“We also conclude that imposing a requirement that officers have reasonable suspicion in order to conduct a border search of an electronic device would be operationally harmful without concomitant civil rights/civil liberties benefits,” the executive summary said.

I think you may not understand the situtation.

The rules do not apply to only those who are crossing the border. The rules apply to those already in the United States who are located within 100miles of the US border.

Ex. You live in Fresno, CA (or any other city in the US within 100 miles of an international boundary line: you can see if you live in a constitution free zone here [link to www.aclu.org] ) and are pulled over. The agents now have the authority to seize your electronics and download all the data from them without a warrant or even suspicion. Think stop-and-frisk but for your electronic devices.

The .gov considers areas within 100 miles of the international boundary line to be border areas. As I mentioned in a previous post, those living as far north as Fresno, CA are affected. There is a map of the US in the OP that shows all the areas affected by this (click the ACLU link). Border no longer means Tijuana/San Diego area, etc.

There's no commercially available encryption DHS can't decrypt. Most security software comes with back-doors for this very reason, so access is easy for "authorities". The only way to be somewhat safe is a custom decryption methods, but even that is time limited on being pulled out.
