending the measures to a second Senate committee.

One of the proposals would prohibit the sale of any semi-automatic rifle that accepts detachable ammunition magazines, prompting activists on both sides of the debate to say the plan goes beyond bans in other states.

"We simply can't wait until the next tragedy before taking action," Los Angeles Mayor Antonio Villaraigosa told the Senate Public Safety Committee.

The proposals come in the aftermath of mass shootings in Newtown, Conn., and Aurora, Colo. Some of the measures, including a ban on possessing ammunition magazines holding more than 10 bullets, would apply to current gun owners as well as those who buy weapons in the future.

Also, bills in the package would:

— Make it more difficult to rapidly reload weapons with high-capacity magazines.

— Add a combination shotgun-rifle to the state's list of prohibited weapons.

— Require background checks for all gun owners.

— Require ammunition buyers to undergo a background check and get a permit.

— Require more training for gun buyers.

— And add new crimes to those that disqualify California residents from owning weapons...."

[link to blogs.marketwatch.com]

"New Hampshire Sen. Kelly Ayotte Wednesday morning issued a statement that seemingly spells defeat for the background check amendment sponsored by West Virginia’s Joe Manchin and Pennsylvania’s Pat Toomney that is up for a vote later on Wednesday.

Though the statement mostly explains which amendments she is backing, the Republican makes clear the background checks went too far.

“While steps must be taken to improve the existing background check system, I will not support the Manchin-Toomey legislation, which I believe would place unnecessary burdens on law-abiding gun owners and allow for potential overreach by the federal government into private gun sales,” she said.

Ayotte was considered one of the swing voters...."

"Senate rejects gun amendment compromise"

[link to news.yahoo.com]

"The Senate on Wednesday rejected a bipartisan amendment that would have expanded background checks on gun purchases, a blow to advocates calling for more strict firearm laws after the mass shootings in Newtown, Conn., late last year.

The measure, the product of intense negotiations between Pennsylvania Republican Sen. Pat Toomey and West Virginia Democratic Sen. Joe Manchin, would have extended background check requirements on gun owners. It needed 60 votes to pass, but failed 54-46.

Democratic Sens. Mark Begich of Alaska, Heidi Heitkamp of North Dakota, Mark Pryor of Arkansas and Max Baucus of Montana voted against it. (Sen. Harry Reid of Nevada switched his vote to no at the end, a procedural tactic that allows him to bring it up for a vote later.) In addition to Toomey, Republicans who supported the amendment were Sens. Mark Kirk of Illinois, Susan Collins of Maine and John McCain of Arizona...."

"New York City Mayor Michael Bloomberg, one of the nation's most prominent gun control critics, issued a scathing statement Wednesday after legislation to expand background checks to gun shows and Internet sales failed in the Senate:

Today’s vote is a damning indictment of the stranglehold that special interests have on Washington. More than 40 U.S. senators would rather turn their backs on the 90 percent of Americans who support comprehensive background checks than buck the increasingly extremist wing of the gun lobby. Democrats – who are so quick to blame Republicans for our broken gun laws – could not stand united. And Republicans – who are so quick to blame Democrats for not being tough enough on crime – handed criminals a huge victory, by preserving their ability to buy guns illegally at gun shows and online and keeping the illegal trafficking market well-fed...."

"Obama angrily denounces gun-rights groups as willful liars"

"President Obama angrily blamed the defeat Wednesday of his centerpiece gun-control proposal on lies spread by the National Rifle Association, calling it “a pretty shameful day for Washington.”

“The gun lobby and its allies willfully lied about the bill,” Mr. Obama said in the White House rose garden about 90 minutes after the vote. “It came down to politics.”

As he spoke, Mr. Obama was surrounded by family members of victims of the Newtown, Conn., school shooting. Also with him was former Rep. Gabby Giffords of Arizona, wounded in an assassination attempt.

Senators voted 54-46 late Wednesday to expand background checks of gun purchases, six votes shy of the 60 needed for passage of the amendment.

The vote was a huge blow to the president’s efforts since the Newtown, Conn., school massacre last December to enact a broad package of new gun laws. Mr. Obama and his team had considered background checks the most likely gun restriction to be approved by Congress, with polls showing as much as 90 percent of the public in favor of the measure immediately after the Newtown shootings...."

First intelligent thing these two have done!

"CO: Udall, Bennet Vote Against Assault-Weapons Ban"

[link to thecoloradoobserver.com]

"WASHINGTON — Four months after hinting they would support a ban on semi-automatic weapons, Colorado’s two Democratic senators voted no on a legislative proposal designed to do just that.

“(I)t went too far because it would also have banned certain hunting rifles and even some shotguns,” Sen. Mark Udall said in a press release. “If this bill had been more carefully crafted to only ban weapons designed for the battlefields and keep them out of the hands of the criminals and the mentally ill, I would have supported it.”

Both Udall and Sen. Michael Bennet released statements after the Dec. 14 massacre at Sandy Hook Elementary in Newtown, Conn. that supported the idea of banning assault weapons. Yet neither senator formally endorsed legislation sponsored by Sen. Dianne Feinstein (D-Calif.).

The Feinstein measure sought to prohibit the sale, manufacture, transfer, and importation of more than 150 semi-automatic weapons. Rep. Ed. Perlmutter (D-Golden) is the sponsor of a companion version in the House.

Feinstein’s amendment was defeated 40-60. The legislation was unveiled at an emotional, elaborate press event in January, but proponents conceded that approving the measure through a Senate with many red-state Democrats up for re-election in 2014 was an uphill struggle.

An administration official said the White House did not expect the ban to pass, as AR-15s are the most popular rifle in the country. The official added that Vice-President Biden met for half an hour in the West Wing with Dan Baum, a Boulder resident and author of Gun Guys, a book on the popularity of the gun culture in rural America...."

"The gun lobby that senators and congressmen are really afraid of (hint: it’s not the NRA)"

[link to news.yahoo.com]

"As the Senate moves to vote on expanding background checks for gun purchases, the Gun Owners of America lobby group has a warning for Republicans on Capitol Hill: vote against background checks or face a showdown with the GOA in the next election.

“We'll be doubling down to make sure the House members realize that they're all up for reelection next year,” says Larry Pratt, the executive director of GOA.

Pratt contends that voting in favor of background checks is a vote against the Second Amendment and will lead to a government registry of gun owners.

"This is actually a vote on registering gun owners," Pratt says. "It's not a background check. The background check doesn't solve crimes, they don't prosecute under it, it's not a crime-fighting tool, but it does give the government a list of people who have guns, and they are very open in saying they are keeping the names."

Though the background checks bill crafted by Sen. Pat Toomey (R - Pa.) and Sen. Joe Manchin (D - W. Va.) explicitly bans the federal government from creating a national firearms registry, Pratt is not convinced. Toomey now has a metaphorical red target on his back with Pratt, who says his leadership on background checks shows “you can be in Washington too long....”

Think about this for a minute.
This substantiates that gun laws are intended only for the law abiding.....

U.S. Supreme Court's 1968 Haynes v. U.S. decision:

Haynes, a convicted felon, was convicted of unlawful possession of an unregistered short-barreled shotgun. He argued that for a convicted
felon to register a gun was effectively an announcement to the
government that he was breaking the law and that registration violated his Fifth Amendment protection against self-incrimination.

The court, by an 8 to 1 margin, agreed, concluding: "We hold that a
proper claim of the constitutional privilege against
self-incrimination provides a full defense to prosecutions either for
failure to register a firearm, or for possession of an unregistered
firearm."

(Summary from American Rifleman magazine, March 2000, page 20)
So, when these gun registration schemes are announced, be very aware
that only lawful gun-owners are required to register their firearms.
unlawful owners are exempted from registration laws due to their
constitutional protection against self-incrimination.
