The main witness has recanted these events, there are several witness that DO NOT claim the officer shot him the in the back, and several witness that claim Brown, who had marijuana in his system "bum-rushed" the officer. This is corroborated by the PHYSICAL evidence gleaned from a number of autopsies showing he WAS NOT shot in the back.
