It's perfectly legal in most states including the one where this incident happened to have an unloaded firearm in the passenger compartment of a vehicle as long as it is in plain view and unloaded. Once again, who cares if there was a gun visible??? There's no need to search a locked car for something you can see. In the end, no charges were pressed against the kid who got slapped because he was not breaking the law. Considering how the cop was behaving, don't you think if even the smallest law was broken, this dude would not have been arrested? I'm honestly surprised the cop didn't make something up. They don't need a warrant if they have probable cause/reasonable suspicion that a crime has been committed , or is about to be committed. In this case, there was probable cause -- Deputy Glans saw the men behaving suspiciously, and then he saw a semi-automatic rifle laying in the back seat of the car. For all the deputy knew, the rifle could have been stolen, or could have been loaded with more than the amount of bullets allowed by the SAFE Act. Or, the guys could have been out shooting people. The deputy had probable cause for a search, and the civilian should have cooperated -- then everything could have been cleared up and they would have been on their way. |

If there was probably cause, he wouldn't have stated that he was going to get a warrant. He would have just searched the car. He knew no crime was comitted, so he was hoping to find some pot or something in the vehicle so he could jam them up. He was fishing. Acting suspiciously is not probable cause so search a vehicle, unless said person is in the vehicle. And walking back to your car is not acting suspiciously. For the 50th time, there is no need to search a car for something that is in plain view. |
