If the Senate initiated it and the House approved it, wouldn't that assent/consent be exactly the same as the Congress's delegation of power to administrative agencies, which delegation has been resoundingly approved by the Supreme Court since the first agency was created in 1887 as the Interstate Commerce Commission, of which Thomas M. Cooley was appointed by President Cleveland as its first administrator?
