I think Home Modification Program plans to foreclose on my house
Fourteen years ago I went through a local Not-for-profit that offered free home buying classes and gave reduced FHA interest rates for participating in these classes. I found them extremely helpful and have been a proud homeowner ever since.

After becoming unemployed and using my entire 401k to care for my elderly parents in my home, I anticipated I may have problems paying my mortgage. The Not-for-Profit recommended asking my bank about the Making Homes Affordable Act. I did some research online and saw it had worked for many people. The people who had problems did so because of Mortgage companies who were initially hostile about the program. Or so I thought at the time.

MY mortgage company seemed very helpful and the process easy. They reduced my mortgage payment by $230/mo for a trial period of 4 months, whereupon as long as there were no judgements on my house (there are not), the program and payment would be made permanent.

I made my payments on time as I was told if I were even a minute late, the agreement would be null and void. During the trial period, I continued to receive letters from the Mortgage Co. saying I was delinquent on my original payment. I called them a number of times about this, and they told me to "disregard" those letters, they had to go out but they were aware I was in a modification trial period and was making my payments on time.

NOW after paying my last payment in my trial period, the mortgage company is harassing me. They repeatedly call and ask why I was able to make my payments "early?" I made the payments at the time of month I had for 14 years.

Now I realize what I've done. Now I see what HAMP (Home Modification Program) is REALLY doing to people. They told me this was really just a "refinance" for an 8% FHA loan.

What do they really do? They tell you your payment is lower for four months, deny your modification, then foreclose on your house for not making the proper payments.

I know I am in for one of the biggest fights of my life, and now I know what their next step will be. I was wrong. I was naive.

Thousands of people are being foreclosed on across the country because of this program. Some of us were decent hard-working folks that were living within our means but got screwed anyway, due to life's unforeseen circumstances.

Same thing happened to us...we went through the modification process to qualify and got approved for this program after jumping through all their hoops. They gave us a modified amount to pay but to show them good-faith, we paid OVER the modified amount.

After taking our payments for 6 months and assuring us that everything had been worked out, we got a notice that they were foreclosing on our home. We called the person at the bank that we were working with on our modification and their excuse?..."Our department does not communicate with the bank's foreclosure department." That was 3 1/2 years ago and we are STILL fighting them about this while our home sits rotting and abandoned, unsold and unmaintained.

This system is TOTALLY BROKEN and quite obviously meant to destroy the homeowner. Where is OUR "bailout"!

Gather all your payment evidence and bring it with your loan mod agreement to a lawyer to see what can be done to fend off foreclosure.

Most nursing home patients are now automatically enrolled in Medicaid, regardless of their income, pensions etc.

If you made your payments on the trial according to the trial plan you should be fine. Most people don't understand the inside of the bank, there is a foreclosure department, collections department and loss mitigation. They have also implemented a single point of contact system at the bank I work at, if you have one you need to get in contact with that person and make sure your loan is getting final modification documents sent out. Collections is harassing you because they get paid if you pay, foreclosure department cannot touch your file if your locked into a modification. Call the person who you spoke to in loss mitigation and explained the trial payments. They should have direct contact with the folks sending out your final modification paperwork.

One other thing if you currently have an FHA loan it is a bit more drawn out regarding the final modification since the bank who holds your note (servicer) has to get the funds from HUD (your investor) so they make what's called a partial claim to bring you current and to extend the term and lower the rate.... This will all be in your paperwork and you should have gotten trial payment paperwork also. Anyways, the partial claim is the 'approval' from HUD allowing the servicer to extend terms and/or reduce rates that were on your original note (original loan agreement) once that's in your final modification gets signed by you and then the terms become final or it 'books'

I am so sorry all this has happened to you. The loan modification is a scam! I have heard there are a few random success stories. The rest are stories like yours, scammed by the banks and foreclosed on.

Sorry not good advice, don't pay more money to have a lawyer get on the phone and call for you, I see this happen and it shouldn't. There are FREE resources for modifications. The one OP can use is 800-HOPENOW it's a free HUD hotline, the counselors will call your servicer and work with them for free since the general public is not loan smart.....I am not being rude or mean, but I thought when I started working I was helping people get out of trouble and helping them. What I found out is that most homeowners were completely clueless and it was more than sad. My heart hurt for people....I will never forget one lady I helped get a mod, her son was living with her or off her I should say and she was on fixed income and could not afford a thing, I found her a local food pantry and even called to see if they would be able to deliver!!! This woman would use her whole fixed income and pay the trial payments and when her modification booked I called her and we both cried.....it's really heart breaking, but I hope the few I am able to help really do benefit..... Then there are others who have 2 car payments that are more than their house payment each.... And they yell at me when I tell them they need to re evaluate their expense priorities .....or the single guy who claimed to be spending 2000 a month on food for himself, but when he sent in documents his statements show he was withdrawing 1000 from the casino..... Classic..... And his mortgage payment was $675 !!!!!

op get a lis pendens - s Lis Pendens filed as in other states, can, at least temporarily, stop foreclosure proceedings. a Lis Pendens serves as a legal warning that a lawsuit has been filed. however, more importantly, it discourages a lender from completing foreclosure. even if the lender ends up with title to the property, the legality of the foreclosure and lender ownership may be in question.

use in your complaint - lender in breach of fiduciary duty.

Get a Lawyer,same thing happened to my daughter.They strung her along for years and a week before Christmas they sent her a letter of foreclouser.I looked it up and it's a scam and they through the records out every 6 months.Now when they called and she said she had a lawyer they backed off.

That's exactly what they are doing. Happened to myself and 3 other people very close to me. I saved mine by selling it outright. They will put it up on auction and not tell you. You have to monitor county residential auctions- your house will show up. I sold mine for cash and made payoff b4 they could auction it off...I was not upside down tho- they took$100K from me to pay fines and late fees-12 years of mortgage gone, along with all my equity.

My life's investment- gone. I will never recover it.

Loan mods are a joke. Entered into one when my income dropped. Something was "lost" in the process and I was served for foreclosure. Meanwhile, the delinquency sent all my other APRs skyhigh.

With perserverence, the bank finally figured out their shit and admitted I was current. Didn't help my credit one bit, though. 3% APRs were suddenly 24% to 27%. I lost my "credit worthy" status.

I learned my lesson. Never borrow. Pay in cash and be done with it.

op get a lis pendens - s Lis Pendens filed as in other states, can, at least temporarily, stop foreclosure proceedings. a Lis Pendens serves as a legal warning that a lawsuit has been filed. however, more importantly, it discourages a lender from completing foreclosure. even if the lender ends up with title to the property, the legality of the foreclosure and lender ownership may be in question.

use in your complaint - lender in breach of fiduciary duty.

Same thing happened to us...we went through the modification process to qualify and got approved for this program after jumping through all their hoops. They gave us a modified amount to pay but to show them good-faith, we paid OVER the modified amount.

After taking our payments for 6 months and assuring us that everything had been worked out, we got a notice that they were foreclosing on our home. We called the person at the bank that we were working with on our modification and their excuse?..."Our department does not communicate with the bank's foreclosure department." That was 3 1/2 years ago and we are STILL fighting them about this while our home sits rotting and abandoned, unsold and unmaintained.

This system is TOTALLY BROKEN and quite obviously meant to destroy the homeowner. Where is OUR "bailout"!

Fight this with everything you've got. If you paid all your trial modifications on the exact date they were due under the trial loan mod and can prove same it we be difficult to foreclose on you. Gather all your payment evidence and bring it with your loan mod agreement to a lawyer to see what can be done to fend off foreclosure.
