Donald Eugene Miller Jr. walked out of Hancock County Probate Court on Monday as legally dead as ever.

In 1994, the court ruled that Miller was legally dead, eight years after he disappeared from his Arcadia rental home.

The same judge, Allan Davis, ruled Monday that Miller is still dead, in the eyes of the law. Miller's request for a reversal came well after the three-year legal limit for changing a death ruling, Davis said.

Miller, 61, now of Fostoria, spoke softly in court and offered few details about his past.

Miller said he was an alcoholic who was unsure what to do after losing his job.

"My paycheck was being taken away from me and I had nothing left," he said.

"It kind of went further than I ever expected it to," Miller said. "I just kind of took off, ended up in different places," he said.

He said he briefly worked odd jobs in Atlanta and Marathon, Fla., after leaving Hancock County sometime before 1990.

His parents informed him of his "death" upon his return to Ohio in about 2005, he said.

Miller told Judge Davis he neither sought alcohol treatment nor contacted his children in the time after he left.

Miller said he would like to start his life again, or "whatever's left of it." He asked the court to reverse its 1994 death ruling so he can reinstate his canceled Social Security number and driver's license.

The court said no.

Ha! I just read this earlier. Thanks for sharing OP. Made me think of my law school admiralty law class when the prof said if you don't claim your birth certificate by the time you're 7 yrs old any judge has to consider you legally dead.

He is also free from drivers licenses and taxes! Yes! Exactly!

The government and the slave agencies can only deal with fictions. That fiction was his birth certificate trust and it has been disolved. He is truly a free man. Unfortunately, it doesn't sound like he knows it. Sad.

Thanks for that Jenny!! Most people do not know their legal identity is considered "dead" anyway. Check with the IRS, they will have you listed as a "decedent" on the official record.

The courts always see you as a corpse, that is why the high priest (judge) wears black robes, to symbolize death.

Even though he has been declared dead he has a birth certificate, his family as next of kin can get for him.
He can legally change his name, from that birth certificate.
Then he can, find his social security number from his death and have it declare his, from an old name have his new name declared alive.

Unless he had a family that drew of his death benefits, there should be no problem. DNA and picture id, can be sent to the government if he wants to. That is the only thing I can thing to get his life back.

He would no longer be asking to declare this old name alive only his new one with a changed name legally changed on his birth certificate there are ways to prove to the government he is who he says he is with a new name. Even with his old sscard.

When I got married I did not know I had to put a new name on my sscard, so I could not draw unemployment, but when I add a new part of my name it changed, they transferred my ss money to the new name, just a different middle name with my last name.

Hmmm, there was a great site years back, something merchant info dot net?, but I believe it's defunct now. It's possible 1215 dot org has literature on this. My father is an old school lawyer with knowledge of this stuff and he cites that particular website, as well as Winston Shrout from time to time. However, I've come to learn that the pentagon shut down birth certificate trading, and Cesta Que Trust access, during the hurricane Sandy fiasco last year, if my partners' intel is accurate. Hope that helps a bit.

This happened to my sister, she move out of her rental because of an abusive roommate situation (a--hole punks trashing the place and partying all the time, she tried to have the landlord evict her roommates but it didn't work).
She moved in with me an my family for a bit longer than I'd have liked, but hey what are you gonna do you gotta help out your little sister. I'm not sure on the details but, a couple of years later she went to get a car loan, and found out she was dead. It took her almost a year to get recognized as living. All I know is it had something to do with her landlord. WTF are they really Lords?
