Neither CBP nor USBP has the slightest connection to investigations except an obligation to refer potential cases to HSI. Since HSI is a lateral agency and not in a position of influence to corral CBP and USBP in their attempts to usurp non-existent investigative authority, the entire system is running amok on a national scale. As is the case with any new bureaucratic invention, the usual hopes of enhanced information sharing and mission synergy have evaporated. HSI has reported that information they developed and shared with their CBP and USBP counterparts is often modified within automated information systems to restrict access only to CBP and Patrol personnel to the exclusion of HIS, who developed and provided it to them in the first place. Layers of bureaucratic fine print, immigration laws saturated with loopholes, and exceptions to exceptions, slow the process to a near halt. Dealing with the Immigration and Nationality Act (INA) and its loopholes requires the expertise of an agent who had come up through the system and not a recent transplant from the Customs Service. The Customs component of ICE was aghast at the amount of hand holding and political correctness that appeared the standard operating procedure of the INS. In the minds of many, there was no mystery as to why immigration was broken. Illegal aliens by definition have broken the law by entering the US without inspection.
