Photographer Carlos Miller and his companion were viciously attacked by security guards while taking pictures at Miami-Dade Metrorail on Sunday night, and they captured most of the incident on film.

The pair were idly passing time waiting for a train home by taking shots of the Dade County Courthouse, a looming piece of architecture visible from the train platform. Suddenly, as if out of some some dystopian movie, a voice boomed over the loudspeaker ordering them to stop taking photographs.

When the pair ignored the order, a 50 State security guard emerged on to the platform to confront them.

Miller, who runs the popular website Photography Is Not A Crime, immediately recognized his rights were once again being trampled on, and began filming the exchange on his camera.

The security guard is seen on camera telling Miller that it is illegal to photograph the rail portion of the train, which is not true.

After a short exchange, Miller was accused of being drunk and another two guards approached and began to crowd Miller toward the escalator. A fracas then ensued, during which the camera Miller’s friend was using was knocked out of his hand and turned off.

“At the top of the escalator, one of them shoved me hard as if to push me down the escalator, which is when I shoved back.” Miller wrote on his website.

“Then three of them piled on top of me, including one choking me where I could’t even breathe, leaving me gasping for air.”

Miller notes that the third guard, the tall black man, whose badge read R. Myers “…violently choked me to the point where I thought I was going to die.

The pair were held for an hour, then released with a $100 citation accusing them of “producing loud or excessive noise”. Neither of the men was cited for anything to do with intoxication or photography. Indeed, the guards returned both cameras to the men without tampering with them.

The Cops are paranoid that someone is collecting information on them.

So when they see anybody taking picture they will go harass them. It dont matter what reason your talking pictures.

Here in the UK you are allowed to film at train stations for non-commercial reasons but MUST inform the station manager beforehand of your intentions, which is fair enough imo as it stops incidents like this happening.

If the manager tells you to scram, simply move onto public land instead.

While they may have been a bit beligerent . There was absolutely no reason to arrest them, they had no right to even question them. They were not suspected of commiting any crime . No probable cause. If anything security was harrasing them. Evrything they did was perfectly within their rights.

They were filming. Nothing wrong with that. The guards were looking for the fight.

The police state already exists. If it did not this would not have happenned. It is great that these camera men got a chance to show it to the unbelievers and naysayers.

The guy wanted to get on the train. He did not assault anyone. He committed no crime.

I wish they would have had several friends as backup, and were willing to slap cuffs on the guards. They could have then got on the train and gone home without further trouble.

If nothing else they should have been arrested for public intoxication, that's probably one of the reasons they were causing trouble...just because there isn't a specific law for it doesn't mean it's ok to act like a terrorist plotting sabotage to a train...

Your basic right is actually pretty simple: if you're in a public place and you can see it, you can shoot it. This means as long as you're in a public location you can legally take almost any picture. However, if you're using a telephoto lens, parabolic microphone, or hidden camera to get a shot of a private property when you're standing on public property you might have an issue if someone on that property has an expectation of privacy. So, what constitutes a public place? Most places are obvious, a park, a street, a soccer field—these are unquestionably legal places to take pictures of anything happening. But what about all those Instagram photos of food you've taken inside a business? That's a little different.
Generally if a private property is open to the public (like a restaurant, retail store, tourist areas, etc) you are allowed to take photographs and video unless it is expressly posted somewhere on the premise that you can't. In most cases it's okay to assume you're allowed to take pictures and video in a shop that doesn't expressly forbid it. However, if a property owner (or store employee) tells you to stop, you have to stop. More importantly, use good judgement and assess the situation and environment before snapping pictures.

This also goes for citizen journalism. If you see an accident you want to record, public servant misconduct, or even TSA checkpoints, you can do so as long as you're not interfering with police or medical operations. As far as the Department of Justice is concerned you're also allowed to shoot video or still shots of police officers provided they're on public land. Videotaping police officers is still a tricky situation without a concrete ruling, but the courts have leaned toward protecting your right to film officers. Photo by Christopher.
