The Obama administration has won the latest battle in their fight to indefinitely detain US citizens and foreigners suspected of being affiliated with terrorists under the National Defense Authorization Act of 2012.

Congress granted the president the authority to arrest and hold individuals accused of terrorism without due process under the NDAA, but Mr. Obama said in an accompanying signing statement that he will not abuse these privileges to keep American citizens imprisoned indefinitely. These assurances, however, were not enough to keep a group of journalists and human rights activists from filing a federal lawsuit last year, which contested the constitutionality of Section 1021, the particular provision that provides for such broad power.

A federal judge sided with the plaintiffs originally by granting an injunction against Section 1021, prompting the Obama administration to request an appeal last year. On Wednesday this week, an appeals court in New York ruled in favor of the government and once again allowed the White House to legally indefinitely detain persons that fit in the category of enemy combatants or merely provide them with support.

This is another one those *facepalm read the actual opinion* for me. Occupational hazard I suppose.

They vacated the permanent injunction based on lack of standing. They didn't say it was ok for the feds to permanently detain American citizens. What they said is that before you can raise the question, you have to actually be harmed in fact by the law. So the first person who actually gets detained under the NDAA can run straight back to federal court and from the tone of the opinion that judge at least would probably grant them relief.

So Obama did not "win" any "right". The court just told a few specific plaintiffs that they're not going to get to invalidate the law ahead of its actual enforcement.

Obama can't "win" a right of this nature because nobody in the legal system has a source of authority giving them the power to grant such a right.

These are just a bunch of hoodlums in suits patting one another on the back.

The same sort of shenanigans was practised by Lincoln in the 1800's, during the civil war period. He offered a bounty of $20 in gold for anyone who would turn in a fellow American who did not support the Civil War. One pastor was jailed not because he opposed the war but merely because he did not actively support the war from his pulpit, but remained silent.

After the war ended, these "powers" were rescinded and declared illegal and abhorrent by the Supreme Court. One Justice, Marshall, wrote a tome spelling out this history in detail. It is called The American Bastille.

A friend of mine has a first edition of this and I've had the opportunity to peruse it. Powerful stuff. Highly recommended. Perhaps there is an EBook version of it out there. The original can sometimes be found, but it's expensive.
