A few days ago we had a mandatory briefing on Data Privacy. Quoting: tandym It became very clear in the first 30 minutes that the rules they are implementing (between Europe's strict data privacy laws and transfer of data across borders) will shortly cause the paralyzation of the internet. Of course that won't stop major companies from swapping data in secret or governments from spying on you, but it will make it nearly impossible for small businesses to take advantage of the global marketplace without breaching these 'international' laws -- the fines and sanctions are very steep! It is my humble opinion that all of this hullaballoo about the NSA (which most of us already knew about years ago) and now things like this: [link to www.washingtonpost.com] Are only orchestrated talking points to get people behind the 'idea' of data privacy and the 'paralyzaton' of the internet for *our own safety*. I hadn't really made up my mind about this until today, but it is my opinion that nothing will stop these people from getting what they want and if they cannot convince our congress to enact a CISSPA-like referendum then they will simply go around it and force the US to comply with everyone else, thereby enacting by default. |

Ratified treaties either have equal weight with US Constitution or they may be above the US Constitution. For example, if a treaty was ratified that made private gun ownership illegal, many scholars believe that Congress could pass laws to implement that treaty even though those laws would violate the Constitution. Actually, the Supreme Court is hearing a case this session which will address this issue...
