Justice Clarence Thomas made the point that the right to bear arms was critical to newly freed slaves during Reconstruction and that the 14th Amendment guaranteed that state law could not trump federal law in such matters, that federal citizenship trumped state citizenship. Immediately following emancipation, southern states, controlled wholly by Democrats had sought to pass a multitude of state laws to prevent blacks from acquiring firearms and, thus, the ability to protect themselves.

Not ironically, it is again the Democrat Party standing at the ready to disarm the citizenry. The KKK mobs, the white supremacist mobs that terrorize blacks back then will simply be replaced by the New Black Panthers and labor union mobs of today.

The sad thing is blacks will not see they are getting played. They are too angry and will not see their available choices. They have a choice, to turn down rap, affirmative action., and the lies. But they fall right into the plan, and don't flourish. They will consistently do everything they are not supposed to do ( not all blacks of course) like vote for Obama even though they don't really know why.. And be angry towards whites even though blacks sold them as slaves as well, and give in to popular black media/ culture ., that hurts them ... It's a shame

The linked article is full of noble sounding phrases but is incorrect. The Bill of Rights were not handed to Americans on tablets from some old bearded White man calling himself God. Madison's bill of rights were adopted by actions of the people to amend the Constitution. By becoming a part of the Constitution, those Rights cemented themselves into the foundation of government. So YES the government does grant those rights. But since in the final analysis the Government is the people; don't sweat the small stuff.

The Bill of Rights are certainly subject to negotiation via judicial review. As Justice Holmes pointed out the 1st Amendment does not protect the speech of someone who fraudulently cries "Fire!" in a crowded theatre. And here lately the SCOTUS has granted a federal right to own a gun to those who are not a part of a well ordered militia. If that is not a renegotiation of the 2nd Amendment I would not know what is.

I am hardly an enemy of America but the OP might inadvertently be one since he/she has obviously not done his/her homeworker. Jefferson weeps.

Just in case no one has brought this up, those are not all of your rights. You have lots more. Those are just the ones the framers thougt the government and the idiot masses might try to infringe upon. That is why they enumerated those ones in particular. Yes licensing is an infringement. Rights don't cost you anything, you can't be charged by the government to exercise them. Travel is a right as well. In the customary way, that would be in a private car while driving it. Don't let them bullshit you into thinking they can infringe on your rights for your protection.

Listen no one is making me take out my adopted Rights in Amendment of the U.S. Constitution, just to scratch out freedoms, and put in zero freedom.

Its stashed away, where no one can change them. The paper doth not Rot nor Rust,nor is it in a warehouse, but has become an erected Fort of Freedom, hanging out in the Mind's Eye.

You come to my house / mansion, without a inkling of paperwork to substantiate my consent, and you will put the fear of Life in my mind, as you try to break down my door mafia style.

Government can't "grant" fundamental inherent rights. If you claim govt can, then you are also saying govt can take them away. They cannot do this. Fundamental rights aren't given by man made institutions. People already possess them.


The BOR aren't subject to judicial review or worse negotiation. If you yell fire in a crowded theatre and there is no fire,a crime has been committed. But the crime isn't the exercise of the 1st amendment.

SCOTUS did not "grant" the individual right in the Heller
decision. They recognized it as an existing inherent human right.

In the final analysis the government is separate from the American people. It exists of,by and for itself. It has its own agenda and its own priorities.

Occasionally the interests coincide but not usually.
