Public Safety exception dates from 1980. It requires an imminent threat BUT the term "imminent threat" has been more broadly defined in terrorism cases (it's very narrowly defined in standard criminal cases).

From what I've read they are planning to try him in civilian court - so his trial will probably be similar to what we saw w/ the Times Square Bomber (also US citizen).

They did not Mirandize the Times Square bomber for a day (arrested Monday, Mirandized Tuesday). DOJ didn't disclose lack of Miranda warnings until after the fact. They are pre-announcing that they will not be Mirandizing the Chechen kid.

Based upon my understanding of the situation, and being a simple mortal, not a lawyer. They did not Mirandize him because they were not able to ask him any questions anyway and his state of consciousness may not have been at the level where he could have understood his rights nor would he have been able to acknowledge his understanding of them. Also, I'm sure they have enough evidence to convict him on a number of other charges already that will send him away for ever. They may also consider him an enemy combatant no matter how the prosecution progresses.
Due to a shot in the neck, they inserted a trach almost immediately after pulling him out of the boat where he was bleeding to death. Since a trach is placed below the voice box he would not have been able to speak. Yup, they could also claim the exception to cover their butts, however that doesn't mean they needed it. As you stated "the term "imminent threat" has been more broadly defined in terrorism cases"...this is a terrorism case, so imminent has become a somewhat nebulous term, which was my point.
I have learned 2 things, never argue with a lawyer and never argue with a woman...so as I have been taught over the years by multiple women...yes dear, you're right, I'm sorry...I'll be in the garage.

Thread: Back from West, TX and I asked around.

This is what we're hearing, on the other side of the state, too. The family that owns the Ford dealership in my town has alot of family in West. They also own a dealership in West. Annette Sykora is from West and all of her family is still there, including her son.

I read another thread somewhere today about the possibility of arson as a cover-up for theft. Something to watch for. NONE of these plants have ANY kind of security.

I know. It's really started, hasn't it? It seems like the labor pains have gotten closer to the final stage. Everyone I know, family included, are having worse troubles every day. It seems like all I do anymore is talk and talk to people to try and calm them down. It's getting harder to do, too. Did you ever watch the movie The Birds? That's what I feel like sometimes. Stuff coming at me from all directions, just like those darned birds.

Well let's just try to put things in perspective, it may seem like the sky is falling, just cuz we have problems, all we can do is go one day at a time and one problem at a time.
