A 5 year and 10 year felony are actually served the same length of time. Also, when mulitple counts are added on a conviction 90% of the time they run concurrent (meaning that no extra time is served for each since they are all served at the same time). The only difference between a 5 yr sentence and a 20 year sentence is that most states have a mandatory minimum statute for violent crimes or potentially violent crimes (like attempted rape or going armed with intent) meaning that a certain percentage of time must be served before parole can be granted on a 20 yr sentence. You can be parolled on a 5 and 20 yr sentence in the same amount of time (12-18 months) as long as there is no mandatory minimum guideline on the 20 yr sentence. This is why many violent crimes are committed by the same people over and over again. Because they are let go in 1-2 years of thier original sentence. There are also many instances of people serving life, being granted furloughs and actually killing people outside of prison while serving their time. A contract killer wrote a book 15 years ago about how many people he killed on the outside while he was using his time inside as an alibi. He was given furlougs to leave the prison on weekends which he used to kill his own lawyer and other witnesses against him...then returned to prison on Sunday night. california has to free 8% of its prison population by the end of the year ...thats just under 10,000 ...i can only speculate other states will do the same they need to. Non violent crimes like weed possession are a humbug. California lost a lawsuit initiated by the Fed Gov't because of overpopulated prisons. What stood in the way? Prison guard unions. The unions wanted the overtime thus they lobbied for overcrowding and lobbied against transferring lifers to other states. |
