Children are not mature enough to give consent to financial contracts or marriage for obvious reasons. The idea that a child could "consent" to having sex with an adult is ludicrous. They can't "consent" to forced child labor, either. That is why we have laws against it. I am guessing those laws will be under attack next since the corporations need more cheap labor within the states, and someone can say "other cultures do it" for an excuse. We'll surely hit bottom soon with all this reversion to the primitive (primate) ways. Look for a celebrity to marry and breed with a monkey soon.

I'll repeat.. there are sex offenders in the legal & law enforcement system of most countries.

Some of these sex offenders are child killers.

Interestingly, the mother remarried shortly after she divorced Elizondo in 2007. She could have had the step-father adopt.

The pleadings state that he started having visitation in 2012 supervised by either his adult daughter or adult son. The visitation became unsupervised in early 2013. Additionally, she had accused him of using drugs, he passed a drug test, at which time she was to reimburse him for the costs of the test which she has not done. So, were her accusations considered perjorative by the court and did it affect the court's perception of her credibility? Perhaps. Additionally she has recently been approved for social security disability. One wonders about the nature of her disability, perhaps she has a mental health diagnosis or a seriously physically debilitating condition that precludes her from being able to effectively care for the child.

As some posters here have said we were not there, did not hear the testimony and don't have all the facts. However, the mother has the option of appealing the judge's decision to a higher court who could then reverse the lower court's decision and return custody to the mother. The case is not necessarily over.

I am rather surprised given the facts regarding both parents and those relatives didn't refile their petition for guardianship and request custody of the little girl.

That OP article is poorly written.

It says he took a plea deal, but was he actually CONVICTED of the rape or did he plead to a lesser offense? It would seem to me that rape should have landed him in prison a lot longer.

The child he is getting custody of now is not the victim, though the article seems to go out of the way to not make that clear.

The article also goes on to mix in a story of another sex offender victimizing the daughter in the custody dispute.

So in other words, the mother got pregnant by a man on trial for raping his daughter. That mother then fails to protect her child from a brother who must have attacked her while the father was in prison.

I dunno, something stinks about this story. I think it's a propaganda piece.

I have no idea what any of this means. I'm trying to gauge support for a legal, lawful political movement. Looks like nobody cares about children, which I find to be very sad and quite bleak for the future. But, at least I exposed the idea. Maybe it will grow.

So, some visitations were supervised by the daughter he was accused of molesting? Because as we know, it's not this current 6 year old he's accused of molesting, but his first daughter. And visitation rights under the supervision also of the brother - the brother that touched her.

Ok, then we find the first daughter retracted her accusations (but still somehow he was found guilty of *something*, enough to get him 6 years). So, maybe he did molest her or maybe not now, since her retraction.

In the information you provided below on some of the allegations the mother is charged with, they sorta pale in comparison with molesting ones own daughter, though good to note nonetheless for assessments sake. I'm sure we all know that there *are* substances available at head shops to help one bypass a drug test. Just a random thought.

Why is the daughter who first claimed abuse then retracted a viable candidate for visitation supervision? That's questionable as hell right there. As well as the brother accused of touching Sarah. Unless there are other siblings I missed, this really smells.
