Wonder if they have heard of 4 WHEEL DRIVE! BLEEPING EAST COAST TARDS! So private plow drivers can not go out and plow hospital parking lots etc. I would go out and go sleding ,ice fishing, snow shoeing and let them try to stop you! It is your CONSTITUTIONAL RIGHT. They will say you are putting emergency response people in danger but nobody said they had to rescue you! You go out that is your choice but told you will be arrested if you do, is martial law and communistic! We are due to get a foot of snow in MN. Sunday. They better not try that shit here!

Re: pin...illegal to drive in massachusetts because of snow
It's an illegal law.

LAW OF THE LAND

The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The U.S. Constitution is the supreme law of the land, and any statute, to be valid, must be in agreement. It is impossible for a law which violates the Constitution to be valid. This is succinctly stated as follows:

"All laws which are repugnant to the Constitution are null and void. "
Marbury vs Madison, 5 US (2 Cranch) 137, 174, 176, (1803)

"Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them quot;
Miranda vs Arizona, 384 US 436 p. 491.

"An unconstitutional act is not law; it confers no right; it imposes no duties; affords no protection; it creates no office; it is in legal contemplation, as inoperative as though it had never been passed."
Norton vs Shelby County118 US 425 p.442

"The general rule is that an unconstitutional statute, though having the form and the name of law, is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of its enactment, and not merely from the date of the decision so branding it.

No one is bound to obey an unconstitutional law and no courts are bound to enforce it."
16th American Jurisprudence 2d, Section 177
late 2nd, Section 256

Remember, There is no such crime as “resisting arrest" when the supposed arrest is unlawful. This is a fictitious crime dreamed up by law enforcement to accuse a citizen of a crime when they refuse to surrender to the illegal demands of the police.

U.S. courts have ruled on numerous occasions that resisting a false arrest is not merely a citizen’s right, but his duty! In fact, courts have gone so far as to rule that if a law enforcement officer is killed as a result of actions stemming from a citizen’s attempts to defend themselves against a false arrest, it is the fault of the officer, not the citizen.

Here’s a short collection of relevant court rulings on false arrest and resisting arrest:

“When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justified.” Runyan v. State, 57 Ind. 80; Miller v. State, 74 Ind. 1.

“These principles apply as well to an officer attempting to make an arrest, who abuses his authority and transcends the bounds thereof by the use of unnecessary force and violence, as they do to a private individual who unlawfully uses such force and violence.” Jones v. State, 26 Tex. App. I; Beaverts v. State, 4 Tex. App. 1 75; Skidmore v. State, 43 Tex. 93, 903.

“An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.” (State v. Robinson, 145 ME. 77, 72 ATL. 260).

“Each person has the right to resist an unlawful arrest. In such a case, the person attempting the arrest stands in the position of a wrongdoer and may be resisted by the use of force, as in self- defense.” (State v. Mobley, 240 N.C. 476, 83 S.E. 2d 100).

Do individuals have the right to come to the aid of another citizens being falsely arrested? You bet they do. As another court case ruled:

“One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910).

And on the issue of actually killing an arresting officer in self defense:

“Citizens may resist unlawful arrest to the point of taking an arresting officer’s life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529.

I live here. For only 1 1/2 mind you. It's literally the worst state ever. People are stupid, egotistical and proud to be "massholes" ...they're too stupid to figure out its actually an insult.

That being said. I have no desire to drive in this shit. It's snowing really bad and it is extremly unsafe. I don't agree that it should be illegal and that people should just use common sense.. Sadly nobody in this hell hole has common sense and that's why it has been ordered. The governor knows how fucking dumb every single person who grew up here is and needs to help the workers do their jobs.

Now, I agree it seems like it is a dry run. Why was the governor on TV with an Air Force general or commander standing next to him? Is because the Air Force is causing this weather? Fuck this place I can't wait to get a new job and move the hell out of here.
 Quoting: Anonymous Coward 24728295

BTW - I like the "1 1/2 mind you". You acknowledge you have no clue to what is the truth.

In order for you to know it's the worst state ever you would have to live in all. Loser.
 Quoting: Anonymous Coward 560401

Not really. You only need to be here for a month to know this place sucks. The amount of time I'm here means nothing. This POS state is stuck in the 80's and so is every "losah" that lives here. I'm pretty sure my post is very accurate, wouldn't you agree?

Hey you guys, this happened in '78 martial law, no one on the roads period. It really helps. I was there is '78. More than 100 people died in that storm. So many of them were stuck... yup - on the roads! The rescue crews couldn't reach them. They died.

Just chill. They really don't want deaths again. It doesn't look like mutch, but believe me, it becomes so strong no one can keep up with it.

Just chill with a glass of wine, beer, soda pop, family friends.

Back then we lived one block from a supermarket and liquor store. Two days after the storm the liquor store was sold out.The grocery store sold out of bread and eggs! People walked every where. It was quiet and nice.

Be safe and enjoy it!

So true!!!

Not everyone has common sense and people do go out and drive..if it weren't for those people then a ban wouldn't be in effect.

If it snows as much as they are saying then drifts will cover cars easily. I sure wouldn't want to be stuck in my car during that.

why are so many fucking people saying blah blah blah its not a big deal because they want you to be safe? you think the governor wants us to be SAFE? and thats why this was ordered? why now? vehicles are safer than they ever were before and are better in all weather. snow is a normal part of life here, we deal with it non stop for half of the year. this is an UNPRECEDENTED (except for the blizzard of 78 which was not ordered preemptively and was much worse conditions) driving ban. it is the first time in my lifetime living in massachusetts that i have been told that i basically MUST remain in my home (although there are many laws that restrict your movement after dark around here, thats for sure)
This is GLP, and nothing like this has ever happened around here, and although the weather is bad now its no worse than anything we've dealt with every year multiple times a year.

if this is to become the norm...its just one step closer to total control.

AND ALL THESE GODDAMN RETARDS ON RETARD FACEBOOK WONT STOP BITCHING ABOUT IT ITS JUST SNOW LIKE WE ALWAYS GET WTF THERE HAVE BEEN FEET AND FEET OF SNOW ACCUMULATED ON THE GROUND BEFORE THIS IS NOTHING THAT UNUSUAL

I am a Boston MA resident.

I agree that people should NOT be out.

But it's VERY WHACK that the state is going to punish you with 1 year incarceration if you're outside.

It's supposed to be a free country.

The state should GIVE WARNINGS and ASK that people remain inside.

But they SHOULD NOT PUNISH PEOPLE FOR THEIR RIGHT TO TRANSPORTATION.

Please share this on FaceBook, Twitter, and anywhere else you can.

Just a clarification, I've been driving in Massachusetts for like 10 years and have seen many snowstorms.

I've also witnessed tons of "State of Emergencies" due to the inclement weather / snowstorms.

Make no mistake: this is the first time this state has EVER threatened to arrest / incarcerate someone for being on the road.

It's going a little too far.

There's not many good reasons for people being on the road in these conditions; but if they want to, it's within their rights to do so.

Like I said on another thread
"I feel the state should have just told everyone "travel at your own risk. If you get stuck or you're in a wreck, you're fucked. We will not put other peoples lives and safety at risk to help your stupid ass, you are on your own." Plain and simple, anyone who is driving out in this weather in a vehicle not equipped to handle it is a fucking retard and deserves what happens to them."

I agree. The main variable of consideration is whether or not the state should threaten to incarcerate people for 1 year and fine them?

Wouldn't a declaration of state of emergency & a plead to stay off the road been enough?

Just provoking discussion, no hard feelings.
