Breathalyzer seems like self incrimination. Can you plead the 5th? Let your lawyer fight it out. The cops have less of a legal leg to stand on without documented proof. I believe you can ask for a lawyer at any point but you will be arrested and processed and I doubt they will be nice about it! |

This is a good plan in theory, but most states now have 'implied consent' laws, in which if you are operating a motor vehicle you are automatically implying your consent that if you get pulled over you will comply with DUI protocol. In some states, this means if you refuse a breathalyzer they'll forcibly take your blood or cath you for urine. And they will do so legally - indeed, if you resist you will be charged with additional crimes and may be shot and killed for your efforts - all within the legal parameters we've granted these fucks. |

The accident caused by a 2-beer person can be just as severe and life changing as a 6-beer accident. but the kid was a .018... probably less than taking cough syrup. if someone gets in an accident with a .018 it wasnt the alcohol that caused the accident. . |

If you are charged with DUI and you license suspended, demand a jury trial and read both fourth and fifth Amendments of the bill of rights, AND REST YOUR CASE.Since they have no evidence, there is no case against you. They CANNOT revoke your driver license without a legal cause and you have broken no law refusing. The requirement to provide evidence against yourself is based on the legal fallacy that driving is a privilege and not a right. Juries typically disagree. The instant they charge you with a criminal offense that fallacy evaporates, privileges cannot be dictated by law and there is no such thing as a privilege involving law, which applies to everyone with equal force whether you are privileged or not. Then you forfeit your license. i believe it is 'their' license, it says so on the back .. There are all kinds of legal fallacies floating around and this is one of them. A license is conditional only upon your abiding in the law, and breaking the law or failing to meet the physical requirements that are required is the only way it can be taken from you (unless you allow it without a fight). The license is yours, it has your name on it, you applied for it, took the tests and paid for it to validate your competency to drive. This is the only reason we have licenses, not to prove we have the privilege to drive. |

The cop says the reading is .016 and claims the kid is over the limit. The kid counters and stands up for himself by pointing out to the cop that .016 is not over .08. The cop then realizing his mistake takes the "I'm a cop" mentality and continues to arrest even though he knows what he is doing is wrong....My two cents....the cop is a douche. |

Maybe you should reread what I wrote previously. No sense in me writing more when you didn't do such a good job on the first response. Yes, I did cure my Stage 4 cancer in two weeks when I was 48. I also reversed my chronic kidney disease (glomerulonephritis) when I was 25. In neither case were any medical treatments involved. |
