Or does he need congress approval ? the President has the power to set aside and suspend the Constitution during times of national emergency (ie. martial law, etc.) but the President does not have the power to change the Constitution in any way. changing the Constitution (adding or taking away amendments) is a long and arduous process: first with all kind of actions by both houses of the U.S. Congress, and then the change has to be ratified by 7/8 of all the individual States (maybe just 3/4), and that is by the Senate and the House of Reps. in each of the States. For example, while we have the right to free speech, we have limitations upon that right. You are correct. The limitation on the 2nd Ammendment is that you can't just go and gun down the masses. That being said, the INDIVIDUAL would be tried in a court, NOT everyone who respectfully upheld the ammendment. Same with 1st Ammendment. Those who would willfully slander someone would be tried in court, not EVERYONE who chooses to use their 1st Ammendment rights.
