They splattered the descriptions of his old truck, and the marine hair-cut he had all over the Media.

Unfortunately, that points a finger directly at a very big "broken" aspect of our judicial system. Our judges are no longer able to judge. We have laws, yes, but our system is so overwhelmed with cases, that rather than let a Judge judge, there are now precedants that define the outcome of a case. It's VERY rare these days to see a Judge even have the time and ability to truly look at each case individually and judge. Our courts are too overcrowded with non-violent cases, BS lawsuits, etc. It's far too easy and WAY less time consuming to sentence based on precedent, rather than look into the facts of every case at hand. Add in "Mandatories" for everyone, and you now have folks serving time (hard, long time) for something that in their case may have had minimal impact in the overall situation, but, it's now mandatory. I watched a gentleman on The Daily Show a while back bring up a PRIME example. A woman in Florida was being attacked by a male (can't remember if it was a husband, boyfriend or stranger...). She was in possession of a handgun and fired a warning shot (proper first shot) into the air. It was stated that in Florida, there is a mandatory minimum of 40 years for discharging a firearm in public (could be wrong about exactness, I live in CO), so she is now serving 40 years for defending herself. If she had shot him and killed him, she'd be out in about 14... "Mandatories" only "streamline" the effectiveness to put people behind bars rather than spend time looking into a case, and does not allow the judge to determine if the sentence even fits said case...
