I read your story and i shudder........ a few years back i had an epidural in my neck and long story short I was leaking spinal fluid and had a horrible headache. They told me that the dr had trouble with it and the headache was normal. I ended up in ICU 3 days later for a week. I also felt bad suing and didn't believe in it but it took a long time to recover. The doctor was gone from that group within a month of the incident and I found out later there was a problem with that doctor and other patients. But I still didn't want to sue and I should have. look at it from another way - that doctor/facility would learn to be more cautious. Who's to say other people haven't been harmed too? You sound like you are legitimately suffering, so go for it and I hope you get better soon.

Did they do this under diagnostic imaging? Usually when they go through vertebre they do so under guidance of X-ray, so they can see where the needle needs to be.

Definitely consult with an attorney. You were a ginni pig to them. Sounds like you have some nerve damage. My prayers to you that the nerves heal (they always take longer than muscle to heal), and that you recover. Attorney for advice!

I'm a medical professional.

Are you saying that the whole past year you have had constant pain? Starting with the LP?

Why did you have the LP in the first place?

What kind of back pain did you have before the procedure?

What were the results of the LP?

An LP is a simple procedure, to drain spinal fluid. It would not cause bone deformities or clunking.

It would be very difficult to link an LP performed a year ago to the current symptoms you are experiencing. There are very few risk factors related to LPs. Even if nerve damage occurred, it heals rather quickly

You may need different types of diagnostic testing to see if there is something else going on - slipped disk, nerve impingement, etc.

But the first thing you need is a copy of your medical records. Find another physician to treat your current back pain. You will need the support of a new physician to pursue legal recourse if you believe the LP is responsible for you current problems.

Hello, I'm wondering if anyone on GLP has any experience with medical practice and could help me...

A year ago I had a lumbar puncture perform on myself, before the procedure went ahead the Doctor asked me if I wouldn't mind allowing a student to take part it this, I was assure that she would be under full supervision and that she knew what she was doing... I was also told that if there was any problems then she would take over... I agreed as every one deserve a chance to learn... I was laying down when the procedure was done the doctor allowed the student 5 attempts to do the LP before she stepped in while the student was doing the procedure the I could here the doctor saying and I quote

Nope thats the tendon, No you don't want to go in that direction thats bone, No you don't want go there you have gone to far up, and no thats the wrong angle...

then the doctor took over and had 7 attempts at it herself...

I would understand the difficulty if I was of large build as I know it is a blind procedure and I appreciate that its not as easy as it sounds but I am of quite a slim build and I remain very still and didn't complain at all...

the procedure took 80 minutes... when they finally obtain the fluid they needed they dropped the dressing they were meant to apply to my back... the doctor thankfully went of to get a new one but she said she could find the right type so she stuck a dressing around 6 x 6 inch the dressing was plaster type... I was laid there with out a dressing for a period of 3 - 5 minutes...

It wasn't until I sat up that I was told to stay laid down as soon as I sat up and went to move of the bed I just fell back didn't lose conciousness how ever I did spin out...

I was laying down for 3 hours before being discharged as the couldn't find any bleed...

A head ache occurred within 7 hours and I couldn't stand or move at all for that matter when I even held in going to the toilet until the next day, due to the shear amount of pain I was in, now I can barely do what I used to be able to do I used to be out ward bound and the only work I'm qualified to do is security and building work that means I have to go back to college to gain a qualification to work in a different trade as I cannot do the physical work I used to I am more depressed and I now go to the toilet more as a result from the lumbar puncture I'm always in pain I'm at my ends witt with the pain now...

I don't hold the student responsible as the doctor in m opinion was meant to stop her after 2 or 3 attempts and the fact that the doctor her self is meant to be able to complete the procedure in less then 7 attempts I am now considering seeking legal advice against the NHS due to the change to my life and my personality I lost my job and I have became more depressed from this as I said its a year on and I'm still experiencing back pain to a very noticeable extent and I have had a head ache every day for a year, my spine makes a clicking and a thudding sound when I stand up which makes my legs go week and I collapse to the floor most of the time It also makes me sleepy when my spine aches... is there anything I can do to help the pain now ??

LP's are performed to take a sample of spinal fluid for testing. Usually to diagnose things like meningitis. Your symptoms could be from your illness, which even after several people asking, you have not revealed.

The needle used for an LP is a very small diameter and it does not need to be performed under imaging. The intention of the procedure IS to puncture the dura (the covering of the spinal column) in order to obtain cerebral spinal fluid. It may take several attempts to find a space to enter through, but the needle is not removed and reinserted, it is simply redirected in small increments near the spine.

It is not surgery of the spine.

Touching the bone during the procedure USUALLY happens and is NOT a complication and does not cause injury.

Your initial headache probably WAS from the procedure. It would NOT last until a year later.

You really need to be evaluated by a neurologist to determine the cause of the problem. I'm afraid you may be putting treatment off because you believe the problem started with the LP. My concern is that it started with whatever you were originally trying to get diagnosed.

After evaluation by a doctor, you can make the decision to sue or not. At least you will have an accurate diagnosis. (Hopefully).

OP, I've successfully sued the NHS for negligence.

It's very difficult because they put up all sorts of obstacles - overtly and covertly.

Anyway, some tips:

- you have 3 years from date of procedure that caused the problems (usually) to begin a legal action

- start voice recording (secret recordings are admissible in evidence) EVERY conversation you have with a doctor from now (and even phone calls with doctor's staff/receptionists - good reason for this)

- spend c.£200 on a consultation with a private specialist and get a written report. Do NOT tell your NHS doctors about this. Do not tell the specialist that you might be taking legal action.

- keep clear notes on everything to do with your condition - a daily journal of its effects even, keep notes on everything doctors say to you, ask your wife to keep notes too

- ask for ALL your medical records including copies of all scans you've ever had. It will cost. They will ask why (although they shouldn't). Do not say anything but that you're just interested. The Xray dept's admin person's first question will be 'Is this for a legal action?' - you say no.

- keep all this activity as low key as possible.

- do not rely on second opinions from other NHS doctors. They will invariably back up their negligent colleagues.Yes, we're into mafia territory now...

- do not tell your GP about your legal action. But consult him/her about your continuing pain and disability.Make sure your medical problems are documented in GP records.

- find an excellent firm of clin neg solicitors. Word of mouth from other patients who've sued NHS is good, also call AvMA [link to www.avma.org.uk] for their advice on best firms.

- prepare to spend every spare moment collecting evidence for the solicitors as they prep your case for court - and for having your whole life examined and turned inside out. The NHS does all it can to stop people suing them. But it's very possible.

- You won't get a huge sum in damages - nothing near US settlements. Refuse to accept the usual gagging clause that the NHS tries to impose. It is unlawful in the UK. But they still try and silence you by fair means or foul.

...I just thought, I could write a book on suing the NHS! I never ever dreamed that I'd sue anyone ever in my life. But the NHS's dirty tricks were just so appalling that there was no option. Maybe I should write a book. Maybe more people should be taking them to court. Maybe the service would improve and they'd stop covering up all their mistakes.

And now the NHS tech goons will now be trying to trace my IP and location. Seriously. What I learnt throughout my experiences is that the NHS is way, way off-track, it's not a nice, caring, patient-centered organisation. I am so sad about this.

In fact the British Medical Association had this to say about NHS culture the other day

OP this exact thing happened to me, your headache will disappear if you lay head down on an incline, it will simply disappear and will return when you are upright, it may stay this way for a week.
You will have to do this until its no longer needed, I dont think the so-called patch procedure will help much unless you get it free.

Why is the first fucking response always to sue the doctor?? I'm really sick of that mentality. If it's a teaching facility, you probably signed a statement of understanding that students/residents would be involved with your care. You have the right not to have trainees assist in your care. If you elected only the physician, and students worked on you, that is battery and you probably have a cause of action. If you made no such election, time to move along with your life. Just sayin.

Get saved, water baptized and then let believers lay hands on you to heal you. My daughter was healed of a botched ceasarean operation last year and the only thing that worked was praying to God. nothing dealing with the physical is guaranteed, youre not perfect, and your doctors arent perfect.

You can sue if you want to, the chances are that the lawyer on average will get at least twice as much money as you do.
Of course, you'll take it, since you know you dont deserve any of it at all.
Just so you know, the standard deal is 30% PLUS expenses which is everything includint the hourly rate of everyone in the office including every waking minute of the lawyer which can legally exceed the hours in a day

Hey OP, I had a lp 7 years ago and my back still is not 100%.

It's mostly ok though.

I had the headache for over a month and I went 9 days with absolutely no sleep and hallucinated because of the lp.

I was told "It's a more extreme reaction than most people have, but well within documented norms."

With all respect OP, please don't assume that you know the law. Whatever evidence your wife can give will be perfectly admissible in your case. Let your lawyers advise you. They want to win as much as you do. They'll only take on your case if they can win it.

Also, there are NOT 'so many people who con the system'.
That's a meme put about by the media working on behalf of the gvt/NHS etc to make people with valid complaints doubt themselves and feel bad about suing so that they won't.

Good grief! This is a conspiracy site! You should maybe read some more of the copious posts on how we're manipulated by TPTB!!

If you've got the evidence of negligence then there's no way you're conning anyone.

Of course the NHS and its lawyers will 'frown' on you, that's their job!
What you'll find if you win is that the majority of people you know will be congratulatory and admire that you;ve had the balls to sort it and win. They will also take you more seriously and be more helpful re your disabilities.(speaking from very hard won experience.)

What's age got to do with it? 6 month old babies sue the NHS (through their parents)...

What 'standard deal' are you talking about? The two lawyers who won my case billed £360 and £270 per hour respectively - and actually did far, far more work than they billed for. Nothing else was added but a moderate 'success fee', which is standard.

When you win the case, the defendant (the negligent doctor/NHS) has to pay all the legal costs, theirs and yours.

All fees are regulated by the Law Commission. Every penny has to be accounted for and can be challenged at any time.

ive had a LP for menengitus which i fully recovered.
They should have kept you in for 24 hours, they let you out so they could deny liability when you prossecute.
You could try going to the police and ask them to press charges for "Criminal Negligence" if they refuse goto your magistrates court and apply to prossecute them from there.
If that Fails or they refuse, go speak with Your MP.
If all above fail go talk to a newspaper or Sky, dont goto the BBC they will ask to see your balls.

I feel your pain. I had a brain haemorrhage a few years ago.
To cut a long story short, run of the mill NHS hospitals don't have the equipment to always locate a bleed to the brain. Lumbar punctures and CT scans don't always pick up the bleed.
You need a specialist brain hospital. Only they can fully check your brain.
I don't fully know your situation but due to how dangerous this is you need fully checked ASAP encase of a bleed or clot.

Thank you its been a year on wards now... I would like to think that I would have known about bleed or clot by now although my head still feels its been hit by a rock...

My GP isn't prepared to refer me yet until I complete Physio and a lot of the time scale I have had is due to NHS waiting periods

If you get a good solicitor, not one from tv preferably, but a local one that specialises in medical negligence claims, they will arrange specialist appointments for you, you don't have to do it yourself. They have medical experts that prepare reports for you. Also they won't take any of your compensation, that is paid by the hospital where the procedure was performed. They also pay your fees.These cases rarely get to court, and will be settled out of court. I recommend you do this asap, and try to relax, sorry to hear about your experience, and good luck!

I read your story and i shudder........ a few years back i had an epidural in my neck and long story short I was leaking spinal fluid and had a horrible headache. They told me that the dr had trouble with it and the headache was normal. I ended up in ICU 3 days later for a week. I also felt bad suing and didn't believe in it but it took a long time to recover. The doctor was gone from that group within a month of the incident and I found out later there was a problem with that doctor and other patients. But I still didn't want to sue and I should have. look at it from another way - that doctor/facility would learn to be more cautious. Who's to say other people haven't been harmed too? You sound like you are legitimately suffering, so go for it and I hope you get better soon.

Did they do this under diagnostic imaging? Usually when they go through vertebre they do so under guidance of X-ray, so they can see where the needle needs to be.

Definitely consult with an attorney. You were a ginni pig to them. Sounds like you have some nerve damage. My prayers to you that the nerves heal (they always take longer than muscle to heal), and that you recover. Attorney for advice!

Nope I was laying down on a bed in the ward there was no other device involved other then the needle for local anesthetic and the needle they used for my spine it was a weird one It was right angled I think that was the tap one its the one that was going in to my back 12 times...
