Via Executive Order:Obama to order expansion of overtime pay for salaried workers!
President Obama will reportedly use his executive authority to order the Labor Department to change its rules this week to require overtime pay for millions of workers currently classified as "executive or professional" employees.

The New York Times, citing White House officials briefed on the announcement, reported that Obama would announce the rule changes on Thursday.

The new regulations to the 1938 Fair Labor Standards Act would mandate that businesses provide overtime pay for those who work jobs as varied as fast-food restaurant manager, loan officer, and computer technician. Currently, businesses are prohibited from denying overtime to a salaried worker making less than $455 per week. The rules that President Obama is proposing would increase that salary threshold, though it was not clear by how much.

Conservative groups have warned that Obama's planned change would lead businesses to reduce staff or cut pay.

For years I worked as an exempt employee which meant I got work lots of overtime and not get paid for it. I can understand not paying overtime for managers as a lot of them are way over paid to begin with. I have never understood the fairness of people in professional positions not being paid overtime. You are promised bonuses which are paid with favoritism for certain favored people and projects. You can work your ass off and then be told your project and work were maintenance and therefore you don't qualify for a bonus. Yet, without your maintenance the entire operation would halt.

There are people in union positions that out earn their management counterparts because of paid overtime.

Then again I don't think a decision like this by the President is a good move at this time because it further raises expenses for domestic businesses which drive more business outside the country.

Damn straight, it is. My company employs a lot of those loan officers he is trying to "help" with this nonsense. They forced us to pay minimum wage to nonproductive loan officers several years ago, and the response has been to fire anyone who has a bad month, because, as a business owner, why would I employ someone who is just costing me money? If we didn't have that rule, we would keep them on because, at least, they're not hurting anything by being nonproductive. Now, I have to pay them overtime for doing no business?! just because they happened to be around?! Yeah, ain't gonna happen. If this goes into effect, we're gonna watch those guys like a hawk, and the first time they give us a report that says no loans in process, they're gonna be flipping burgers.

The government does not have a right to change a contract period! Your employment contract is just that YOUR contract and you can negotiate it any way you see fit under any terms of agreement.


I say you will get paid X for doing this work, you sign the contract and you get paid if you do the work.

The amount of time it takes to do the work is not relevant to the contract of pay. If it was you could purposefully be inefficient to complete that work to get paid more.

A lot of salaries have efficiency bonuses worked in to them. Such as; Make the store more money or finish a job early and you get a bonus.

The government does not have a right to change your employee contract period. No one has the right to step in to your legal contract regarding anything, it’s a legally binding agreement between two parties that no outside party can influence.

I had a job working for 20k a year, took me three hours a week, after I got the job some lib above me thought they were overpaying me because I was efficient! But I got the job done and done well, had that jobs a very long time, great side job.

If you are an exempt professional employee you do not have a contract other than when you have to show up, where and you are expected to handle anything that you get. Bonuses are in a pool. Some people get big bonuses while others don't. Where I worked the pool of money kept getting smaller every year while the work piled up and the company made more and more money. The last 5 years there I worked 50-70 hour weeks. Got phone calls all the time when I was supposed to be on vacation. Comp time was a joke that got removed long ago. I doubt this will go through as none of the larger companies will want to pay it. They will just restructure everything so you won't get paid. This will cause much more outsourcing. A cost saving method in the past was to give supervisors 30 employees to cover rather than 15 and do away with the 2nd level manager and give the 3rd level manager all the responsibilities of the 2nd levels under him. Can't get the job done, your fired. No overtime pay. They will tell you that you have enough time to do the job and if you can't it is because you aren't good enough which is an open ticket for people to take their work home with them.

That's puts you in to the "employment at-will" legal specification, meaning they can terminate your services at any point for no reason. You are right, either out sourcing or severe reduction in salary is the end game, there is no minimum wage laws when it comes to "employment at-will". So to have "overtime" yet no right to make minimum wage makes it pointless.

Example; accountants, they work normal hours all year but at tax time they might work 16 hours a day 7 days a week till their clients are taken care of. They don't know year for year how many hours each client might need. This means with-out the ability of the firm that the accountant works for to know what they will be paying to their employees year to year, they will have to reduce the base salary for each accountant dramatically.
