Bloomberg seems to think he can rule by decree, screw the voters, apparently he is king of New York. Under his decree, I guess it's still illegal to grow, buy or sell MJ, but it's legal to possess it. Not sure how you can possess it without doing one of those other things. What about the people already in jail for possession? |

Quoting: Mordier L'eft Mayor Bloomberg, who previously stood with New York Governor Andrew Cuomo in his call for fixing New York’s marijuana laws, reiterated that support, but said his city won’t wait for Albany on this issue. But we know that there’s more we can do to keep New Yorkers, particularly young men, from ending up with a criminal record. Commissioner Kelly and I support Governor Cuomo’s proposal to make possession of small amounts of marijuana a violation, rather than a misdemeanor and we’ll work to help him pass it this year. But we won’t wait for that to happen. Right now, those arrested for possessing small amounts of marijuana are often held in custody overnight. We’re changing that. Effective next month, anyone presenting an ID and clearing a warrant check will be released directly from the precinct with a desk appearance ticket to return to court. That people will still go to jail for marijuana possession? The quote you provided does not speak of anyone being sent to jail for simple possession and subsequently having to post bail to be released. Being taken to the precinct to have a background check run and a court summons issued is not 'going to jail'. Additionally, having to appear in court on a summons does not guarantee you will get sentenced will jail time. The title of the link you're providing is labeled 'Starting Next Month No Jail For Marijuana Possession'. If the mayor is proclaiming 'no jail time' for marijuana possession and he is true to his word, than he would also be addressing the statutory 'sentencing guidelines' for the offense - which is administered by the judge when you appear in court. In your original reply your statement went from a definitive 'they are still being locked up' to 'probably still being locked up' and "doesn't mean you're not going to jail necessarily'. That paints two different pictures to a person exercising reading comprehension. That's not really important though. In most areas the laws will not suddenly change overnight. It's often necessary that there is a slow transition into a more lax approach to enforcement which will help pave the way to more rational & sensible policy with regards to marijuana possession (ultimately decriminalization & legalization). There are surrounding cities/areas that are ahead of NYC with this measure and have already moved to make simple possession a ticketable offense.
