You need to look up the statue of limitations on credit card debts in your state.

For instance, CA has a four year statue of limitations for most credit account debts. That means four years after the date of default, the company or collections a-holes can no longer legally go after you. They can still harass you, but they have no legal recourse to collect a dime from you. If they continue to harass you, you just need to send a certified letter telling them to fuck off. If they don't, you can sue them.

The debt will still be on your credit reports for 7 years from the date of default, but after four years they can't legally collect.

Find the information in your state.

Oops, I made a mistake. The SHERIF ended up on my doorstep and was paid $58.00 to do it. It's in the letter... I wasn't home when he showed up. I'm going to edit my post... my bad!

No, it may have helped you. The statue of limitations is there to protect you. Find out what the length of time is in your state in the link above. If it is already past that date, the collectors can't sue you, garnish your wages, or seize accounts legally.

You need to take a deep breath. Try to separate this debt issue from the other legal issues you are having.

Learn the laws in your state regarding debt so you know where you stand legally with these collectors.

If you can't do that, then I would suggest finding free legal aid through your county.

Your credit is probably destroyed already thanks to them.
Bankruptcy costs about $2K, compared to the $50K you owe them now.
And yes, you can do just fine without credit. I have no credit score, yet have a mortgage, a car, and a stable job.
Can still fly, rent a car, etc.
Don't let them tell you you can't survive without a credit score.

First of all the original creditor has probably written off the debt and you will have to have a court order for them to garnish your wages. Go to court and contest the debt. Hell we should all show up at the Whitehouse and serve them on the fact that they are 18T in debt and can only make payments on that debt with fake printed money! They need to be charged with conterfeiting

I said I'll end up 50,000 in debt, kind of jokingly, after all this is finished.

But thank you, I kind of had the same line of thought... I really don't care about credit anymore. Or banks... maybe this will all do me a bit of good in the end, furthering in detaching me from the system- at least mentally. I'll do what I can to get out of banks and etc from here on out and just deal with cash only and hoard it all(possibly aiding the economic crash/depression). Come what may!

Now, you need to check your credit report(s). It will list the official default date reported by the original creditor. You need to know this from your report (not what the collectors will tell you.)

I should have added that if you have been served court papers (sounds like you have) then you will probably need legal help at this point.

There might be a free legal aid society where you live. Look this up and call them first thing tomorrow.

If a case has already been filed with the court, you can't ignore this any longer. Don't let it go until there is a judgement. It's almost impossible to go back and ask a judge to relieve you of a judgment, and the judgement debt usually will not be discharged in a bankruptcy.

Well, all I can say is this is a true story. I know the truth is hard to handle. And I've been terribly stupid and Idk what will happen next. I'm accepting the fact that my wages may be garnished and my accounts frozen, and I'll just hoard up all the left overs in cash for the next few years before I can get the fuck out of this state. Honestly, I feel like I already work for practically free...

But it still feels ridiculous that a SheriFFFFFF would end up at my doorstep over a small debt like this. It IS BULLSHIT.

And maybe I'm crazy but I can't help but connect it all to a psychological warfare that I've been increasingly aware of within the past year. Psychological, spiritual, whatever it is it's very real to me.

Statute of limitations over here in the UK is 6 years . I have used that myself when I hit bad times , what ya do in your position if it is less than the statute of limitations in your country is this , contact the credit card company that you owe the debt too offer them the $2k as a full and final settlement figure and you want it in writing that they accept it .And they WILL accept it trust me .
Your debt will disappear and you have it in writing that they have accepted the amount and there can be no recourse to the debt its wiped out .......This will work ..Unfortunately I have experience in being up shite creek without a paddle and have done the same thing....

Be very,very careful if you do this if you are considering using the statute of limitations. Held in default without payment there is no "acknowledgement" (this is legalese pretty much but I think you can see the point) on your part that the debt is yours once you contact/send even a partial payment etc. the statute very well may start all over again. Call a lawyer get some advice and they will tell you just exactly what you need to do or say to them in order to settle for less.
