They got their start in the "big bucks" litigation back during the asbestos days (Google this - you can put 2 and 2 together). I do clerical work and occasionally assist in court, mostly keeping information packets together and at the ready so that the attorneys are prepared for on the fly changes in the courtroom. I'm good at what I do, and as such I am trusted. Often times I overhear things, because the attorneys will talk freely with me in the room. If for any reason Dec 14 is meaningful legally (or was chosen as a symbolic date for some kind of legal action) I think major sales might be significant. Lawsuits are not the only kind of legal recourse; we could be talking settlement agreements, some kind of arbitration, either as a group or as individuals. The first thing Sedensky (?) did was swiftly divide families who lost a child from those who didn't, creating what I think is a sad and unnecessary separation between people who could have supported each other better together. But for legal/liability reasons, the people doing damage control wanted to whittle the number of "injured" down, down, down, until they had a neat little group, with everyone else excluded. What about the kids who hid in the Room 10 closet but possibly didn't see anything? What about the little girl in the Room 6 bathroom who heard godawful things right on the other side of the wall (her family is not included in "the twelve" survivor families)? What about the blood covered girl from a completely different room who to this day has not been acknowledged or included as injured/affected? What about the kids in Room 12 who, best we can tell, were NOT hiding safely in the bathroom? What did they see and hear? What about the kid who was both a witness AND had his house burn down--had anyone really investigated to see if that was witness intimidation? His family, too, was not included in "the twelve," even though he said he saw bullets come into his classroom (Room 12) from the outside parking lot. And who came up with the idea in the first place that the only classes affected were in rooms 10 and 8? Why other kids who also saw bodies be included? It's all lawyers' games in the end. |

The media has been almost completely silent on lawsuits--this is the first I can recall seeing. This is also the first time in history, as far as I know, that anyone but us has raised the 2 year statute of limitations issue. "With a week to go before the deadline to file litigation in the wake of the Sandy Hook Elementary School attack, no lawsuits had been filed against the town of Newtown or any municipal employees...The state statute of limitations to file litigation for personal injury claims alleging negligence is two years from the date of injury, according to state law." [link to www.middletownpress.com] One self-proclaimed lawyer on another forum stated the statute was not always 2 years, and could be as long as 5 years in some cases. Don't know if she's telling the truth. "Attorney David Grogins of Danbury, who is Newtown’s town attorney, said this past week that he is unaware of any claims against the town [and] if anyone were to file one...it would likely be by late this coming week..." “I think it would be a difficult case to prove, but that doesn’t mean nothing will be filed,” Grogins said." Notice this line: "...no lawsuits had been filed against the town of Newtown or any municipal employees." Wow, that's pretty limiting. Nothing about the state overtaking the scene, the state declaring itself responsible, the state taking it upon itself to decide how the parents were to be taken care of, etc.? It's all about suing Newtown? Interesting. And there's certainly nothing in there about the two state vehicles, in particular, that parked in the middle of Dickinson and were left abandoned, preventing ambulance travel as early as 10:00 a.m. (and which police in their reports blamed on "parent vehicles.") But..."The deadline to sue the state passed last year, according to state officials." However, later in the same article, Bridgeport attorney Robert Berke who received one call from someone interested in litigating, casually expressed that someone might actually have two years, not one, to sue the state: "Berke said if anyone were to sue in federal court, they would have three years to do so, rather than the two years in state court." Much, much more info in the article. The journalist apparently contacted Pinsky, parents, the city, the state, and others, making him the only individual in the media to have truly looked into Sandy Hook lawsuits as far as I'm aware. |
