If it occurs in nature it can not be patented, if synthetic it is patentable.

Anyone interested? This is important for the future, and for lowering costs of testing.

What this means: you can't control your own dna. Anyone can use it.

No what it means is that a company can not own your dna like they were trying to.

A company had patented the "breast cancer" gene because they found it. So the charge for the test screening was over thousands of dollars instead of the hundred or so dollars normal screening tests run.

You own your DNA, companies do not, now that is law.

Well, it was a win-win for them. Now you don't own your own dna, so they can just use it.

It is great getting your perspective on this ruling, it adds food for thought.

Yours was up first so think it should be the main one.

And my view of this case: it was a catch-22 case. No matter who won, we lose.

One side we can't protect our DNA (they can collect, slightly change, and patent, still, but more than that, we can't claim exclusive rights to our own DNA), the other side, people would claim your DNA before you did (like web squatters) making you under their control. What needs to be done is protection, one which recognizes the real problems, not cases which will give win away from us.

True this ruling does not give us the protections we need, but it keeps companies and others from staking a claim.

Something is terribly wrong with this. The decision meets the lowest threshold of common sense. Everyone knows when that happens, something is off.

Thanks for the information. Corporations had applied for patents on about 20% of human DNA along with patents on DNA occurring in nature in an attempt to stifle the use of natural remedies.
