Re: How do I prove that a bank surveillance video has been fraudulently altered
So you think a bank will have a video security system which anyone can just delete frames without leaving a trace?

1, The recording system will be on a battery backup so can't just be switched off.

2, Any altering of settings will be on a password and possibly recorded of whose password is used.

3, You cannot just delete frames from security footage. Cameras save complete video files to hard drives. They aren't MP4s, they're a secure format which don't allow tampering.

Something isn't right with your story: I don't believe you.

I know this because I use security cameras on a daily basis. I have access to them and burn off CDs as evidence (I work in a prison). I can guarantee you that a banks security camera system is more secure than the one I use.

Any good explanation for receiving an incomplete video?

Any MORON knows that a banks security system is secure. The question is, was the digital video fraudulently altered?

"Don't allow tampering"?

Re: How do I prove that a bank surveillance video has been fraudulently altered
I understand the disbelief but I get very angry when my credibility is inappropriately challenged. In fact, my wife and I have been totally confounded since February 1st when the Bank served us with Power of Sale documents and demanded vacant possession of our property.

This nonsense is so disturbing I feel heartsick. I get pains in my chest and I constantly rub it with my right hand at night because I feel like my heart is too sick to work on its own.

Home is not what it used to be. I want to sell our house and move away but the Bank has taken that option away as well because we can't do anything as long as our home is mortgaged with them and I feel like my entire family is being held hostage by their abuse.

I don't talk to anybody about the way I feel. This is the first time I have ever said/written anything about it because we are a proud family that does not go around looking for sympathy. I simply get furious when ANYBODY challenges my credibility and that is the only reason I am reacting in this manner.

It's how we instinctively survive. Stop responding and it's practically death. As for how my wife has been feeling, that's pretty obvious. She feels the very same way anybody else would who is inappropriately threatened by Power of Sale proceedings. I can merely try to assure her that as long as my credibility is not subject to be challenged by anybody, the Bank is going to lose this battle.

Please don't tell me to contact a lawyer unless you are willing to provide me with a $10,000 retainer, and that's merely a good start. This is Canada, lawyers get paid whether they win or lose and many of them rely on the Big Banks to make a comfortable living. It is consequently difficult to get anywhere without a retainer that is large enough for a lawyer to take the time that is necessary to effectively challenge the side with the bigger pockets.

If you actually know a Canadian lawyer who is able to assist by billing the Bank for his or her services (in Canada, loser pays for all legal fees) please send me his or her contact information and we will get the legal representation we deserve.

We probably do not qualify nor wish to apply for legal aid but will certainly speak to any lawyer who is willing to work on a Pro Bono basis.

did you have your phone with you at the time of deposit?

does it have gps or did u make any calls around that time?

If you can prove with phone data and stamped reciept you were there it should be enough to get the polce to invesitgate the bank for fraud,
You should go speak to any local places that have cctv nearby, and quickly because some places dont keep the recordings for long before they record over them.

get a laywer, or a pi.

Re: How do I prove that a bank surveillance video has been fraudulently altered
I walked into the bank, I handed the teller the invoice for our line of credit and 12 one hundred dollar bills to pay it, she took my money, gave me my change back and stamped the bill to confirm the fact that I had paid it. Normally, that would be the end of the story. No surveillance video required unless it has been fraudulently altered to dispute what I just described.

Everybody gets it except for the people at the particular branch that is denying payment and one or two severe skeptics who post on GLP.

My wife and I were confident that with a bank teller, stamped receipt in hand, the Bank would eventually accept the fact that the bill in question was paid. It never
did, the battle goes on and it will end when the Bank accepts payment or when it is forced to accept payment. END OF STORY.

In the meantime, the challenge moves forward very, very slowly. That's the court system.

Needless to say, like everybody, I thought I was playing poker with 4 aces in hand because it is difficult not to think that a stamped bank teller receipt is not as
good as gold. But the banks position is that the teller stamped the bill in error.

The last time I spoke to the Bank's lawyer, I tried to put this controversy to rest once and for all by trying to emphasize the strength of my hand (4 aces should be
impossible to beat). I flashed the stamped bill (thinking the game was over) and inquired, "How does she explain that?"
"She made a mistake and stamped the bill" he responded.
"I hope she has a good explanation for that" I said upping the ante, but my enthusiastic willingness to expose my hand was deflated by the words, "You'll see it in her affidavit."

And so, I am not able to respond to any more questions about the receipt the teller stamped as soon as she took MY cash, until I read her affidavit.

Any guesses on how that one will read?

This makes me worry about what could happen. Just an hour ago I did not have sufficient funds in my account to pay the mortgage, nor did my wife, but together we did.

I payed by calling her at her office and conferencing the Credit Union mortgage department and had them take approximately $1,600 from my account and $700 from my wife's account to pay the amount.

I have no receipt either--it was a phone transaction, most often that is how my mortgage is paid.

No, I stopped voluntarily paying, waiting for them to acknowledge payment, they raided my account and used it to "double pay" and it is my position that as long as the bank does not recognize my payments and applies them according to our written agreement (as they are contractually obligated to) they are in breach of contract.

I am talking to their lawyer because I am currently acting as my own attorney.

Relax, I have a receipt and it is making no difference.

Don't worry about getting ripped off until it happens. I am beginning to realize that you cannot prevent theft. All you can really do is deal with it when or if it happens.

This is an extreme case, has anybody else had a similar experience?

The line of credit, which is the payment that is not acknowledged, is linked to our mortgage. Regardless, we kept paying the mortgage until the Bank threatned us with Power of Sale, and then we stopped.

What's the point of paying a mortgage when the bank is threatening to sell your house?

So when we received the Power of Sale warning, I called the bank and said, "Listen, I understand that our line of credit and our mortgage are joined at the hip, so why don't we sit down like adults and make a new agreement so that we can continue to make our mortgage payments without the threat of Power of Sale?"

The Bank rejected our offer.

When they raided our account and took money out without our permission, everything collapsed. The check I had issued to pay my daughters rent for university bounced and the nightmare they created is indescribable because she goes to school out of town and I had to personally deliver payment.

We always try to meet our financial obligations as contractually obligated, not indiscriminately, as the Bank inappropriately demands.

With that you may get your missing eleven hundred dollars back. It won't help you with the unpaid payments though. The sensible thing would have been to continue making payments until the issue was resolved. That way you would only be 1 payment behind.

Why not try offering the past due amount and see what happens?

1) Move your banking to a new bank, so they can't sieze your money.

2) Pay the $1,100 dollars, to end the banks action against you.

3) File suite against the bank that they stole $1,100 from you.

This turns tables that you are suing the bank, not the bank suing you.

If your receipt is timestamped and the video is timestamped then they should correspond .. If they do correspond then the video has not been "altered" .. The only way that you can prove any type of fraud is the end of day cashing up if it shows over then that's the money not been accounted for ,if it shows under then it means either you or the cashier made a mistake and the courts take the side of money ..Unless you can prove otherwise which unfotunatley you can't ... so you have lost the money........

Put together all your documentation, including where you obtained the cash in the first place, item by item, and then get yourself down to the CBC, or get a reporter to interview you, asap.

It seems the only way Canadians can redress situations now is to get the media involved.

Also, post a YouTube video, and get your nice-looking wife or daughter to appear on camera.

Remember Amanda House when she went up against Loblaws last year?

Her video went viral, and the Loblaws CEO had to agree to meet with her because of all the media attention.

(Sadly, the supermarket chain has continued to stonewall, and her lawsuit is still creeping through the system.)

Justice in Canada against the BIG BOYS?
