"CO: Sheriffs File Lawsuit Against Gun Control Bills"

"DENVER–A group of 54 Colorado county sheriffs filed a federal lawsuit Friday against two newly signed Democratic gun-control bills, calling the measures unconstitutional, impossible to enforce and a threat to public safety.

“This isn’t good public policy. These are really awful bills,” said Weld County Sheriff John Cooke at a Friday press conference. “They are unenforceable and encourage disrespect for the law, which puts both law enforcement and the public in greater danger.”

The lawsuit challenges two bills: House Bill 1224, which restricts ammunition-magazine capacity to 15 rounds or fewer, and House Bill 1229, which mandates background checks on all gun sales and transfers, including temporary transfers.

David Kopel, a constitutional-law expert and research director of the Independence Institute, said the bills violate the Constitution as well as the federal Americans with Disabilities Act. In addition to the sheriffs, the plaintiffs include Women for Concealed Carry, the Colorado Outfitters Association, and Outdoor Buddies, a charity for the disabled.

Kopel, the lead attorney on the case, said the bills fail to offer “reasonable accommodations” for the disabled as required under the federal law. He said the measures also create situations that make it virtually impossible for law-abiding citizens to comply with the law.

For example, the background-check bill would require checks on all private transfers, including scenarios in which a gun owner fleeing a burning home drops off his firearms with a neighbor. A failure to undergo a background check in that situation is punishable under the bill by 18 months in jail.

Getting a background check under less dire circumstances is also problematic because all checks must be performed by a federally licensed dealer for $10...."

"A Texas startup has developed a "smart rifle"that barely needs to be aimed.

The maker of the gun, being shipped to stores this week, brags that "even a novice shooter can become an elite long-range marksman in minutes."

The company, TrackingPoint, has said its "world's first" long range Precision Guided Firearms (PGF) integrate precision hardware, digital optics, and tracking technology to deliver an unmatched shooting experience. The line of rifles starts at about $22,500 and each comes packaged with an iPad mini including the interactive TrackingPoint mobile app.

"We're taking centuries old tech, firearms and ammunition, and introducing 21st century technology to it," TrackingPoint CEO Jason Schauble told ABC News.

The PGF line of rifles come equipped with what the company is calling the XactSystem, which uses a network tracking scope with digital display interface, laser tagging to "paint" a moving target, and a guided trigger that only lets the shooter fire when there is a high percentage shot.

The weapon is being introduced at a time when the debate over gun control has raised tempers on both sides of the argument.

Schauble said safety is paramount, just like with any other gun or rifle. "It is a firearm. It is controlled by federal law," he said...."

"Rocker Ted Nugent has continued to make his views on firearms and the Second Amendment known. On Friday, his brother, former president and chief executive of Revlon, Jeffrey Nugent, also came forward to share his opinions on gun rights in a recent Washington Post op-ed. The problem? The two adamantly disagree -- at least when it comes to universal background checks.

While Ted has come out strongly against expanding these provisions, Jeffrey has taken the opposing side and is embracing and advocating for enhanced background checks.

The famed rock star's brother begins his article by noting that he is a member of the National Rifle Association (NRA), a former Army officer and the Ted's older sibling. While he notes that both he and Ted own legal guns and hunt together, Jeffrey makes it clear that they aren't entirely in agreement on gun control.

"I agree with Ted that our constitutional right to bear arms should not be undermined. I want all those who are qualified to purchase a gun to be able to do so," he wrote. Clearly, this is a major point of contention, as background checks have drawn the ire of many conservatives and have led Ted to be one of the more vocal opponents among them. Jeffrey continues:

"I believe strongly that expanding and improving mandatory background checks will keep a lot of people who aren't entitled to Second Amendment rights from having easy access to guns. As of today, a convicted felon can find a gun show or a private seller and buy a firearm without a background check. That loophole should be closed. Every gun transaction must include a thorough background check. Why would responsible gun owners want to protect people who threaten not only our safety but our gun rights?

The NRA has it wrong: Irresponsible gun owners are bad for everyone. If you shouldn't have access to a gun, then there should be no way for you to access a gun! Can anyone argue with that?"


Gun violence and the Sandy Hook Elementary School shooting, according to the businessman, should be causing Americans to think more deeply about what the Second Amendment really means. To make his point, Jeffrey uses the notion that one must obtain a license before driving or buying a car. While car companies know the value of keeping bad and dangerous drivers off the road, he wonders why the NRA and gun industry don't work toward the same goal when it comes to those who shouldn't have access to firearms...."

As part of the agreement, Benjamin Srigley, 39, was required to pay a $1,000 fine but will not have criminal charges filed against him for the three unregistered firearms and the ammunition that investigators found in his possession, said Ted Gest, a spokesman for the office of the attorney general.

“We took it into account that he saved this boy’s life,” Mr. Gest said.

Possession of an unregistered firearm or ammunition in the District is punishable by up to a year in jail and a $1,000 fine, and prosecutors said Mr. Srigley could have faced up to seven criminal charges in the case...."

"An ad from Mayor’s Against Illegal Guns accuses Sen. Jeff Flake of breaking a promise to strengthen background checks because he voted against a bill that would have expanded background checks. But Flake did not promise to expand background checks, and he voted in favor of a bill that he argues (though others contest) would have strengthened the system.

The gun control group led by New York City Mayor Michael Bloomberg has been running TV and print ads in Flake’s home state of Arizona after Flake voted against an amendment offered by Sens. Joe Manchin, a Democrat, and Pat Toomey, a Republican. The bipartisan legislation that would have expanded background checks to private sales by unlicensed individuals at gun shows and over the Internet. Among the major gun bills considered in the wake of the school shooting in Newtown, Conn., the Manchin-Toomey amendment was viewed as having the best chance of passage.

Minutes after the Manchin-Toomey amendment failed to get the 60 votes necessary to move forward, Flake voted in support of a Republican alternative, the Grassley amendment, which received less attention. We’ll get to the particulars of each proposal, but in order to sort through the competing claims — which we are sure to see more of in future elections – it is important to remember that the sides are talking about two different bills.

In mid-January, Flake registered his opposition to President Obama’s gun control plan, saying it “goes too far.” And in a statement reported by the Arizona Republic in early March, a spokeswoman said Flake opposes universal background checks, but “believes in broader background checks like making sure mental-health records are more efficiently integrated into the National Instant Criminal Background Check System. He’s working on legislation to strengthen the reporting process of mental-health records so that those who shouldn’t have access to guns are barred from purchasing them.”

The Grassley amendment addressed those concerns, and Flake never supported expanding background checks in the way proposed by Manchin-Toomey...."

"There is a prolific myth in the United States which asserts that illegal firearms are easily obtainable. Bolstered by pro-gun lobbyists like the NRA, we are led to believe that, in most cities in America, there is a shady character on a particular street corner who will sell a gun to anybody, no questions asked, and because of this, there is no reason to eliminate loopholes allowing legal sales of firearms to, well, shady characters.

I’m a convicted felon who lives in the Bronx. Despite the nonviolent nature of my crimes—my convictions range from counterfeiting to felony-shoplifting to possession of narcotics and drug paraphernalia—I cannot legally purchase a firearm. But given my somewhat shady past (not to mention the Bronx being the Bronx) I’m fairly certain that I could find a shady character close to home who will sell me a gun illegally—with three caveats: I’d risk being sent back to prison if caught, I would be putting my life in danger, and the price of weapons bought in such deals can be in excess of five times their retail cost. To put this in perspective, the assault weapon that Adam Lanza used to murder 20 children and six adults in Newtown, Connecticut, last December, which has a retail value of between $1,000 and $2,000, could cost between five and ten grand on the streets.

My point is that purchasing firearms illegally should be an ordeal, and that effective background checks would be the first step in making it so. But what’s also pertinent is that Lanza was not a shady character with a long criminal history, and so would have had no experience moving in illicit circles. Background checks may have forced him to do so—to risk being arrested, robbed, or even killed in some dark alley for the substantial sum he’d have needed in order to buy a gun illegally.

There is, of course, a legitimate argument that background checks would not have prevented the Newtown massacre. This is likely true, but it’s also equally true that Lanza would have been denied easy access to legal firearms if his mother, the purchaser and owner of the assault weapons he used (and the first one to be murdered by Lanza) had utilized trigger locks and/or a gun safe—prudent safety features that any good NRA member would wholeheartedly advocate...."

"There are two things we can learn from The New York Times's lead story today on a 2005 law shielding gun manufacturers from lawsuits. The first is that the companies' self-defensiveness is reflexive. The second is that the NRA's biggest ally on Capitol Hill is probably the filibuster.

The passage of the Protection of Lawful Commerce in Arms Act, signed into law by President Bush, effectively drew a heavy curtain on manufacturers. On a number of occasions prior to its passage, company executives were made to offer testimony under oath about how reports criminal behavior and firearms trafficking were handled. Their answers were revelatory — which is probably one reason why NRA CEO Wayne LaPierre called it "an historic victory for the NRA."

Since Senate Bill 397 was introduced into the 109th Congress, the Senate itself has changed substantially. Only 44 of the 100 members that voted on it are still in the chamber. (It was introduced by Idaho's now-infamous Larry Craig.) But even though it's not an election year, the office is in full campaign mode, with volunteers working the phones and reviewing maps in anticipation of a new front of modern campaigning — the recall phase.

A handful of Democratic state lawmakers in Colorado face recall petition efforts in what looks to be the first wave of fallout over legislative votes to limit gun rights. In an era in which recall efforts are booming, from governor's offices down to town councils and school boards, the Colorado efforts will serve as the first test of gun-rights groups' ability to punish elected officials who expanded gun control laws after last year's Aurora, Colo., and Newtown, Conn., shooting massacres.

In Colorado, gun-rights activists wasted no time seeking recalls to oust state Senate President John Morse and three other Democratic lawmakers. The targeted lawmakers weren't necessarily the main advocates for ratcheting back gun rights, but all come from districts with enough Republicans to give opponents hope they can boot out the Democrats and replace them with lawmakers friendlier to guns. Colorado is the only state outside the East Coast to have adopted significant statewide gun controls this year.

"Colorado seems to be the testing ground for some of the gun measures, so this has national implications," said Victor Head, a plumber from Pueblo who is organizing a recall attempt against a Democratic senator.

Two of four recall efforts in Colorado already have evaporated from lack of support. But in Colorado Springs, Morse opponents are piling up signatures in gun shops and outside libraries and grocery stores. The National Rifle Association sent a political mailer saying it was coordinating the recall effort with local groups, though the local recall petitioners have denied that. The NRA did not return calls for comment on their involvement in the Colorado Springs effort.

Morse has mounted a campaign to urge voters not to sign petitions. In an indication of the national stakes, that push is largely funded by a $20,000 contribution from a national progressive group called America Votes. The Morse campaign said the donation came through the group's local Colorado office...."

"COLO. SPRINGS – More than 800 people filled The Freedom Financial Expo Center this week to rally for 2nd Amendment rights and raised more than $15,000 for the lawsuit filed by 55 county sheriffs challenging the constitutionality of gun-control measures signed into law by Gov. John Hickenlooper.

But another target of the fundraiser was embattled Senate President John Morse (D-Colo. Springs) whose office Tweeted the message “#Sheriffs4Criminals …“2day CO sheriffs stood in opposition of CO’s new gun laws, but not w/law-abiding citizens, but with criminals,” earlier this month.

El Paso County Sheriff Terry Maketa referred to Morse as the unnamed senator from Colorado Springs and “criminal” – a comment endorsed by the thunderous applause, whistles and cheers from the audience.

“He is bought and paid for, and I have no problem saying that because if you track the money, it takes you to the criminals,” said Maketa. “I know people are out there going, ‘Oh geez, did he just call somebody a criminal?’ – I did!”

Morse may be sweating bullets over being recalled; backers of the petition effort, which will end June 3, are confident that they have garnered the necessary 7,178 signatures to place the recall question on the ballot.

Morse drew the ire of the sheriffs and voters for zealously pushing through gun-control bills, cutting off opponents’ testimony and admittedly ignoring calls and emails from constituents.

Maketa is one of several county sheriffs who attempted to testify against the gun-control legislation and who filed a lawsuit challenging two of the measures, House Bills 1224 and 1229, both of which the sheriffs contend are unconstitutional and impossible to enforce.

HB 1224 bans the transfer or sales of magazines greater than 15 rounds. HB 1229 requires mandatory background checks for all firearm transfers – including temporary ones — and mandates all transfers be performed by a licensed federal agent...."

"DENVER – Save Our Shotguns, a grassroots campaign, released a poll Thursday showing 52 percent of Colorado voters support repeal of House Bill 1224 which bans ammunition magazines larger than 15 rounds.

It is one of the more controversial gun-control measures passed by Democrat legislators and signed into law by Gov. John Hickenlooper.

Opponents of the law want to ask voters to repeal the law with a November 2014 ballot question.

“With a majority of Coloradans supporting repeal of HB 1224 – before it is even on the ballot – I am confident that the wisdom of the people will ultimately overturn an action by the legislature,” said former New Mexico Gov. Gary Johnson, Honorary Chairman of Save Our Shotguns.

The legislation “might have been well intentioned, but [it] was ill advised,” said Johnson.

“Restricting 2nd Amendment rights of law-abiding citizens does not make anyone safer,” he declared. “Rather, it simply empowers those who have no regard for the law and who wish to do us harm.”

Johnson, who served as a Republican governor, ran as a Libertarian presidential candidate in 2012.

Colorado’s controversial gun-control laws have captured national attention – and more eyes will be on the state with Johnson’s leading role in the repeal effort. The founder of Our America Initiative, Johnson said his national advocacy group will also support the referendum to repeal HB 1224...."

A police department in the Chicago suburbs said some of the guns obtained from a buyback program will be sold to a pair of licensed dealers.

St. Charles Police Chief James Lamkin said about 20 firearms obtained through a gun buyback program and seized by courts will be sold to the dealers, the Chicago Tribune reported Friday.

"There's value in these guns," Lamkin said. "They're not illegal guns. Quite honestly, it's a bottom line for us...."

I am not a New York gun control liberal, either. I support a shotgun for home defense, a handgun for limited conceal/carry, and an assortment of hunting rifles to balance West Virginia's exploding deer population (as evidenced by hourly collisions with cars). So, I am hardly out of the mainstream.

Probably the most serious miscalculation opponents make is the guest list for the NRA speaker's podium. To let the half-wit half-term quitter Sarah Palin have a microphone is to alienate the very people Republicans need to work with on future legislation. To say nothing of the other speakers..."

Mike Bloomberg has never been fond of firearms and after Newtown, the outgoing New York City mayor threw what remains of his national political clout behind gun-control measures.

Now, Mayor Bloomberg is a very bright guy, but no one is ever going to accuse him of modesty. And he's been extremely vocal about gun control. Bloomberg put $12 million behind an ad buy pushing for tighter regulations. Bloomberg's ads have run in 13 states and target both Democratic and Republican senators who Bloomberg apparently believes did not listen to their constituents during the gun votes.

The problem? The people Bloomberg is attacking have begun wearing his condemnation as a badge of honor. On Friday, Sen. Mark Pryor of Arkansas — one of the Democrats the New York City mayor has been targeting with his gun control ads — launched an ad in which he brags about Bloomberg's condemnation. Yes, that's right. The fact that Mike Bloomberg does not like Mark Pryor is something that Mark Pryor believes makes him more electable.

Bloomberg dramatically overestimates how popular or influential he is outside of the confines of New York City, and his arrogance has backfired. Pryor's new ad — and expect similar ads or rhetoric from the other senators (from both parties) that Bloomberg has been firebombing with anti-gun ads — basks in Bloomberg's ire: "The mayor of New York City is running ads again me, because I oppose President Obama's gun-control legislation. ... I'm Mark Pryor. And I approve this message because no one from New York or Washington tells me what to do. I listen to Arkansas...."

“Today is the historic day that We the People tell Senator Morse, his cohorts in Denver, his backers in New York, and those watching in DC that we want a representative, not a ruler,” said a Monday post on the Facebook page Recall Senator John Morse.

The Wasington-based Democratic Legislative Campaign Committee blasted the recall effort in a statement Monday, describing organizers as “extremists in Colorado who want to waste hundreds of thousands of taxpayer dollars.”
