Justice Roberts may not have sold us out, like it appears he did, but he may actually be rubbing our noses in it, like the owner of a puppy that just took a dump on the carpet.

The Roberts Trap Is Sprung

One of the most overlooked aspects of the year just ended is the vindication of Chief Justice John Roberts -- a vindication that showed up as the national catastrophe known as ObamaCare got rolling. Roberts may have also doomed Hillary Clinton's chance to live in the White House again.


The chief justice, an appointee of President George W. Bush and reputedly a constitutionalist in his jurisprudence, set his diabolical trap (diabolical to Democrats) on June 28, 2012, when he joined with the four liberal justices on the Supreme Court to uphold the constitutionality of ObamaCare. Conservatives and Republicans across the land were apoplectic. But in hindsight, it appears that Roberts actually saved the Republican Party from going into a death spiral and imperiled the Democrats instead. This suggests amazing foresight, but it wouldn't be the only instance.

Judas Roberts betrayed his country and his oath and contributed to the normalization of rule by fiat in the process. That traitor took it upon himself to legislate from the bench to change the wording of the law all by his unelected unrepresentative self to "justify" an unjust and unconstitutional law. What he did was nothing short of lawless. He ignored his own conviction that the law as written was unconstitutional and repeated his self reversal by doing what no judge should ever do in acting as a law maker instead of an adjudicator of the law that is written.

The only way this can be seen as a trap is if you accept his unrepresentative rule by fiat as some kind of slick legal slight of hand check on the legislative process. You have to accept that he had the authority to modify a law from the bench to even get to the "gotcha" moment. It is the death of a Republic.

I have never been so pissed at a government official.

Agree. Since Roberts ruled it Constitutional as a tax when others ruled it valid under the Commerce Clause, there was no real consensus of opinion at all to uphold it. He should have vacated the decision and remanded for legality on Robert's contention it was a tax, as it was not argued that way before the court. Screw that bastard. Rumor had it he looked pale as death in Court that day, and was blackmailed by NSA spying into the adoption of his kids from Ireland via Central America.

Obama's legacy is already the failure of ObamaCare.

The Senate took up a parliamentary trick often used to circumvent the Constitution. They grabbed a House bill, gutted out every word and put in the PPACA.

I don't think roberts was as prescient or clever as the article maintains.

But here is the thing if roberts had ruled correctly there would be a dem house now, obongo would be the put upon great leader who only wanted to help people and the hildebeast would be a lock for 2016.

Instead it is all unraveling for them.

Is it an issue of origination, or is it an issue of approval? If the Senate initiated it and the House approved it, wouldn't that assent/consent be exactly the same as the Congress's delegation of power to administrative agencies, which delegation has been resoundingly approved by the Supreme Court since the first agency was created in 1887 as the Interstate Commerce Commission, of which Thomas M. Cooley was appointed by President Cleveland as its first administrator?

Well it seems like for this elaborate trap to work you would need at least two key parts we don't have: an honest media and an intelligent electorate.

Outside of a few instances the media is still trying to turn shit into shinola. People that supported this monstrosity in the face of several warnings will not drop it now that those problems have surfaced. Obamacare will always be great, the problems are caused by evil corporations, republicans, insurance companies, etc.
