The system that you paid into from work is called Social Security Disability Insurance or SSDI. And you are correct if you paid in for ten years you will receive payment. This is nothing like SSI and the processes should be different I would think. In other words you could have been denied due to the fact that you qualify for SSDI. Check into SSDI instead. you can start a claim online, which is good cause that will be the date they use to determine back payments. |

If you did indeed apply for SSDI and not SSI and it was SSDI that turned you down, get yourself an attorney. People think it is not worth paying an attorney, but it is. You need to know that rarely does one get approval the first time. You may have to pay an attorney up to $5000.00, but it is only paid if you are awarded SSDI and it is taken from the retroactive allotment you get, not out of your pocket. Things is you will get approved at some point if you get an attorney. And I should say, my husband is one who recently got SSDI for a mental illness. Please don't tell me my husband who is forty years old and worked for 22 years of his life should not get SSDI. He can in no way return to work even though he wants to do so. I am living this nightmare right along with him. It took 20 months to get the SSDI, with a law firm that specializes in this process. The amount of SSDI depends on your income and how much social security you have paid in over the years you worked. If you have any dependant chidren, they are eligible for dependents benefits. However, you have to account for how every nickel of the child's benefits was spent. Dependent's also get retroactive payments. |

Both saying that I would be able to return work in a shorter than 12 months. Some of the bone actually was broken off so my ankle can never actually heal so eventually I'm going to need another surgery where they literally fuse my bones together and I will have no motion in my ankle anymore. So essentially me walking is like a fuse on a bomb. I had my doctor even fill out some form stating all of this out and it did not matter. I'll try to start looking for an attorney this Monday |
