The way I see it is, if any of the Native American tribes actually were interested in getting their supposed ancestors' bones back, they'd let the old guy know about it. Since the old guy seems to be nice enough, he'd probably send the bones to them and problem would be resolved there. Since the FBI's involved, this issue has gone from "can be civilly resolved without significant issues to WAY fubar".
