ARTICLE 3

STATE GRAND JURY



7‑5‑301. Petition for impaneling; determination by district judge.



If the attorney general or the governor deems it to be in the public interest to convene a grand jury which shall have jurisdiction extending beyond the boundaries of any single county, he may petition the judge of any district court for an order in accordance with the provisions of W.S. 7‑5‑301 through 7‑5‑309. The district judge may, for good cause shown, order the impaneling of a state grand jury which shall have statewide jurisdiction. In making his determination as to the need for impaneling a state grand jury, the judge shall require a showing that the matter cannot be effectively handled by a county grand jury impaneled pursuant to W.S. 7‑5‑101 through 7‑5‑209.



7‑5‑302. Powers and duties; applicable law; procedural rules.



A state grand jury shall have the same powers and duties and shall function in the same manner as a county grand jury, except for the provisions of W.S. 7‑5‑202(b)(ii), and except that its jurisdiction shall extend throughout the state. The law applicable to county grand juries shall apply to state grand juries except when the law is inconsistent with the provisions of W.S. 7‑5‑301 through 7‑5‑309. The supreme court may promulgate any rules it deems necessary to govern the procedures of state grand juries.



7‑5‑303. Selection and term of members.



The clerk of the district court in each county of the state, upon receipt of an order of the district judge of the court granting a petition to impanel a state grand jury, shall prepare a list of fifteen (15) prospective state grand jurors drawn from existing jury lists of the county. The list so prepared shall be immediately sent to the clerk of the court granting the petition to impanel the state grand jury. The district judge granting the order shall impanel the state grand jury from the lists compiled by the clerks of court. The judge preparing the final list from which the grand jurors will be chosen need not include the names of jurors from every county within the state having due regard for the expense and inconvenience of travel. A state grand jury shall be composed of twelve (12) persons, but not more than one‑half (1/2) of the members of the state grand jury shall be residents of any one (1) county. The members of the state grand jury shall be selected by the court in the same manner as jurors of county grand juries and shall serve for one (1) year following selection unless discharged sooner by the district judge.



7‑5‑304. Summoning of jurors.



Jurors shall be summoned and selected in the same manner as jurors of county grand juries.



7‑5‑305. Judicial supervision.



Judicial supervision of the state grand jury shall be maintained by the district judge who issued the order impaneling the grand jury, and all indictments, reports and other formal returns of any kind made by the grand jury shall be returned to that judge.



7‑5‑306. Presentation of evidence.



The presentation of the evidence shall be made to the state grand jury by the attorney general or his designee. In the event the office of the attorney general is under investigation, the presentation of evidence shall be made to the state grand jury by an attorney appointed by the Wyoming supreme court.



7‑5‑307. Return of indictment; designation of venue; consolidation of indictments.



Any indictment by the state grand jury shall be returned to the district judge without any designation of venue. Thereupon, the judge shall, by order, designate the county of venue for the purpose of trial. The judge may order the consolidation of an indictment returned by a county grand jury with an indictment returned by a state grand jury and fix venue for trial.



7‑5‑308. Investigative powers; secrecy of proceedings.



(a) In addition to its powers of indictment, a statewide grand jury impaneled under W.S. 7‑5‑301 through 7‑5‑309 may, at the request of the attorney general, cause an investigation to be made into the extent of organized criminal activity within the state and return a report to the attorney general.



(b) Disclosure of matters occurring before the grand jury, other than its deliberations and the vote of any juror, may be made to the attorney general and to any district attorney for use in the performance of their duties. Those officials may disclose so much of the grand jury's proceedings to law enforcement agencies as they deem essential to the public interest and effective law enforcement.



(c) Except as provided in subsection (b) of this section, a juror, attorney, interpreter, stenographer, operator of a recording device or any typist who transcribes recorded testimony may disclose matters occurring before the grand jury only when so directed by the court preliminarily to or in connection with a judicial proceeding or when permitted by the court at the request of the defendant upon a showing that a particularized need exists for a motion to dismiss the indictment because of matters occurring before the grand jury.



(d) No obligation of secrecy may be imposed upon any person except in accordance with this section. The court may direct that an indictment shall be kept secret until the defendant is in custody or has given bail, and in that event, the clerk shall seal the indictment and no person shall disclose the finding of the indictment except when necessary for the issuance and execution of a warrant or summons.



7‑5‑309. Costs and expenses.



The costs and expenses incurred in impaneling a state grand jury and in the performance of its functions and duties shall be paid by the state out of funds appropriated to the attorney general for that purpose.

Grand Jury Functions
Grand Jury functions

Historically, grand juries have performed two functions. They decided whether someone should be charged--"indicted"--for committing a crime. They also investigated criminal activity and the conduct of public affairs. Before the American Revolution, colonial grand juries essentially ran local government, supervising everything from road-building and bridge maintenance to the operation of local jails. Over the years, they lost much of their public affairs function, as the operation of local government was taken over by administrative agencies, an institution that did not exist in colonial times.
Indicting:Grand juries hear evidence presented by a prosecutor and decide whether it creates probable cause to believe that specific persons have committed crimes. Prosecutors usually submit a statement of proposed charges known as an "indictment" to a grand jury. The prosecutor leaves the jurors alone and they decide if the evidence gives them probable cause to believe the people named in the indictment are guilty of the crimes it charges them with. If a majority of the jurors vote for the indictment, it is "returned" and initiates a criminal case against the people it names as defendants.
All but two states and the District of Columbia use grand juries to indict. Twenty-three states (Alabama, Alaska, Delaware, Florida, Kentucky, Louisiana, Maine, Massachusetts, Minnesota, Mississippi, Missouri, New Hampshire, New Jersey, New York, North Carolina, North Dakota, Ohio, Rhode Island, South Carolina, Tennessee, Texas, Virginia and West Virginia) plus the District of Columbia require that indictments be used to charge certain crimes. These states tend to follow federal practice, requiring that indictments be used to charge serious crimes and allowing other charging instruments, such as informations and complaints, to be used to bring charges for minor felonies and misdemeanors. Informations and complaints are like indictments in that they charge particular persons with committing crimes, but unlike indictments, they are initiated by a prosecutor acting without the assistance of a grand jury.
Twenty-five states (Arizona, Arkansas, California, Colorado, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Maryland, Michigan, Montana, Nebraska, Nevada, New Mexico, Oklahoma, Oregon, South Dakota, Utah, Vermont, Washington, Wisconsin and Wyoming) make the use of indictments optional. Most of them let prosecutors use either an indictment or an information to charge any offense.
Connecticut and Pennsylvania have abolished the use of grand juries to return indictments, but kept the investigating grand jury. Both used a constitutional amendment approved by the electorate to abolish the indicting grand jury. Connecticut replaced the grand jury's determination of probable cause with a hearing before a judge. Pennsylvania's amendment gave each county court the option of using informations, instead of indictments, to bring charges. All of the courts chose that option and ended the use of the indicting grand jury in Pennsylvania.
Investigating:As noted earlier, grand juries traditionally investigated both criminal activity and the conduct of public affairs. State grand juries still retain these functions, although not every state gives its grand jury both functions.
(1)Investigating criminal activity
At the federal level, grand juries can, and do, investigate criminal activity, especially organized crime. They do not, however, initiate their own investigations. Perhaps because federal criminal law tends to be very complicated, federal grand juries are simply the instrument federal prosecutors use to conduct their own investigations of possible crimes. Grand juries give prosecutors the ability to subpoena witnesses, who have to testify under oath, and to subpoena the production of evidence.
Grand juries in every state plus the District of Columbia can investigate criminal activity. This is even true in Connecticut and Pennsylvania, which eliminated the indicting grand jury. In so doing, Connecticut also abolished the use of "civilian" grand juries; instead of being composed of ordinary citizens, its investigating grand jury is made up of between one and three judges. Pennsylvania still convenes grand juries composed of ordinary citizens.
State investigating grand juries can be divided into three categories. In some states, including Arizona, Florida, Louisiana, Minnesota, Missouri, Montana, and North Carolina, grand juries are limited to investigating criminal activity that is brought to their attention by a prosecutor or by a court. Grand juries in other states, including Alabama, Alaska, Arkansas, California, Idaho, Indiana, Iowa, Kentucky, Nebraska, Nevada, North Dakota, Ohio, Oklahoma, Oregon, South Dakota, Tennessee, Texas, Virginia and West Virginia, can investigate any activity that appears to violate the criminal law of their state as long as the activity in question occurs within their venue, which is usually the county in which the grand jury sits. The third category is composed of state grand juries that investigate certain kinds of criminal activity, which often involves drug crimes or organized crime. These grand juries, which are known as "special grand juries," "statewide grand juries," "state grand juries" or "multicounty grand juries," usually sit in addition to the more conventional grand juries that are usually convened in these states.
(2).Investigating non-criminal activity
Federal grand juries lost their ability to investigate non-criminal activity and report on what they found. Using federal grand juries to investigate civil matters declined in the nineteenth century and was abolished when the Federal Rules of Criminal Procedure were adopted in 1946.
State grand juries still have this ability. The most common civil matter they investigate is the operation and condition of local jails and other confinement facilities. Alaska, Arizona, Arkansas, California, Georgia, Idaho, Iowa, Illinois, Louisiana, Maryland, Minnesota, Missouri, Mississippi, Nebraska, North Carolina, Nevada, New Mexico, North Dakota, Ohio, Oklahoma, Oregon, South Dakota, Tennessee and Wyoming either require that grand juries investigate these institutions or permit them to do so.
Grand juries in Alabama, Arkansas, California, Minnesota, Missouri, North Dakota, Nevada, New York, Oklahoma and Tennessee investigate the conduct, and potential misconduct, of county officers and employees. Grand juries in some states, including Arkansas, Florida, Georgia, Kansas, Kentucky, Tennessee and Texas, monitor the conduct of elections and bring criminal charges against those whom they believe committed improprieties.
Some states give their grand juries various specific tasks. Alabama grand juries, for example must investigate the county pension list to determine if anyone is receiving pension who is not entitled to it. California grand juries must scrutinize transfers of land which "might or should escheat to the State of California", and must also investigate certain kinds of non-profit corporations. Georgia grand juries must approve any proposed change in a county's boundaries, as well as set the yearly compensation paid to probate court judges, court clerks and bailiffs. Tennessee grand juries are charged with investigating any failure to comply with state rules that require rabies vaccinations for cats and dogs, while Pennsylvania grand juries must approve proposals to erect statutes honoring military veterans. Other states, such as Alaska and Nevada, simply instruct their grand juries to "investigate and make recommendations concerning the public welfare or safety."

BAGHDAD, Iraq - A Jordanian extremist suspected of bloody suicide attacks in Iraq was killed some time ago in U.S. bombing and a letter outlining plans for fomenting sectarian war is a forgery, a statement allegedly from an insurgent group west of the capital said.

Abu Musab al-Zarqawi was killed in the Sulaimaniyah mountains of northern Iraq “during the American bombing there,” according to a statement circulated in Fallujah this week and signed by the “Leadership of the Allahu Akbar Mujahedeen.”

There was no way to verify the authenticity of the statement, one of many leaflets put out by a variety of groups taking part in the anti-U.S. resistance.

The statement did not say when al-Zarqawi was supposedly killed, but U.S. jets bombed strongholds of the extremist Ansar al-Islam in the north last April as Saddam Hussein’s regime was collapsing.

It said al-Zarqawi was unable to escape the bombing because of his artificial leg.

Before the Iraq conflict began last March, U.S. Secretary of State Colin Powell said al-Zarqawi received hospital treatment in Baghdad after fleeing Afghanistan. U.S. intelligence sources said he apparently was fitted with an artificial leg.

The statement said the “fabricated al-Zarqawi memo” has been used by the U.S.-run coalition “to back up their theory of a civil war” in Iraq.

In February, the U.S.-led coalition in Iraq made public an intercepted letter it said was written by al-Zarqawi to al-Qaida leaders, detailing a strategy of spectacular attacks to derail the planned June 30 handover of power to the Iraqis. U.S. officials say al-Zarqawi may have been involved in some of the series of suicide bombings this year in Iraq.

“The truth is, al-Qaida is not present in Iraq,” the Mujahedeen statement said. Though many Arabs entered the country to fight U.S. troops, only a small number remain, the group said.

A little over a year ago, Jordanian authorities named al-Zarqawi as the mastermind behind the October 2002 murder of Laurence Foley, a 60-year-old administrator of U.S. aid programs in Jordan.

In a German court last year, Shadi Abdellah, a Palestinian on trial for allegedly plotting to attack Berlin’s Jewish Museum and a Jewish-owned disco, testified he was working for al-Zarqawi. He said they met in Afghanistan.

German authorities have reportedly said they believe al-Zarqawi was appointed by al-Qaida’s leadership to arrange attacks in Europe.

Moroccan government sources said a group blamed for bombings last May that killed 45 people in Casablanca got its orders from al-Zarqawi. In Turkey, officials said he was believed to have played a role in bombings that killed 63 at two synagogues, the British consulate and a British bank in Istanbul in November.

A prominent official in the Afghan Taleban movement announced yesterday the death of Osama bin Laden, the chief of al-Qa'da organization, stating that binLaden suffered serious complications in the lungs and died a natural and quiet death. The official, who asked to remain anonymous, stated to The Observer of Pakistan that he had himself attended the funeral of bin Laden and saw his face prior to burial in Tora Bora 10 days ago. He mentioned that 30 of al-Qa'da fighters attended the burial as well as members of his family and some friends from the Taleban. In the farewell ceremony to his final rest guns were fired in the air. The official stated that it is difficult to pinpoint the burial location of bin Laden because according to the Wahhabi tradition no mark is left by the grave. He stressed that it is unlikely that the American forces would ever uncover any traces of bin Laden.

You see, every time Bush's lying ass is backed into a corner, he trots out these two DEAD guys as a distraction, as a way to ramp up the hatred by blaming them for the false flag ops carried out by himself, the Brits, and the Mossad, and as a means to try to garner support for his PHONY 'war on terror'.

BushCo is very good at forging documents and tapes, it's their MO. Karl Rove is, himself, a LIAR and Master Forger that Bush uses to "catapult the propaganda.".
