According to Mark Levin, a Constitutional lawyer, and former member of the Reagan administration, says this is a waste of time.

First, the courts say you need both Houses in order to have standing in court which of course is a no go.

Levin pointed out that Congress has power of the purse which Boehner surrendered in the first days of assuming the leadership position.

At this point Impeachment is past due. Yes, the Senate could vote it down, but the process would either encourage Obama to stop violating the law or suffer the consequences of the public's increased attention to his violations.

Even if the Republicans win the Senate it still takes a 2/3rds majority, so waiting for a simple majority isn't an effective strategy.
