Santa and his elf are still in jail. Hopefully getting out soon.

From what I am hearing they are going for a Class B, essentially saying it cost them more than 50 bucks to clean the chalk. My whole water bill for a month is about 50 dollars.

Criminal Mischief Penalties in Texas

The penalties for an Austin criminal mischief offense are found in Chapter 12 of the Texas Penal Code and are classified as either a misdemeanor or felony and will generally vary depending upon the circumstances off the offense and value of the property damaged or destroyed or the financial loss suffered.

Criminal Mischief Class C Misdemeanor: The amount of the financial loss is less than $50 or causes substantial inconvenience. The penalty faced is a fine of up to $500.00.

Criminal Mischief Class B Misdemeanor: The amount of the financial loss ranges from $50 to $500. The penalty faced is up to 180 days in jail and/or up to a $2,000 fine.

Chalking the sidewalk should be legal. It counts as "posting bills", and is less permanent.

Why not a simple ticket & fine, and no arrest? Graffiti I could see arresting for criminal mischief since it damages property, but chalk washes off.

Maybe he had no ID on him which might require an arrest to determine who to write the ticket to. Otherwise he could lie about his identity.

Of course there is cause for this!
