Quoting: Sir Phydeau I didn't watch the pretrial stuff and I can't attest to anything that was decided there. Honestly, I feel that THC in the system is much ado about nothing, honestly. Especially weed. I mean, c'mon, this is 2013, not 1940. We all know that "Reefer Madness" was propaganda hype and marijuana is mostly harmless and does NOT turn someone into a crazed maniac. As for the blood being drawn, well, rigor mortis had done it's thing by the time the autopsy was performed. A few hours had passed at that point. I'm not saying it's a big deal, I'm just wondering why it's not allowed in. And if it really was "much ado about nothing," I don't see why the prosecution would have a problem with it coming in. Although it's nothing to you, it doesn't mean it would be the same to the jury. If they're going to bring up George's past of wanting to be a police officer, his class work, etc., I don't see why they can't bring in Trayvon's hobbies including recreational use of marijuana. From what I read, if the body isn't moved for a period of time, blood begins to pool (often in the lower part of the body), and then clots. For clarity, I'm not siding with the state, just going to relate what my understanding of the matter is with as little bias as I can muster. Zimmerman's past is admissible because it goes to the state's theory that he is a "gung ho wannabe cop looking to hunt thugs for personal pleasure" and "he knew the system well enough to manipulate it to save himself from prosecution". So, that data does go to the state's case they're trying to make. Whereas Martin being a thug or not is not a part of the defense's theory. Ultimately, by the standards of law, it's irrelevant and it's probative value does not outweigh the prejudicial impact of such information. That said, I also agree that it should be presented to the jury and for them to be allowed to decide for themselves. I think things should be more like Switzerland where any and all evidence is permitted to be thrown into the mix. But that's just my own opinion. I know toxicology is VERY important to show Trayvons state of mind. Obviously, the Jury needs to know if Trayvon was high, drunk or on other drugs. The toxicology report is in the court, they have it. But the prosecution and Judge insist it is not important. Which is BS because we know a persons state of mind is critical in this type if trial. If Trayvon was under the influence of marijuana is important. Marijuana can cause paranoia, thus leading to illogical choices. And why was Trayvon on the other side of the neighborhood when 7-11 is to the right of his home. tray was found casing homes to the far upper left from his home. He HAD to walk past his house, in the rain, to get where he was. Not typical of someone who is trying to avoid being rained on. Z is innocent in my mind no matter the courts ruling. My opinion they are not allowing TM toxicology, is because it will go against this choir boy persona, that the media purposely created, to cause a divide. State was ridiculously forced to press charges, judge has been bias the entire time against GZ. Allowing anything in that shows TM was under the influence, or a troubled kid, will not be admissible. He racially profiled GZ, and not a word about that is said. Hypocrisy, once again. |

It is such a joke. Further reasoning for my belief that this is a manufactured media event for an agenda that I always mention. Quoting: Ms. Superduper I'm actually dreading it. I'm afraid that by watching the obvious work up to a 'not guilty', he'll still be found guilty and that niggling possibility is starting to effect me emotionally. I agree with this. There's no doubt in my mind that he's innocent. |
