No because they are screened and usually not psychotic, and they need to uphold the law. If you were actually responsible for running a government and had this attitude, you'd simply lose power to the groups that could successfully systemitize the tactics which subvert your ham fisted policies. If you simply say "too bad, ignore the obvious setups and sally forth with life sentences for everybody" you'd end up with a failed state. 2) Nope, you already agreed that criminals have no problem obtaining guns through smuggling or shop fabrication.
