Anonymous Coward (OP) User ID: 1750328 United States 03/04/2013 09:10 PM Report Abusive Post Report Copyright Violation | Lets clear some of this shit up I did get my car back, it got impounded Saturday when i got arrested for being 'under the influence' and could not get it out til today since there closed on the weekends. 2 1/2 days equals 700$ on top of the other fines. Stupid? yes lol I was not high so where does that place me? sober. The violation i committed just this morning i seen 10 other cars do. Could i film the intersection i got pulled over at to show how many people do it? Well i know i can but would that help? And the reason i skipped the first lane when turning RIGHT on a GREEN light is because the LEFT turn i would make after is literally right there less than a few hundred feet away from the turn i made. I consented to the cop because i thought being honest and cooperative that i would get some slack. Nope not at all. I blew a 0.00 in the breathalyzer because i do not like drinking. So they took my pee to get it analyzed. Yes its going to come back dirty, but can they say i was high when i got pulled over? Because i wasn't. I told em i smoked 2 hits when i woke a few hours before driving. I can smoke bowl after bowl after bowl and still be able to function normal right after smoking. Im not saying im not the one to blame because i did put myself in the situation but im getting charged with a DUII when i was not under the influence shit that would be another 1500 on top of the 1700 i already got to pay. AND AND AND the pipe taken from my car i had not smoked any weed through it ever, i only used that one for spice. So they have my 2 grams of great medical shit and a pipe with no weed residue at all. How can they pin me with being under the influence when i indeed was not? I did fail the outside sobriety tests but they did the sobriety tests on me again at the jail which i believe i did fine. This isn't about me not taking responsibility for my actions for i was honest with the cop, this is about them pinning me with shit that i didnt even do. I am going to fight this, i got til the 29th to figure this shit out. I need some advice for this is my first DUI charge and if i do get a DUI i want to for sure be under the influence when it happens. I not going to say much about my drug uses but i am young and smart, just got my associates degree. I smoked everyday before my classes cuz i get a little social anxiety which a few hits of weed calms me down and lets me talk right. So those of you saying to drop the weed and grow up, i grew up when i was 16 and probably blow most of you's away with my deep thinking. I have my own TOE (theory of everything) which i figured out before i was 21. I love astronomy, psychology, philosophy and everything in between. I might be 23 but my mentality is way up there. I don't do drugs to escape reality, i did when i was younger but now i use them for meditation and purposes of the sort. Im not stupid come on y'all |

You can drive unlawfully but if you have drugs in the car you will get arrested. Thinking that you can drive a certain way because you see others do it is a bad idea. I was a passenger and the worthless cunt driver wasn't using her turn signals. I mentioned it to the twat and and said she never uses them. Next thing I know she is pulled over but all the cops care about is me because I'm male. |

Some try to get them at the first of the month and some wait til the end but they all get them filled. Drivers make it really easy. I know a cop that fills out his quota of tickets before every shift and just puts in the drivers name at the stop. |

I do this all the time and see lots of people do it. Bam pulled over. I get nervous when i get pulled over so my hands were shaking a little cop thought i was under the influence of something gave me a sobriety test. I Failed somehow and he searched my car finding my weed stash which had less than 3 grams. Quoting: you know who 1750328 I get arrested because of that and possible dui. I passed the doctors test at the jail but still got slammed with two tickets. one for the traffic violation 300$. the other for possesion of weed 1000$. My car got towed so all in all i owe 1500$. wtf? I dont sell (never did) , i dont steal, dont do anything i would consider bad especially in the eyes of the law. Why must good people get in trouble for something so small and have to pay big? I mean if i sold drugs i would understand but no.. What you guys think? You could have kept that down to the tow bill if you knew your rights. You had the right to refuse that breathalyser. You had the right to refuse your car being searched. The $1300 in violation fines you owe because you are ignorant of your own rights. In Arkansas, you lose your drivers license if you refuse the breathalizer. |

The probable cause was his nervousness. But he could have refused everything and they would have had to get a judge to issue a search warrant for the car, usually that's the case but states are different. If it was like 2am in the morning would the officers want to wake the Judge up for a marijuana suspect. Wrong. they would have brought in a dog to do an external scent check and odds are her would have signaled. That would be their probable cause to search. no judge needed. |

You are misinformed. A moving violation is not a "crime." It's an infraction. The only probable cause is plain sight. The cop had no legal justification to search. |

Once he failed the sobriety test he is now in custody, thus the police have every right to search the vehicle where he had immediate access to. If weed was found in trunk, would be thrown out in court due to bad search but if it was found in glove box or center console that area is in his control, good search. |
