i am looking at the DISC of Assassins creed ii and it says on the disc:

RESALE AND RENTAL ARE PROHIBITED unless authorised by scree

it says this in print above the title.

RESALE AND RENTAL are terms for business. There is nothing thats says, do not share for free. And that is what 'piracy' sites do, no RESALE AND RENTAL, just FREE SHARING.

Again First Sale Doctorine has been proven to trump such "claims" by the manufacturer. This is how Redbox got started. The movie industry wouldn't sell them DVD's, so Netflix said screw you then, we'll go buy them from the store and rent those, if you don't like it try and stop us. The MPAA did try and stop them and the court said tough shit, once someone buys something it's theirs to do with as they please so long as it doesn't violate basic copyright laws. And letting someone else use your disc while you do not have access to it does not constitute copyright violation.

Oh and a dump truck can't put a sign on the back that says "Not responsible for cracked windshields" and be totally immune to any claims. All vehicles are responsible for securing their cargo before getting on public roads.

I'm in the music biz. This technology has been around for a very long time, it was first used for promotional copies of very early promos so you were less inclined to share/leak them with your friends/the world. It's only used by major labels for this, it still currently is.

It's also used to identify songs(shazam), as well as identify songs say if... If you upload a mix you made to soundcloud and it contains songs that the artist doesn't want shared online... Soundcloud Will then replying to you saying "the file you uploaded contains a footprint of a audio file owned by blah blah"

In very few cases would they sit and examine files in your library to check for ownership.

When I am given promotional material it embeds my personal information on the file so if they are seeing a leaked copy of material that's not yet out they can tell who leaked it... Then we lose our job :)

Hope that clears some things up for people who were curious
