Bob Rae and Thomas Mulcair, the leaders of Canada's two political parties in opposition to the Harper Conservatives, are in negotiations now with Chief Spence, trying to convince her to end her 42-day fast now.

They are working out the language of a declaration to be signed, perhaps as early as tomorrow, Jan. 24, in which the New Democrats and the Liberals would commit to a joint resolution in Parliament regarding the current crisis in the handling of First Nations affairs, including treaty rights and environmental concerns.

PM Stephen Harper would not meet with Spence personally in the past six weeks.

But the Prime Minister recently released a photograph of his greeting two winners of a French-language reality show in his office.

Further update this afternoon - best reporting is on CTV, rather than the CBC (goes without saying). The CBC online report actually published what they admit is a DRAFT DECLARATION, which may or may not resemble the final version in key points, and which really should not have been published.

But who cares about ethics or accuracy, CBC?

Yahoo News reported earlier that a delegation of community members from Attawapiskat was coming tonight to see Chief Spence to tell her to quit the hunger strike, or be removed as Chief.

A lie. Thank you, too, Yahoo News.

No one actually knows at this point what will happen with Chief Spence Thursday morning. Negotiations are ongoing.

Dear Mr. Johnston,

It was a pleasure te be received by you and guests at the Great House January 11,
2013. I write this letter to stress the importance of the position that you hold in relation to the original treaties made with First Nations and the Crown and it is imperative that yourself and the Prime Minister be present at a meeting of all First Nation Chiefs, to discuss concerns and renew the relationship with First Nations in Canada.

This was requested and explained to you face to face by Chiefs and hunger strikers with honor, spirit and respect and the special value your position means to First Nations People.

I would like to go home with my family as would the other hunger strikers, but feel we cannot. As requested I urge you to Contact the Prime Minister to establish a meeting with all First Nation leaders and thus end our hunger strike.

There are immediate needs that our people require and that have been set out in prior Auditor Generai Reports relating to access to housing. Infrastructure provided through AANDC has been capped and funding agreements for housing operations underfunded; all of which are a necessity before developing subdivision housing.

In addition AANDC controls the number of housing units available to First Nations followed by the need for a Ministerial Guarantee to approve CMHC mortgages. Chronic underfunding through AANDC has caused deficits that many First Nations face.

Set out beiow are other issues that need to be discussed with you and the Prime
Minister of Canada:

1. Frameworks and mandates for the implementation and enforcement of Treaties
between Treaty parties Nation-to-Nation.

2. Reforming comprehensive claims policy based on inherent rights.

3. Resource sharing requiring the involvement of Provinces that currently reap all
the royalties from Resource Development in our Traditional Lands.

4. A review of legislation C-38 and to ensure it is consistent with S35 of the
Canadian Constitution.

5. A revised Fiscal relationship that is fair and sustainable removing arbitrary caps
and inciudes indexing.

6. A National Pubiic Commission of enquiry on Violence against Indigenous Women
and Girls.

7. Equity in Capital construction of First Nation schools with funding parity with
Provinciai funding formulas.

8. A change in how government currently operates that should include direct
oversight, a dedicated Cabinet Committee and Secretariat within the Privy
Council Office with specific responsibility for the First Nation-Crown relationship
to ensure implementation.

From the outset our objective as hunger strikers was to achieve a meeting with
you as Governor General, the Prime Minister and Chiefs for the purpose of tabling
issues.

It was never our intent to meet with you, the Prime Minister and Chiefs as Hunger
strikers.

With the utmost respect to you, I again urge you to Contact the Prime Minister for a
meeting with all First Nation Chiefs and yourself that allows the tabiing of these issues.

Thank you for your letter of January 15. I was very pleased to welcome you to Rideau Hall last Friday for a ceremonial event that served to reinforce the important place of First Nations people in Canada. We were honoured that so many chiefs, elders and their immediate advisors could gather together in such a setting and speak to the narratives on which trust is founded.

I want to thank you for bringing to my attention the eight public policy issues that you
believe must be seriously addressed. As you may be aware in our system of constitutional monarchy, the governor-general acts on the advice of Canadian ministers; the matters you raise are their direct responsibility, and I have therefore brought your letter to the attention of the Government.

As I mentioned in my remarks last Friday night. I will be visiting many First Nations
communities over the coming year in order to focus on two pillars of my theme of a Smart and Caring Nation, which I underlined in my installation speech: nurturing family and children, with a special emphasis on mental health, and reinforcing learning and innovation. My wife and I hope to see first-hand places where the most influential positive work is being done in these two areas—such as pioneering schools and clinics serving First Nations communities. We want to shed a positive spotlight on them and to tell these inspiring stories across the country.

I hope you will be soon be reunited. in good health, with your children and
grandchildren.

Your Excellency:

Thank you for your letter of January 18, 2013, delivered by hand, which is response to my letter of January 15, 2013, and makes reference to the event at Rideau Hall on January 11, 2013.

My letter of January 15, 2013, presents eight issues which are fundamental constitutional issues and concerns of First Nations peoples across Canada and which are related to the Treaties and to the Treaty relationship. Respectfully, by referring in your letter to these eight matters as “public policy issues”, these matters are not properly given appropriate deference.

I brought matters of urgent concern to your attention on January 11, 2013 and previously, regarding the failure and breaches on the part of the Government of Canada in respect of the implementation ofthe Treaties according their spirit and intent. Your office maintains and exercises a direct role and duty in respect of addressing these concerns. It continues to fall on your office to uphold the Honor ofthe Crown and to provide your opinion and advice to the Prime Minister and to Her Majesty's Privy Council.

It remains the duty of your office, as Her Majesty's representative in Canada, to maintain watch and to ensure the faithful perfomance of the terms of the Treaty entered into between the Crown and the First Nations in Canada .

In accordance with the constitution and with the Letters Parent Constituting the office of Governor of Canada and Commander in Chief of Canada, your office also holds certain reserve powers which may be invoked where it is your opinion there is an intolerable violation of the spirit and intent othe constitution over an extended period of time, and where there is no doubt as to the righteousness and constitutionality of the actions of your office.

Moreover, Your Excellency must advert to assertions of intolerable violations of the
spirit and intent of the constitution and to respond to such assertions.

In addition to the concerns I have brought to your attention, several urgent requests were directed to the attention of your office that you exercise these reserve powers and to refuse a grant of Royal Assent to Bill C-45. The reasons for these requests to exercise this power included that the process by which Bill proceeded as an "omnibus" budget bill, despite the uniform opposition by all Members of Parliament in opposition to Government. This is an intolerable violation of the spirit and intent ofthe constitution and of Canada‘s democratic and parliamentary traditions.

The process by which the Government of Canada proceeded with Bill C-45 also violated the spirit and intent of the Treaties and the Crown's duty to consult and accommodate First Nations.

For the sake of our youth, our families, our communities, Mother Earth, and for the sake of a peaceful and safe Canadian Nation which honors the terms and reflects the true spirit and intent of the Treaties and the Treaty relationship, I again urge you, as Her Majesty's personal representative in Canada and in accordance with your constitutional obligations and duty as Governor General of Canada, to uphold the Honor of the Crown. I also urge you to express your opinion to the Prime Minister and Her Majesty's Privy Council regarding the matters that I and other First Nation leaders have brought to your attention.

I again request and urge you to meet with the Prime Minister and the First Nation
leadership on January 24, 2013, in the same room, at the same time, to engage in these important discussions

the $94M received to support the Attawapiskat First Nation over that past six
years from Aboriginal Affairs does not remain or circulate in our community. The
majority of these funds go to support the greater economy of Northern Ontario
and Canada for goods, materials, services, contractors, legal advice and auditing
services to mention a few, which in turn support urban northern communities
such as Timmins, Sudbury, Sault Ste Marie, Thunder Bay, North Bay, Toronto,
Kenora and Winnipeg to name a few. The majority of these firms are non
Aboriginal tax-payers.
