People hear something about surveillance and assume it's the same story they've heard about for weeks and tune it out. In reality, we're not far from a police state. My husband recently fought a traffic camera ticket in court. The judge threw it out immediately because he knew the city didn't really have a case against him. They make money hand over fist because people usually don't bother to fight it and conduct surveillance at the same time. Win-win for the city and the public gets screwed...as usual. I don't know where you get your delusions, laser brain. |

Remember way back, when we all had to replace our home cordless phones to the "new Digital Frequency's" that were up in the 2.4 GHz range?? They told us that the old ones were interfering...and they said that people with police scanners could listen to our conversations?? that was just the beginning of the wholesale conversion to Digital for our society.... what is the difference?? well.. remember how frustrating it was to find the beginning/end of a song on a cassette music tape? remember that? the spies used to have that problem also.... no more with everything being digital. also....imaging how much easier it is now to go back and listen to everyone's communications now that everything is digital. imagine how much data can fit on one CD sized storage device... All these changes have made it easier to spy on us us as a society... Big Brother is Here.... How are we going to stop him? |

Not to say this is not disturbing. I have done alot of research on this issue as I had a client who was tracked by his cell. It appears that most of the Courts are split and it has not gone to the U.S. Supreme Court. I am in the 1st Circuit, and when I challenged it, the Government decided not to use the records at trial so there was no need to go forward with the motion (I believe they did this so that we would not create law here that would prevent them from continuing to do this). Basically their argument was that under the patriot act (provision on stored electronic communications) and the trap and trace statute (which allows agents to get your in-coming and out-going phone numbers without a warrant), they could obtain cell site info without probable cause. Mind you, my client was never alleged to have any involvement with terrorism and the case involved charges relating to a robbery. Moral of the story, if you are going to commit a crime, leave your phone at home.
