Wtf is America coming to? I live in SC and bought a tao tao 50 moped because I lost my lisence. This moped is well within the law at .49cc and 1.8 bhp. The title has all this on it and says motorscooter.

A cop pulled me over going to work and said I was going 45mph (on a upwards inclined road) which is impossible for this scooter. So this is a motorcycle not a moped. And he was towing it right away. He then asked me how to get the trunk and seat open and I told him I didnt consent to a search. He told me he didnt need my permission because he was taking inventory. So after his search (yes he searched good) he called a wrecker and charged me with DUS, Driving without insurance on a motorcycle, and failure to register a motorcyle.

Now I have a valid moped lisence and a moped tag. You dont need insurance on a moped in SC, but he said none of it matters because its not a moped.

Now heres the problem. Dispite the title and all paperwork saying its a .49cc motorscooter the metal plate says motorcycle. Which I dont understand. Thats what he is using. He never saw the title and he never charged me with why he pulled me over..which was allegedly speeding.
Can anyone help me as to where I go with this? I have a pic of the title and my lisence but cant post it.

haha..yeah i have little 50cc scooter...its not considered a motorcycle here in florida but it does have a "motorcycle" license plate.

i agree you could not have been going 45mph...the fastest i was able to get mine to do..downhill, with the wind at my back..was 43mph

just because the paperwork states whatever you said it stated, there are in fact ways to remove the governor off of the motor to achieve speeds in excess of the 35 MPH you are allowed to be moving on a motor bike on the roads without a motorcycle license.

Call a lawyer. He falsified information which lead to the traffic stop, he again did this to seize the vehicle. Also his search is an invasion of privacy now. Honestly not shit is going to happen, at most you will get the charges dropped and end up getting harassed by every cop in town. The cop is just going to have to issue you an apology if even that. Now a days US cops are allowed to do what the fuck ever they want and nobody is going to stop them.

my advice OP is to talk to a lawyer, and research your moped model extensively. find out things like max speed compared to weight load, incline speeds, specs of anything possible. as long as you can get the point across that there's no possible way that moped, on an incline, could get you going 45MPH then you should be good to go.
