We were married for 7 years. 5 before kids. He turned to drugs and eventually harder drugs and when all was said and done, he assaulted my mother who is elderly. He is LOST and his children are without a father because of it. Enforcing the support on him was supposed to be a last ditch effort to get him into jail which would lead to a treatment facility but instead her prefers meth houses and God knows what. Having the children was OUR choice and him choosing drugs and walking out on his family was HIS choice.

Going to court tomorrow and before the same judge again.

I won't give details except to say, the judge had ex parte communications with my ex wife's council and made a tentative decision on that basis.

This judge is notorious for ruling on opinion and emotion and not on fact and yes, I never knew there was such bias and contempt for men in the family court.

For those of you who make stupid statements such as, "Serves you right, wear a condom", you really don't know a goddamn thing about people who were married and in love at one time.

In my case, when I left my marriage, I gave my ex $85k IN CASH from investments I made instead of buying a home at the peak of the housing market like she wanted (late 2005).

I was already paying $500/child support for our son.

I agreed to let her have him as a tax right off at that time because he was only 3 and she being a school teacher had a more liberal and generous lifestyle in terms of time and therefore, I wanted my son to have a semblance of a normal life.

Add to this, I only have a high school education while she now has her Masters (some of which I contributed to while we were married and I worked), has since remarried, with him making over $125k/year himself, as well as them owning two homes, the second an income property, and he gets a company car.

I am in my son's life, active and more. He cries ALL of the time because he doesn't get to see me enough and sadly, I've switched careers (out of IT because of the downturn) since then and started two new businesses which have allowed me to see him more these past 5 years (he's almost 11). Do you think she would allow it? No. Do you think she ran to get a lawyer and try to stick me with the bill each time? Yes. Do you think she's making it difficult because she's an angry, hurt person? Absolutely.

Here's the thing though.

I'm representing myself pro se and on top of that, there has been SO much lack of consideration and cooperation from the court system that yes, I have documented everything (including ordering the appropriate transcripts). However, I've also made it a point to know and understand the law.

As such, it's the difference for knowing your rights, what the rules of the court are and when and where they are screwing you. That includes if they threaten with a bench warrant when they HAVE to give you an ability to pay hearing. And even with that, when I had a Hearing Officer try to enforce an order because it was still pending a reconsideration, this Hearing Officer (a woman) sat there and berated me, referring to my age and my being a male, so that I would some how be intimidated or embarrassed by her remarks?

Hey lady... I hate to tell you this, but I'm not moved by your feminist, sexist attitude and the fact that my own grandfather was a true deadbeat, HE being the one who left a family of SIX CHILDREN and then, selling the deed out from under them.

Guess what? I didn't do this and I am SO in my son's life and this is what my ex hates most. She would rather it be her, her new husband and our son, so she can have her fairy tale life, with all of the reality shows she can muster.

Thankfully, our son is smarter than that, aware and always has been. He asks deep questions, knows the system is a sham, is in touch with his inner spirit and when I ask, "What is the most important thing in life?" he replies, "To learn how to love and to help others to do the same."

Yeah, whatever happens, happens tomorrow, but as it stands, I'm not going in meek or quiet but will be sure to give the court quite an earful of law and a motion to dismiss as a result.

about the child support system

all systems may not do this,
but some of them do

you will have to check your own local
system to see if they do this

the system makes money off every child
in it's district, the more support the
judge slaps on the father, the more
the system makes

example:

there is a 30 day delay in the system,
a layover of funds.

If you pay $500 by August 1,
the mother does not get that money
til September 1st. got it ???

During that 31 days, the county system
moves all that money from ALL the fathers
that paid into a slush fund and is floated
on an interest bearing bond that draws interest
to another exchange who temporarily borrows
it for 28 days.

So in essence, if the county moves $1M
into the slush fund, then in 30 days
it gets back $1,030,000 as it bears
them a 3% interest while it is in hock

then the county moves that original $1M
back into the pay fund for mothers and
the county pockets the $30k as profit.

the more children they have in the scheme,
the more money they can make.

so the system is actually making money
off these children

and that is why there is a 30 day layover
of the money you pay and the time the
mother receives her child support

that support earns the county money
during those 30 days

He's not paying current child support for his grown children. He's paying down the ARREARS that he owed before they turned 18. ARREARS are in the PAST...as in DEBT.

The law states that no children can collect child support past the age of 18 unless they are still a full time student in high school and I believe some states make you pay if they're going to college and still living at home.

Don't get me wrong, the child support system in this country are fucking Nazis but if you owe, you owe for LIFE until it's paid. Whether they're 18 or 98. It's a criminal charge that has no statute of limitations.
