How does a gov. agency get to copyright anything? Are they a private and/or commercial entity?

It has been illegal to use seals or logos of government agencies for a long time. We would have like to use some of them on our website over a dozen years ago, and that was the policy then so we did not use them.


From the USA.gov website:

"You cannot use U.S. government trademarks or the logos of U.S. government agencies without permission. For example, you cannot use an agency logo or trademark on your social media page."

So the guys should have done some homework and changed that seal a little bit so it was not a copy of the NSA logo, then they would have been alright.

Nothing will change as it's happening incrementally to us over a long period of time. To be fair, if the jackass had made his own logo that was similar, there would be no claim. This is no different than someone using the Chicago Bulls logo on cheap shirts to make a buck.

If you use someone elses intellectual property a copyright injunction can be filed.
