This is because his announced plan of breaking the law of the District of Columbia involves planning by use of interstate telecommunications and the crossing of state lines, thus it becomes a Federal action for prosecution purposes. This guy is going to a Federal Penitentiary and will likely serve a lengthy sentence due to the Federal Sentencing Guidelines. The fact that D.C. is not a "State" is of no consequence. Leaving Virginia, or Maryland is.
